CITY OF BOYNTON BEACH, FLORIDA, ADOPTING 5 FEES FOR ACTIVITIES WITHIN CITY OWNED 6 RIGHTS-OF-WAY AND CONTROLLED EASEMENTS 7 IN THE CITY OF BOYNTON BEACH, AND PROVIDING 8 AN EFFECTIVE DATE. 9 10 11 WHEREAS, the City Commission for the City of Boynton Beach, Florida adopted 12 Ordinance No. 74-17, which provided requirements and controls as to construction and 13 restoration within the City's rights-of-way including permits, applications fees and other 14 requirements; and 15 161 WHEREAS, the City previously adopted an ordinance, specifically Ordinance No. 17 81-6, which adopted a new "Code of Ordinances", which superceded all general and 18 permanent ordinances adopted on or before July 1, 1980, repealing those that were not 19 recognized and continued in force by reference; and 201 21 WHEREAS, said Ordinance No. 74-17 was not recognized and continued in force by 221 reference; and 2311 241 WHEREAS, the CITY subsequently adopted Ordinance No. 95-02, separating the 25\ Land Development Regulations (LDR) into a document which was made available to the 2611 public as a separate set of rules and regulations for development and improvements within the 2711 City; and 2811 291 WHEREAS, in the LDR, Chapter 22, Article II, Section 3 (Permit Fees), fees for 301 work within the rights-of-way, shall be as established by the City Commission from time to 311. time by resolution; and 3211 3311 WHEREAS, the City Commission did adopt Resolution No. 00-89 on July 5, 2000, to 3411 establish an initial fee and permit structure for work within the city's rights-of-way as being 351 monitored by the Department of Public Works, Engineering Division; and 36 371 WHEREAS, the City Commission deems it to be in the best interest of the citizens 38i and residents of the City to adopt an updated fee schedule for work within its rights-of-way. 39 40 41 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMMISSION OF 42 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 43 44 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 451 being true and correct and are hereby made a specific part of this Resolution upon adoption 46 hereof. 47! I ! The definition of public rights-of-way means the surface, the air space 2 above the surface, and the area below the surface of any public street, highway, roadway, 3 land, path, alley, sidewalk, boulevard, drive, bridge, tunnel, parkway, waterway, public 4 easement or similar property in which the City now or hereafter holds any property interest, 5 which, consistent with the purposes for which it was dedicated, may be used for the purpose 6! of constructing, operating and repairing an access system, functional operating system, utility 7: service system, cable system or open video system. Public rights-of-way do not include I 8 I buildings, parks, or other property owned or leased by the City. 161 Section 3. The City Commission authorizes and approves the Department of I 11 I Public Works, Engineering Division to continue to monitor, address and issue permits for 12 those activities desiring to use the rights-of-ways and easements situated under the control of 131 the City of Boynton Beach. 141 Section 4. The Schedule of Fees for the Department of Public Works, Engineering 15 I 16 I Division to charge for those services noted in Section 2 above are attached hereto and 17 I incorporated herein as Exhibit "A" and Exhibit "B". 18 I 19 I Section 5. That this Resolution shall become effective immediately upon passage.
