Councilman Warnke presided at the meeting in the absence of both
~he Mayor and Vice Mayor. He called the meeting to order at 7:30
p.m. and gave the Invocation, followed by the Pledge of
Allegiance to the Flag led by Councilman Hester.
AGENDA APPROVAL
Councilman Zimmerman requested that the following items be
withdrawn from the Consent Agenda: A, D-3, F and J. City Manager

29, for the Thanksgiving holiday.

Report concerning limitation on number of consecutive terms Mayor

Mr. Cheney postponed his reports on these three items from the
Agenda until the next Council Meeting, as they had been requested
by Mayor Cassandra.

Mr. Cheney said the City buildings were closed with storm shut-
ters Monday afternoon in anticipation of the hurricane; this

This morning at about 10:00 either a tornado or heavy wind struck
~he back end of Fire Station No. 2 and tore off half of the lower
~oof, and water came in throughout the bunk room. Three of the
large, heavy aluminum overhead doors in the back were tot

ruined. An ~nsurance company representative was here by noon,
and by 2:30 p.m. agreements had been reached as to how the claim
would be filed and damages repaired. This confirms the validity
of the warnings about tornadoes coming after a hurricane.

rs. Wilda Searcy, 402 N.E. 13th Avenue, came before the Council
D advise of the littering taking place on the vacant lots in her
~ighborhood around 13th Avenue and Seacrest. Across the street
~ an elementary school, and she felt this is an unhealthy cli-
~te for children. Mrs. Searcy stated she is trying to adopt her
~andchild, and a State official came out to inspect her neigh-
~rhood and said it is not adequate to raise a child in.
%ildren crossing the railroad tracks to catch a school bus had
~en a problem; now arrangements have been made for children to
~ picked up at Martin Luther King, Jr. Boulevard and N.W. 3rd
S'~reet, but they have to walk through sand and mud to get there.
S]le would like to see houses built on the vacant lots and the
neighborhood cleaned up and suggested that signs be erected
stating there would be a $500 fine for littering.
Councilman Warnke told about the Codes Enforcement Board Meetings
which ....... dealt with lot owners who had been cited, had cleaned up
~ge~r ±ors, put up signs, and the following day their lots are
back in the same littered condition. The lot owners are then

cited again and are appealing to the City to try to improve their
situation; signs they put up were immediately torn down. In some
instances, the owners have to have police escorts to go onto
their own property. The problem is being addressed by the Codes
Enforcement Board; Mr. Warnke invited Mrs. Searcy to offer any
possible solutions to the problem. She suggested having the
~hamber of Commerce bring developers in to buy the vacant lots
and build on them.
Councilman Hester thought bringing development into an area is a
esponsibility of the Housing Authority rather than the Council
e suggested that education of the people in the area and '
catChing people in the act of littering are solutions to these
problems, not only here but in other areas also.
Mr. Cheney did not think the County Housing Authority can do much
~ith current funding. The County Housing and Community
Development Agency has a program called "Lotsteadin

munity development at an appraised value. If this could be

.Bill Staley - Intracoastal Bridge Location
M~, Bill Staley, owner and operator of the Boynton Lodge Motel at
the corner of Boynton Beach Boulevard and Federal Highway, spoke

Secretary of the State Department of Transportation,

D Court of Appeals, and was very disappointed with the

his future will be. He asked, for better attention to this matter

"~riend of the court". Mr. Staley thought the issue could have
b~en resolved more quickly and without the appeals if proper
a~tention had been given earlier in the process.

