A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AN
AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF
BOYNTON BEACH AND PALM BEACH COUNTY PROVIDING
COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS FOR
PARK IMPROVEMENTS IN THE CITY OF BOYNTON
BEACH, PROVIDING FOR AN EXTENSION OF TIME TO
COMPLETE SAID PROJECT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Palm Beach County and the City of Boynton Beach
had previously entered into an Agreement which provided
Community Development Block Grant Funds for park improvements in
the City of Boynton Beach; and
WHEREAS, the parties wish to extend the expiration date of
said Agreement from March 29, 1996 to January 30, 1997;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida does hereby authorize the Mayor and City Clerk to
execute an Amendment to the Agreement between the City of
Boynton Beach and Palm Beach County, providing Community
Development Block Grant Funds for park improvements mn the City
of Boynton Beach, providing for an extension of time to complete
said project. A copy of said Amendment is attached hereto as
Exhibit "A"
~ That this Resolution shall become effective
immediately upon passage.

W I T N E S S E T H:
WHEREAS, Palm Beach County entered into an agreement with
the City of Boynton Beach, on February 21, 1995, approved by
Document R95-220 D, to provide $229,508 in Community
Development Block Grant funds for park improvements in the
City of Boynton Beach; and
WHEREAS, the parties wish to extend the expiration date
of the agreement from March 29, 1996, to January 30, 1997;
and
WHEREAS, both parties mutually agree that the original
agreement entered into on February 21, 1995, is hereby
amended as follows:
I. Part III Section 1, Maximum Compensation , lines 9
& 10: Substitute "January 30, 1997" for March
29, 1996".
II. Part III Section 2, Time of Performance, last line:
: Substitute "January 30, 1997" for "March 29, 1996"

Work Schedule: Delete the'entire clause and
replace it with the following: The time frames for
completion of the outlined activities shall be

The time frames for completion of the outlined
activities shall be strictly adhered to by the Municipality.
The Municipality shall provide HCD with documentation
evidencing completion of the activities by the identified
dates no later than 10 calendar days after each date. HCD
shall, in its sole discretion, establish if the documentation
submitted is sufficient to deem an activity to have been
completed. HCD reserves the right to terminate this
agreement at any time as provided for in Part IV, paragraph
12.
NOW THEREFORE, all items in the previous agreement in
conflict with the amendment shall be and are hereby changed
to conform to this amendment.
All provisions not in conflict with this aforementioned
amendment are still in effect and shall be performed at the
same level as specified in the Agreement.
