Minutes 04-02-85MINUTES OF REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, APRIL 2, 1985 AT 7:30 P. M. PRESENT: Nick Cassandra, Mayor James R. Warnke, Councilman Carl Zimmerman, Councilman ABSENT Bob Ferrell, Vice Mayor (Excused) Peter L. Cheney, City Manager Suzanne M. Kruse, Deputy City Clerk James W. Vance, City Attorney Mayor Cassandra called the meeting to order at 7:30 P. M. The Invocation was given by Pastor Ken Ferguson, Ascension Lutheran Church, followed by the Pledge of Allegiance to the Flag led by Mayor Cassandra. Mayor Cassandra announced that the Consent Agenda had items which the Council believed needed no discussion. If people in the audience wished to discuss an item, they should fill out one of the yellow slips which were in the back of the room, and the Council would pull that item out of the Consent Agenda. Mayor Cassandra also announced that there would be no Public Audience on first reading of Ordinances. Public Audience would be on the second reading of the Ordinances. AGENDA APPROVAL Under "ADMINISTRATIVE", City Manager Cheney added "F. Dis- cussion of Selection of Financial Consultant." Mayor Cassandra added "G. Appointments to Industrial Revenue Bonds Board", and "H. Announcement by Former Councilman Joe deLong", under "ADMINISTRATIVE". He wished to pull out "D. 1" from the "CONSENT AGENDA" for discussion. Because of only three Members being on the Council, Council- man Zimmerman wanted to move "VIII. LEGAL, B. Ordinances, 1st Reading, 9s 5 through 10 (Proposed Ordinance Nos. 85-26 through 85-31 inclusive) after "Announcements" for tabling action. Under "F. Announcements," Mayor Cassandra added "American Legion Post". Councilman Zimmerman moved to accept the agenda with the additions and corrections, seconded by Councilman Warnke. Motion carried 3-0. ORGANIZATIONAL RESOLUTION 85-T - Adoption of Robert's Rules of Order City Attorney Vance read Resolution 85-T by title only: - 1 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ADOPTING THE 1970 EDITION OF ROBERT'S RULES OF ORDER (LIBRARY OF CONGRESS CARD NO. 71-106451) AS OFFICIAL RULES OF ORDER." Councilman Warnke moved to adopt Resolution 85-T, seconded by Councilman Zimmerman. Motion carried 3-0. ANNOUNCEMENTS 1. Proclamations: a) Fair Housing Month - April, 1985 b) Arbor Day - April 12, 1985 c) National Building Safety Week - April 14 through April 20, 1985 d) National Library Week - April 14 through April 20, 1985 e) Private Property Week - April 28 through May 4, 1985 Mayor Cassandra read the five Proclamations. Florida Atlantic University Journalism Class Mayor Cassandra noted the presence of Professor Steve Cohen and his students. He requested them to stand, and there was applause. American Legion Post 164 Mayor Cassandra announced that the American Legion will have an award dinner on April 13, 1985, at 7:00 P. M., honoring the Policemen and Fire Fighters' Nurse of the Year. LEGAL Ordinances - 1st ReadinG Councilman Zimmerman moved to table Proposed Ordinance Nos. 85-26 through 85-31 inclusive because of the small number of Members on the Council tonight. Mayor Cassandra explained the motion was for all items pertaining to the Central Business District (CBD) Ordinance to be tabled. The motion died for lack of a second. City Manager Cheney said the Ordinances were prepared in accord with the majority vote of the City Council the last time the issue was taken up. The key issue was the marina - 2 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 and the dry storage definition. There was a 3-2 vote to not have the full marina definition but to eliminate parts of the marina. The Council's action tonight would be at first reading. Mayor Cassandra agreed with City Manager Cheney that a presentation by the City staff would not be needed. Mayor Cassandra announced again that this was first reading and not open to the public audience. Based upon that, he did not feel the request to speak from Hank Thompson, Chair- man~ of the Community Redevelopment Agency, should be honored, but Said he would leave it up to the two Councilmen. Mr. Thompson withdrew his request. Even though it was on first reading, Councilman Zimmerman thought if anyone indicated that they wanted to speak, they should be allowed to speak. Councilman Warnke knew several people stayed away tonight