3 A RESOLUTION OF THE CITY COMMISSION OF THE
4 CITY OF BOYNTON BEACH, FLORIDA, FORMALLY
5 ACCEPTING A DEED AND THE ADDITIONAL RIGHT-OF-
6 WAY REQUIRED FOR THE WIDENING OF BOYNTON
7 BEACH BOULEVARD EXTENSION, EAST OF FEDERAL
8 HIGHWAY; AND PROVIDING AN EFFECTIVE DATE.

10 WHEREAS, the Community Redevelopment Agency (CRA) purchased the property
11 once known as the Relax Inn/Boynton Lodge at the southeast comer of Boynton beach
12 Boulevard Extension and federal Highway; and
13 WHEREAS, the CRA gave the necessary right-of-way to the City of Boynton Beach
14 for the widening and improvements to Northeast 2nd A venue; and
15 WHEREAS, the transfer of the right-of-way was never completed by Deed and
16 acceptance by the City of Boynton Beach; and
17 WHEREAS, the City Commission of the City of Boynton Beach upon
18 recommendation of staff, deems it to be in the best interest of the citizens and residents of the
19 City of Boynton Beach to accept the Deed and additional right-of-way for the widening of
20 Northeast 2nd Avenue.
21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
22 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
23 Section I. The foregoing "Whereas" clauses are hereby ratified and confirmed as
24 being true and correct and are hereby made a specific part of this Resolution upon adoption
25 hereof.
26 Section 2. The City Commission of the City of Boynton Beach hereby approves
27 and accepts the Deed and additional right-ot~way for the widening of Northeast 2nd Avenue, a

1 copy of the deed is attached hereto as Exhibit "A".
2 Section 3. That this Resolution shall become effective immediately upon passage.
3 PASSED AND ADOPTED this ~ day of November, 2009.
