5 OF BOYNTON BEACH, FLORIDA,
6 DESIGNATING AN AREA WITHIN THE
7 BOUNDARIES OF THE BOYNTON BEACH
8 COMMUNTIY REDEVELOPMENT AREA A
9 BROWNFIELD AREA; AND PROVIDING AN
10 EFFECTIVE DATE

13 WHEREAS, the Florida Browntield Redevelopment Act, Sec. 376.77 through Sec.
14 376.85, Fla Stat. (2002) (Act) provides for local governments to designate by resolution
] 5 areas consisting of one or more brownfield sites as "brownfield areas" for the purpose of
16 environmental remediation, rehabilitation and economic redevelopment; and
17
18 WHEREAS, the City of Boynton Beach, Florida, desires to designate, pursuant to the
] 9 Act, an area of the Boynton Beach Community Redevelopment Agency (CRA) as delineated
20 in the attached map, as a Brovvntield Area to secure the benetits accruing under the Act; and,
21
22 WHEREAS, a municipality may declare an area within a Community
23 Redevelopment Area a browntield area, and,
24
25 WHEREAS, the Community Redevelopment Director has requested brownfield
26 designation as a means of obtaining incentives for redevelopment of property within the
27 Community Redevelopment Area.

29 WHEREAS, brownfield designation will enable property owners to voluntarily use
30 State Brownfield Programs for environmental remediation, rehabilitation and economic
31 development; and,

33 WHEREAS, per Florida Statutes 376.80(1), any property owner within the
34 Brownfield Area may have their property removed from the proposed designation by
35 requesting so in writing to the City, and,
36
37 WHEREAS, the City has complied with the procedures outlined in the Act and has
38 provided notice as required by Sec. 166.04](3)(c)2 Fla. Stat.

40 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
41 THE CITY OF BOYNTON BEACH, FLROIDA, THAT:

43 Section 1. Each Whereas clause set forth above IS true and correct and
44 incorporated herein by this reference.

46 Section 2. The boundaries of the Brownfield Area are depicted on the map
47 prepared and provided by the Community Redevelopment Director which is attached hereto
48 as Exhibit "A" and incorporated herein by reference. The Brownfield Area lies completely
49 within the boundaries of the Boynton Beach Community Redevelopment Area.

This resolution shall become effective upon its adoption following two