because they felt they could not speak on first reading and many were present because they felt they could speak. He thought Mayor Cassandra put it very well and reiterated that the first reading is a formu- lation of the facts by the Council. At second reading, everybody will have a chance to express their opinion. Mayor Cassandra said there would be no public audience, and he explained. As this was a very special issue, Mayor Cassandra said there might be a Special Council Meeting just to address this particular question (Proposed Ordinance Nos. 85-26 through 85-31) so they will not have such a long agenda. He asked City Manager Cheney if this would be a problem because of advertising in the newspaper. City Manager Cheney advised that they do not advertise until after they have had first reading because they never know for sure that it will pass on first reading. Then the second reading is advertised. City Manager said there was no way they could have a Special Meeting before the next regular meeting and have it adver- tised. If they want to have a Special Meeting, City Manager Cheney said they could go ahead and set another night with that issue without having it tied up with all of the other issues at the next Council Meeting. He said they will have a heavy agenda on April 16 and told what will be on that agenda. City Manager Cheney did not think they could get a meeting in before the 16th but said they could have a meeting after the 16th if they want the downtown district at a separate meeting. Mayor Cassandra agreed with Councilman Warnke to let it go on the regular agenda for the next Council Meeting. - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Councilman Warnke pointed out that they did not know how the vote would go tonight, but they could always make a change later. City Manager Cheney advised that they can start the public hearing and if they decide that it will be a long time, they can continue it to another time. Proposed Ordinance No. 85-26 Re: Amending Chapter 7.5 of the City Code establishing a landscape code for the Central Business District Attorney Vance read proposed Ordinance No. 85-26 by title: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 7.5. ENVIRONMENTAL REGULATION. OF THE CODE OF ORDINANCES OF THE CITY OF BOYNTON BEACH, FLORIDA, BY ADDING A NEW ARTICLE III. CENTRAL BUSINESS DISTRICT LANDSCAPE CODE, SETTING FORTH A SHORT TITLE, PURPOSE CLAUSE, DEFINITIONS, APPLICATION OF SAID CODE, REQUIRING THE SUBMITTAL AND APPROVAL OF LANDSCAPE PLANS, A PERFORM- ANCE SURETY, REQUIRING MAINTENANCE AND IRRIGATION, AND SETTING FORTH LANDSCAPE REQUIREMENTS THROUGHOUT THE CENTRAL BUSINESS DISTRICT; PROVIDING THAT EACH AND EVERY OTHER PROVISION OF CHAPTER 7.5. Councilman Warnke moved to approve Proposed Ordinance No. 85-26 on first reading. Mayor Cassandra passed his gavel to Councilman Warnke and seconded the motion. Mayor Cassandra asked if this Landscape Code would override the new Landscape Code. City Manager Cheney thought it would because it specifically addresses the Central Business District. In the minutes of the last meeting, Mayor Cassandra raised questions to the City Manager, but the answers have not come to him yet. City Manager Cheney promised that the questions would be answered zn a memo before the meeting. Proposed Ordinance No. 85-28 Re: Amending the zoning code relative to the Central Business District Attorney Vance read proposed.Ordinance No. 85-28 by title: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING APPENDIX A - ZONING, OF THE CODE OF ORDINANCES, CITY OF BOYNTON BEACH, BY AMENDING SECTION 1. DEFINITION OF TERMS. TO PROVIDE A DEFINITION FOR 'ANTIQUE STORE OR AUCTION HOUSE' AND TO AMEND THE EXISTING DEFINITIONS OF HOTEL APARTMENT AND MOTEL APARTMENT; BY FURTHER AMENDING APPENDIX A-ZONING BY AMENDING SECTION 6. COMMERCIAL DISTRICT REGULATIONS AND USE PROVISIONS. E. Councilman Warnke moved to approve Ordinance No. 85-28 on first reading. M~yor Cassandra gave Councilman Warnke the gavel and seconded the motion. Councilman Warnke wished to withdraw his motion because he had a change. Attorney Vance advised that he could only withdraw his motion if the person who seconded the motion gave his consent. Mayor Cassandra withdrew his second. Mayor Cassandra wished to talk to Attorney Vance. He asked