4 A RESOLUTION OF THE CITY OF BOYNTON
5 BEACH, FLORIDA, RECOMMENDING THAT W AL-
6 MART STORES EAST, LP STORE NO. 5911 BE
7 APPROVED AS AN ELIGIBLE BUSINESS PURSUANT
8 TO SECTION 288.107(1)(E)2, FLORIDA STATUTES;
9 ELECTING TO CONTRIBUTE LOCAL FINANCIAL
10 SUPPORT; PROVIDING AN EFFECTIVE DATE.

12 WHEREAS, the Legislature of the State of Florida has created and amended Section
13 288.107, Florida Statutes, to encourage Brownfield redevelopment and job creation; and
14
15 WHEREAS, Wal-Mart Stores East, LP ("\Val-Mart") wishes to add a business unit
16 in the City of Boynton Beach (the "City"), which is identified by Wal-Mart as Store no.
17 5911, and projects to hire two hundred and twenty five (225) new associates within one (1)
18 year of completing construction and obtaining a certificate of occupancy; and

20 WHEREAS, the business UnIt that Wal-Mart wishes to add \vill be constructed on
21 land currently located in the City of Boynton Beach. Palm Beach County, Florida as more
22 specifically described in Exhibit A; and
23
24 WHEREAS, the parcel that Wal-Mart wishes to add its business unit on is located
25 \vithin a Brownfield Area previously designated by the City pursuant to Resolution R-09-
26 173; and

28 WHEREAS, the business unit that Wal-Mart Wishes to add will be important to the
29 City in terms of jobs created and wages paid as well as the new businesses, johs, and wages
30 that will be created by others as a result ofWal-Mart's presence In the City.

32 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
33 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

35 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
36 being true and correct and are hereby made a specific part of this Resolution upon adoption
37 hereof.

39 Section 2. The City Commission hereby recommends Wal-Mart be approved as
40 a Brownfield Redevelopment Bonus Refund Eligible Business pursuant to Section
41 288.107([)( e )2, Florida Statutes.

43 Section 3. The City Commission hereby elects to provide a local match of five
44 hundred dollars ($500.00) for each job created by Wal-Mart at Store no. 5911 (hereinafter,
45 the "Local Match"). For purposes of this paragraph, the term "job" shall mean full-time
46 equivalent positions as that term is defined at Section 288.1 07( 1 )(f), Florida Statutes.

2 Section 4. The Local Match shall be based on the number of jobs certified by the
3 Governor's Office of Tourism Trade and Economic Development and transmitted by the
4 City to Wal-Mart over a five year period in equal installments. The first payment shall be
5 made no later than twelve (12) months following issuance to Wal-Mart of a cenificate of
6 occupancy for Store No. 5911.

8 Section 5 This Resolution shall become effective immediately upon passage.
