R09-181 '\' II I 1 RESOLUTION NO. 09- / €I I 2 3 A RESOLUTION ADOPTED BY THE CITY COMMISSION OF 4 THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING 5 THE CITY OF BOYNTON BEACH TO lNITIA TE THE 6 NEGOTIATION PROCESS FOR AN INTERLOCAL SERVICE 7 BOUNDARY AGREEMENT BETWEEN THE CITY OF BOYNTON 8 BEACH AND PALM BEACH COUNTY, PURSUANT TO 9 CHAPTER 171, PART II, FLORIDA STATUTES; PROVIDING 10 THAT THIS RESOLUTION SHALL ACT AS THE REQUIRED 11 INITIATING RESOLUTION UNDER CHAPTER 171.203, 12 FLORIDA STATUTES; AND PROVIDING FOR AN EFFECTIVE 13 DATE. 14 15 WHEREAS, the City Commission of Boynton Beach deems it to be in the best 16 .nterest of the City to negotiate an Interlocal Service Boundary Agreement with Palm Beach 17 'ounty for the area described in Exhibit '"A" attached hereto and by this reference made a part 18 ereof; and 19 WHEREAS, the City of Boynton Beach desires to annex properties within the Palm 20 each County Urban Services Area boundary; and 21 WHEREAS, the area described in Exhibit '"A" is within the future annexation area of 22 he City of Boynton Beach as set forth in the Intergovernmental Coordination Element of the 23 ity's Comprehensive Plan; and 24 WHEREAS, Chapter 171, Part II, Florida Statutes, establishes a more flexible process 25 f adjusting municipal boundaries through intergovernmental coordination in planning and 26 ervice delivery; and 27 WHEREAS, Chapter 171.203(1)(a), Florida Statutes, provides that other 28 unicipalities may be invited to also participate in the Interlocal Service Boundary 29 greement negotiations and the City of Boynton Beach is aware that the Town of Lantana, 30 he Village of Hypoluxo and the City of Delray Beach may desire to be included in the 3\ egotiations. - I - \. apps3\autuIData\38\ltems\38\514\369\Reso _ - _ISBA.docl \apps3\autoIData\38\ltems\3 g\5 14 \369\Reso . ISBA. doc II I 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 2 BOYNTON BEACH, FLORIDA, THAT: 3 Section 1. The above referenced whereas clauses are incorporated herein by 4 eference. 5 Section 2. The City of Boynton Beach, Florida hereby agrees to negotiate in good 6 faith with Palm Beach County, in accordance with Chapter 171.203, Florida Statutes, 7 egarding a streamlined annexation and land use amendment process for property currently in 8 he unincorporated area of the County as outlined in Exhibit "A", a copy of which is attached 9 ereto and incorporated herein by reference; and further agrees to address during the 10 egotiations the issues outlined in Section 2 and 3 herein; II Section 3. The City of Boynton Beach agrees that negotiations regarding an 12 nterlocal Service Boundary Agreement will address, at a minimum, issues concerning service 13 elivery, fiscal responsibilities, and boundary adjustment as they concern the City's and the 14 ounty's responsibilities for the funding and delivery of the following services; 15 I. Public safety. 16 2. Fire, emergency rescue. and medical. 17 3. Water and wastewater. 18 4. Road ownership, construction, and maintenance. 19 5. Conservation, parks, and recreation. 20 6. Stormwater management and drainage. 21 Section 4. The Town of Lantana, the Village of Hypoluxo, the Town of Ocean 2 Ridge, the Town of Briny Breezes, Village of Golf and the City of Delray Beach are hereby 3 nvited to participate in the Interlocal Service Boundary Agreement negotiations. However, 4 er Chapter 171.203(2), Florida Statutes, they must, within sixty (60) days of the effective 5 ate of this resolution, adopt a responding resolution in order to participate. 6 Section 6.
