AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 2
ZONING, LAND DEVELOPMENT REGULATION SECTION 6 (E)
(1); PROVIDING THAT ALL APPLICATIONS FOR CONDITIONAL
USES LOCATED WITHIN THE CENTRAL BUSINESS DISTRICT
AND THE COMMUNITY REDEVELOPMENT AREA SHALL BE
CONSIDERED AND REVIEWED BY THE PLANNING AND
DEVELOPMENT BOARD; PROVIDING THAT EACH AND EVERY
OTHER SECTION OF CHAPTER 2 NOT SPECIFICALLY
AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT;
PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION
AND AN EFFECTIVE DATE.
WHEREAS, the City Commission has determined that it is necessary to make
uniform all review process for site plans and conditional uses with respect to functions and
duties of the planning and development board; and
WHEREAS, in the interests of efficiency the City Commission has determined that
the functions and duties of the CRA board within the CBD and CRA district are best
)erformed by the planning and development board; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COI'i/IMISSION OF THE CITY OF
BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Chapter 2, Zoning, Land Development Regulation, Section 6 (E)
[1), is hereby amended by adding the words and figures in the underlined type and by
:leleting the words and figures in the struck-through type as follows:
Sec. 6 (E) (1) Permitted and conditional uses. Within the central
business district, no building, structure, land, or water, or portion
thereof, shall be used except for one or more of the following uses
listed below. Uses specified below which are followed by an asterisk
(*) shall be deemed to be conditional uses, which may be considered
and granted in accordance with Section 11.2 of these zoning

applications within the CBD and the CRA district shall be considered
and reviewed by planning and development board in all proceedings.
Section 2. Each and every other provision of Chapter 2 not herein specifically
amended shall remain in full force and effect as previously enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith be and the
same are hereby repealed.
Section 4. Should any section or provision of this ordinance or portion hereof,
~ny paragraph, sentence or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this ordinance.
SeCtion 5. Authority is hereby granted to codify said ordinance.
Section 6. This ordinance shall become effective immediately upon passage.
