09-048 II 1 ORDINANCE NO. 09-048 2 3 AN ORDINANCE OF THE CITY COMMISSION OF THE 4 CITY OF BOYNTON BEACH, FLORIDA AMENDING 5 CHAPTER 2 "ZONING", SECTION 1l.H.16.e(10) OF THE 6 CITY OF BOYNTON BEACH LAND DEVELOPMENT 7 REGULATIONS TO PROVIDE FOR PARKING 8 REQUIREMENTS FOR MARINAS THAT DO NOT HAVE 9 COMMERCIAL VESSELS; PROVIDING FOR 10 CONFLICTS, SEVERABILITY, CODIFICATION AND AN 11 EFFECTIVE DATE. 12 13 WHEREAS, the Development Department has made recommendations to amend the 14 Land Development Regulations to provide for parking requirements for marinas that do not 15 have commercial vessels; and 16 WHEREAS, the City Commission has considered the recommendations and finds that 17 the amendments will be an improvement to the IPUD zoning district and corridor, and provide 18 the ability for non-commercial marinas to provide services to the public. 19 WHEREAS, the City Commission finds that the proposed amendment is in the best 20 interests of the public's health, safety, and welfare, and provides a mechanism to promoting 21 desirable development activity and growth in the City's tax base. 22 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 23 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 24 Section 1. The foregoing whereas clause is true and correct and is now ratified and 25 confirmed by the City Commission. 26 Section 2. That Chapter 2, "Zoning", Section 11.H.16.e(lO) of the City of Boynton 27 Beach Land Development Regulations is hereby amended to read as follows: 28 (10) Marinas: One (1) parking space per boat slip, plus required 29 parking spaces for any other principal uses, including hotels and 30 motels, restaurants, retail floor area, Charter boats, sightseeing 31 boats, drift fishing boats, and outdoor lots occupied by boats for \ \apps3\aulo\Dala\63 \Ilems\63 \852\394 \Ordinance _ - _Mari na_ Parking_ Reglualions _ ( 12-09). doc - I - II t I sale or for rent. Marinas without commercial vessels: One (1) 2 parking space per five (5) wet or dry storage slips. and one (1) 3 parking space per 500 square feet of boat sales showroom. 4 5 Section 3. Each and every other provision of the Land Development Regulations 6 not herein specifically amended, shall remain in full force and effect as originally adopted. 7 Section 4. All laws and ordinances applying to the City of Boynton Beach in 8 conflict with any provisions of this ordinance are hereby repealed. 9 Section 5. Should any section or provision of this Ordinance or any portion thereof 10 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the II remainder of this Ordinance. 12 Section 6. Authority is hereby given to codify this Ordinance. 13 Section 7.