Mr. Cheney explained that the DOT attempted to buy land from an
Ocean Ridge property owner, who raised the question about the
public purpose of the bridge and asked for a hearing by a State
officer. That hearing included only the property owner, the
Audubon Society of Ocean Ridge, and the DOT. Boynton Beach was
not aware of the hearing until the hearing officer's report was
made, after which we immediately sent a letter to the Secretary
of the DOT to clarify the record and enter into the record that
our City has a Comprehensive Plan that supports the Boynton Beach
Boulevard bridge location. The DOT then decided to overturn the
hearing officer's recommendation; that decision was appealed by
. Lopez, joined by the Audubon Society of Ocean Ridge. The
ity then asked to be admitted as an amicus curiae and submitted
a brief, which was complete, accurate and of good quality. Mr.
Cheney added that the DOT written brief was good also. There is
no guarantee of when the Court of Appeals will render its deci-
sion.
Mr. Staley said one of the judges found the drawings and pho-
tographs to be inadequate.. Attorney Vance said those drawings
and photographs were obtained and sent to the judge last week.

Consider request submitted by Richard K. Brooks, Jr.,
agent for Boynton Beach Distribution Center Associates,
for site plan approval to construct a 58,221 sq. ft.
manufacturing/ warehouse building on 3.23 acres on High
Ridge Road at Industrial Way, the southeast corner. This
project is to be known as Door World Plaza.
The Planning and Zoning Board unanimously recommended approval of
this request, subject to staff comments.
Consider request submitted by Mark Lotterman for site
plan approval to construct a 37,896 sq. ft. warehouse
building on 2.02 acres on the north side of Commerce
Road, east of High Ridge Road to be known as High Ridge
Commerce Park Building No. 1.
The Planning and Zoning Board unanimously recommended approval of
this request, subject to staff comments.
4. Consider request submitted by Rick Rossi, agent for Manor
Care of Boynton Beach, Inc. for approval of an amended

1. Regular City Council Meeting Minutes of November 6, 1985
In the second paragraph on page 10, Councilman Zimmerman said the
statement by Mayor Cassandra should read "Of course not." instead
of "Of Course." Councilman Hester moved, seconded by--~ouncilman
Zimmerman, to approve the minutes as corrected. The motion
carried 3-0.
3. Consider request submitted by John Pagliarulo for site
plan approval to construct eight multi-family rental
apartments on 0.80 acres on S.E. 3rd Street at S.E. 21st
Avenue, the northwest corner.
Councilman Zimmerman said the question had been brought to him of
why the City should build S.E. 3rd Street for this developer when
most developers have to put in their own streets; this request
was turned down about a year ago.
Mr. Cheney said the City now receives the $.02 gas tax money,
which we did not have at the time this was turned down before,
and a number of streets were identified as having vacant land on

them but would not be considered new developments or developer-
oriented areas. These are small pieces of the circulation system
that were not developed. When we received the $.02 gas tax
money, it was considered an opportunity to improve some of these
older streets that would either tie together the transportation
system or make some areas developable; these are instances where
the cost of the street versus the investment would be an imprac-
tical ratio. Bids have been received and ordered on five of
these streets, all independent of any particular project. One of
the five happened to be this street. This is independent of the
repair and resurfacing of existing streets in the City.
Councilman Zimmerman asked where we draw the line for building
streets at the request of developers; he was of the opinion addi-
tional funds should be spent for repairing existing streets.

not at the request of the developer.

the time the equipment is installed or at the time the
ontract is signed, and Mr. Cheney replied it would be at the

Councilman Hester, to approve the purchase of E911 equipment

C~eney explained that the current 911 system is operated by a
cooperative dispatch center which serves Boca Raton, Delray
B~a~h, Boynton Beach, Highland Beach and Gulfstream-

the northeast corner. This project is known as Greentree

Consider request submitted by Kieran J. Kilday, agent for
Edward I. Singer to show land as Local Retail Commercial and
to rezone from AR (Agricultural Residential) to C-3
(Community Commercial), for the purpose of constructing a
20,000 square foot retail/office building on West Boynton
Beach Boulevard at Knuth Road, the northeast corner. This
project is known as Greentree Plaza II.
Mr. Cheney read a letter from Mr. Kilday requesting that his
petitions be postponed until the next City Council meeting.

