AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING THE APPLICATION OF RICHARD
BASEHART OF BASEHART CONSULTING, INC.,
AGENT FOR WOOLBRIGHT PARTNERS, INC., (A
5.89 ACRE PARCEL LOCATED AT THE
SOUTHWEST CORNER OF 1-95 AND
WOOLBRIGHT ROAD, APPROXIMATELY 390 FEET
SOUTH OF WOOLBRIGHT ROAD); AMENDING
ORDINANCE 91-70 OF SAID CITY BY REZONING
A CERTAIN TRACT OF LAND MORE
PARTICULARLY DESCRIBED HEREIN, FROM
PLANNED INDUSTRIAL DEVELOPMENT DISTRICT
(PID) TO C-3 (COMMUNITY COMMERCIAL);
PROVIDING FOR CONFLICTS, SEVERABILITY AND
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida
Ihas adopted Ordinance No. 91-70, in which a Revised Zoning Map was
adopted for said City; and
WHEREAS, Richard Basehart of Basehart Consulting, Inc., agent for
~Voolbright Partners, Inc., owner of the property more particularly described
lereinafter, has heretofore filed a Petition, pursuant to Section 9 of Appendix
a,-Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the
purpose of rezoning a certain tract of land consisting of 5.89 acres, said land
being more particularly described hereinafter, from Planned Industrial
Development District (PID) to C-3 (Community Commercial); and
WHEREAS, the City Commission deems it in the best interests of the
inhabitants of said City to amend the aforesaid Revised Zoning Map as
~ereinafter set forth.
NOW, THEREFORE, BE ]'T ORDAI'NED BY THE C'rTy
Si'ON OF THE CI*TY OF BOYNTON BEACH, FLORI'DA, THAT:
Section 1; The following described land, located in the City of
Boynton Beach, Florida as set forth as follows:
A 5.89 acre parcel described as
parcel 3A, of the plat of Boynton
Commerce Center, according to the
plat thereof, as recorded in plat
book 46, pages 126 and 127 of the
Public Records of Palm Beach County,
Florida.
and the same is hereby rezoned from Planned ]:ndustrial Development District
to C-3 (Community Commercial). A location map is attached hereto as
"A" and made a part of this Ordinance.by reference. Attached as Exhibit
is a copy of the conditions/requirements for this rezoning, which are
]corporated herein.
Section 2____/.' That the aforesaid Revised Zoning Map of the City shall be
mended accordingly.
Section 3' All ordinances or parts of ordinances in conflict herewith are
ereby repealed.
Section 4: Should any section or provision of this Ordinance or any
thereof be declared by a court of competent jurisdiction to be invalid, such
lecision shall not affect the remainder of this Ordinance.
Section 5; This ordinance shall become effective immediately upon