DEVELOPMENT PLANS

Consider request submitted by Ira A. Martin, agent for
Walboyn, Inc. for approval of Construction Plans and
Preliminary Plat which provides for the construction of
infrastructure improvements to serve a 148 room hotel lounge
and meeting rooms in connection with a replat of the pre-
viously platted Phase I of Congress Lakes. This plat is
located on the west side of Congress Avenue, north of the
Boynton Canal, and the project name is Catalina Centre.
Mr. Carmen Annunziato, Director of Planning, said this and the
following item were not placed on the Consent Agenda because
there was not a unanimous vote by the Planning and Zoning Board.
From the staff point of view, there are no remaining outstanding
issues which need to be resolved with the applicant. Councilman
Warnke said all of the Council Members were at the Planning and
Zoning Board meeting when these were reviewed. Councilman
Zimmerman asked if there is any way to remove the roadway coming
out on the north side of the Boynton Canal and entering Congress
Avenue right at the bridge. Mr. Annunziato said that driveway
is integral to this project. Councilman Hester commented that
this is not the main entrance, as is the case with the similar
situation at the Waste Water Treatment Plant.
Councilman Bester moved to approve the development plans as pre-
sented by Ira A. Martin for Walboyn, Inc.; Councilman Zimmerman
seconded the motion, though he said he cannot vote in favor of
it. The motion carried 2-1, with Councilman Zimmerman
dissenting.
Consider request submitted by Kimberly Dellastatious, agent
for Walboyn, Inc., for approval of Site Plan to construct a
148 room (112,229 sq. ft.) hotel plus lounge and meeting
rooms on 9.64 acres on the west side of Congress Avenue,
north of the Boynton Canal. This project will be known as
Catalina Centre.
Councilman Hester moved, seconded by Councilman Zimmerman, to
approve the site plan to construct a hotel, plus lounge and
meeting rooms, to be known as Catalina Centre, as requested by
Kimberly Dellastatious, agent for Walboyn, Inc. The motion
carried 2-1, with Councilman Zimmerman voting in opposition.

Consider request submitted by William Moers, agent for
Robert and Carol Beane, Lou and Mary Samyn, and Ronald and
Patricia Linkous for approval of Site Plan to construct a
310 square foot ice-cream stand/restaurant on 0.316 acres on
West Boynton Beach Boulevard at N.W. 7th Street, the
~outheast corner, to be known as Twistee Treat.
Councilman Warnke said all of the Councilmen were present at the
Planning and Zoning Board meeting and heard the arguments pro and
con for this request and saw the plans; for the benefit of the
audience, he asked that the plans be projected onto the screen.
The building was shaped like a large ice cream cone. Mr.
Annunziato had sent a memorandum to the P&Z Board outlining loca-
tional and code considerations. Several sections of the code
were thought to be applicable, including sections of the sign
code, some of which he read to the Council. The recommendation
is that this request be denied in its current form--not the use
but the configuration for aesthetic reasons. The P&Z Board for-
warded to the City Council a motion to deny the~request; their
vote was 3-3. The Community A~ppearance Board recommended by a
5-2 vote that the project be rejected.
Mr. William Moers of Twistee Treat Corporation told the Council
he disagrees with some of Mr. Annunziato's statements, and he
believes there are many things throughout the City that depict a
sign, such as gasoline pumps at service stations. He said this
type of building is in cities throughout the state. Mr. Moers
said they feel they can conform with all of the landscaping and
utility requirements and are fully aware of safety factors. He
felt that calling the building a sign is erroneous, and he did
not think such a building would have an adverse effect.
Attorney Vance said he concurs with the Planning Director in his
determination that this structure is a sign within our sign code.
Mr. Stormet Norem, owner and operator of Boynton Memorial Chapel
at 800 West Boynton Beach Boulevard, which is one block west of
the proposed structure, compared the aesthetic effect on the area
if other businesses constructed buildings shaped like their pro-
ducts or objects associated with their trade or profession.
Dr. M. N. Jacobs, who operates a dental office at 715 West
Boynton Beach Boulevard, made a similar statement.
Mr. Joseph Molina, 811 S.W. 6th Avenue, voiced concern for the
traffic jams which would be created by the project.
Mr. Roy Essery, 118 S.W. 8th Court, said he agrees with the City
Engineer and Planning Director that this project would have an
adverse effect and would be a traffic nuisance.

Mr. Ralph Marchese, 1901 Roma Way, said he does not object to the
sale of ice cream, but the product should speak for itself rather
than needing a gimmick such as this. He urged the Council not to
permit such a sign.
Councilman Zimmerman moved, seconded by Councilman Hester, to
deny the development request submitted by William Moers, agent
for the owners of property proposed to be known as Twistee Treat.
The motion carried 3-0.
Consider request submitted by Beril Kruger, agent for Roland
Reinhardt, for Site Plan approval of an amended site plan to
allow for the expansion of the existing restaurant (Bavarian
Haus) from 160 licenses seats to 222 licenses seats and a
request for a Shared Parking Allocation. The Bavarian Haus
is located on the east side of Congress Avenue, south of
West Boynton Beach Boulevard.
The applicant requested that this item be postponed. Councilman
Zimmerman moved, seconded by Councilman Hester, to postpone this
request until the City Council meeting of December 3, 1985. The
motion carried 3-0.

THE INTEREST THEREON FROM NET REVENUES OF THE CITY'S WATER
AND SEWER UTILITY AND TO THE EXTENT PROVIDED HEREIN FROM
IMPACT FEES; SETTING FORTH THE RIGHTS AND REMEDIES OF THE
HOLDERS OF SUCH BONDS; PROVIDING SEVERABILITY; AND PROVIDING
AN EFFECTIVE DATE.
Mr. Cheney said this is the next step toward paying for our share
of the Waste Water Treatment Plant and providing funds for the
next step of the water supply treatment system. Some time ago we
hired a financial advisor; it was agreed this would be a nego-
tiated sale, because of the revenue bond issue and refinancing.
A team of underwriters, headed by Bill Hough of William R. Hough
Company, was selected. Our financial advisors and underwriters
agree that we should refinance the existing bond issue prior to
the end of December, as refunding opportunities may come to an
end at that time.
Slightly over $10,000,000 is expected from the refunding issue.
Five million eight hundred thousand dollars is for the sewer
treatment plant, based on actual contracts between the regional
board and the contractor. For the acquisition costs, we propose
$1,036,000; this includes land acquisition costs, power supply,
piping and two test wells. The test wells are needed for both
the analysis of the Reverse-Osmosis Program and for conventional
treatment if that method is chosen. This refinances our existing
issue, meets our financial obligations on the sewer plan and pro-
vides land and testing opportunities, the Intracoastal crossing,
a3d design and engineering of the proposed Water Plant No. 2;
a~other bond will be ~ssued for the construction of the plant and
t~e additional wells and raw water pipes to tie them together.
A~ that time we will know precisely what we will be doing; Mr.
Cileney estimated this will be in about nine months, depending on
s.~veral factors. The anticipated time schedule on the back of
tile sheet showing a breakdown of project costs does not include
the special Counci~ meeting on November 26. This issue is not to
e~ceed $20,000,000, at this time the estimate is $18,792,900,
which may change a little on a negotiated sale.
Mr. Cheney added that these are revenue bonds, paid for solely
from water and sewer charges; capital facility charges can be
used if needed. No referendum is involved, as support does not
come from ad valorem taxes.

Consider request for comments and recommendations concerning
the extension of Woolbright Road between Congress Avenue and
Military Trail.
Mr. Annunziato said the County Transportation Improvement Program
provides for the construction of Woolbright Road between Congress
Avenue and Military Trail and the reconstruction of Woolbright
Road westerly to Jog Road as an enhanced right of way. The City
of Boynton Beach has always considered Woolbright Road to be an
integral link in our East/West connections; this was recognized
by the State in the construction of an interchange at 1-95. Our
planning to date has been consistent with that, including the
four-laning of Woolbright Road from Congress Avenue to U.S. 1.
Recently there has been some action by private development
located along the dedicated Woolbright Road corridor to postpone
action on Woolbright Road until some time in the future. We
believe this is inconisistent with the needs and our planning, and
we recommend that we To on record as a city supporting this
construction in the existing right of way, which varies from 120
to 180 feet, and the reconstruction westerly from Military Trail
to Jog Road. This is on the South side of the canal by Quail
Ridge.
Mr. Cheney said this road goes through a right of way through
Quail Ridge, but that right of way was established at the time
Q~ail Ridge was developed. Councilman Warnke said only one-half
mile of this is in the City of Boynton Beach, and the rest is in
the County. Mr. Cheney said he suggests that the Council's
recommendation include the entire road, for without the entire
rQad, it does not give the balance to Boynton Beach Boulevard.
H~ said thlat the Council also might consider supporting the con-
cePt of the five-year plan that has been developed and will be up
for public hearing by the County Commissioners on December 3;
e~entually they will be adopting an ordinance supporting the
five-year plan. He hoped the Council would recommended that
someone go to the public hearing on December 3 and present a sta-

Councilman Hester moved, seconded by Councilman Zimmerman, that
the Council approve the extension of Woolbright Road from
Congress Avenue to Military Trail and approve the concept of the
five-year plan and ask the City Manager and Mayor to attend the
public hearing on this issue. The motion carried 3-0.
Review and approve Central Business District Master Landscape
Plan
Mr. Mark Burton, Chairman of the Downtown Review Board, said con-
siderable time has been spent working with Ed Fried of Stresau,
Smith and Stresau, who is under contract with the Community
Redevelopment Agency. With recommendations for specifications
from his firm, a Master Landscape Plan has been developed, with
actual specifications to the Design Guidelines which were pre-
sented by Urban Design Studio. The lighting the Board Members
selected for the Central Business District, mercury vapor, is in
conflict with the existing City energy ordinance; this type of
lighting was chosen for aesthetic reasons. The CBD is a small
portion of the City; the DRB Members felt that lighting was one
way to make a statement for that area. If the guidelines of the
energy ordinance were followed, either high pressure sodium or
metal halide lighting would have to be used. The specifications
call for high pressure sodium roadway lights, but instead of
using metal halide in the pedestrian areas, the DRB decided to
use mercury vapor. A wide selection of mercury vapor fixtures
are available; there is a very limited selection for metal
halide. AS the area is small, the DRB did not feel the impact
would be too detrimental to the City's energy consumption.
Mr. Burton said the DRB is asking the Council to make an amend-
ment to supersede the City ordinance for energy conservation in
regard to this lighting matter in the Central Business District.
M~. Cheney agreed that a lot of work has gone into this plan, and
he had no problem with what has been developed. He said the
wording of this plan should be related to the City's energy sec-
t~on of the Code to see what conflict there is and how it com-
pares and report back.
Councilman Zimmerman moved, seconded by Councilman Hester, to
approve the Central Business District Master Landscape Plan and
have the City staff review the lighting concepts for future
resolve. The motion carried 3-0.
C. Gift from Woodmen of the World
COuncilman Zimmerman moved, seconded by Councilman }{ester, that
the Council send a letter of appreciation to the Woodmen of the
World for their donation of $200 to the City. The motion carried
3-0.

A. Approve procedure for Change Orders for Regional Wastewater
Plant Expansion
Mr. Cheney said at their meeting last night the consensus of the
Sewer Board was that change orders up to $2,000 should go through
the review process and be approved by the City Manager in each
city; those over $2,000 must be approved by the Board and the
City Council. When the sum of change orders reaches $20,000, a
report will be prepared for the Sewer Board and the CounCil. In
this $11,000,000 project, there will be change orders. In many
cases they are small, but the small ones can be costly if they
hold up th!e project. The large ones are usually identified
earlier and can be taken through a more complicated process.
Councilman Zimmerman moved, seconded by Councilman Hester, to
approve the change order procedure developed by the Sewer Board
at their meeting of November 18, 1985. The motion carried 3-0.