if what is done at the first reading of an Ordinance can be changed at the second reading. Attorney Vance replied that one can amend an Ordinance at second reading. Councilman Warnke moved that proposed Ordinance No. 85-28 be approved on first reading with the following changes: Page 5, paragraDh 2, f. Change wording to the following: "Outdoor storage of any type, other than boats or rental cars in accordance with Section 6.E.l." Page 6, paragraph q, should be deleted in its entirety. Page 3, "ENTERTAINMENT AND RECREATION, paragraph e, should read as follows: "e. Marinas, limited to the following uses: Mooring and docking of boats and vessels, both private and commercial; sale of fuels and lubricants; occupancy of vessels as living quarters, provided that such craft are connected to public sewer facilities or be equipped with United States Coast Guard certified type of sanitation devices; operation of drift and charter fishing boats and sightseeing boats; bait and tackle shops. In addition, other uses may be allowed at marinas in accordance with the list of Permitted and Conditional Uses for the CBD, including dry and wet storage of boats; boat dealers; service, repair, installation, building, rebuilding or custom- izing of boats, engines or marine equipment." - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Councilman Warnke said the intent of the above motion should be clear, and it was subject to the correct wording by the City Attorney for final reading. He explained to Mayor Cassandra that he added to paragraph 3 by deleting it from the Prohibited Use Section and moving it up and including it in Permitted or Conditional Uses. Councilman Warnke said there would still be some control over the usage of the property. The intent of the motion was to leave it open, but it would still be subject to the approval of the Community Redevelopment Agency, the other City Boards involved, and finally the City Council. Mayor Cassandra seconded the motion for discussion purposes. He was in agreement with some of the items Councilman Warnke put on there, but not all of it, and said he would make a motion to amend when this comes up for second reading. To be able to remove the moratorium, Mayor Cassandra said he would endorse the correction but, on second reading, he will not endorse it as presented. Assuming the matter comes up under second reading and there is a tie vote, Attorney Vance informed Councilman Zimmerman that the Ordinance would fail. The remainder of the package makes no rational sense without the Zoning Ordinance. Pro- posed Ordinance Nos. 85-26 through 85-31 are a package deal. Councilman Warnke wondered how it could then be brought up again. He thought it could be brought up again going back possibly to its original form. Attorney Vance agreed that it could be proposed in its original form, at the meeting, by any Member of the Council. Depending on the motion that is made, if it be this one, and it is tied, Mayor Zimmerman said the other proponent body could make a motion, and they could still have a tie. Practically speaking, Attorney Vance advised that it would probably be appropriate to consider this item first at the next meeting because if they did not pass this, there would not be any point in passing the other CBD Ordinances. Mayor Cassandra reiterated that he did not get all of the questions he wanted answered. He met with quite a few Senior Citizens about the downtown, as far as living in Boynton Beach is concerned, and talked to many business people. Mayor Cassandra said the City has a problem that has to be solved. In any delicate issue, mud is slung, and some was thrown around which should not have been. Mayor Cassandra - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 referred to 2.9 acres that used to be Arnold Stroshein's property. He recalled that Mr. Stroshein was a strong advo- cate of having a hotel in that area and did not want the Holiday Inn built on 1-95. As of 1984, Mayor Cassandra said that property went into a blind trust, and he did not know if Mr. Stroshein was still a part of it. So there is never any gray cloud in the City, Mayor Cassandra felt that question of the blind trust had to be answered as far as who makes up the blind trust. If they were independent or Boynton Beach investors, he said there were no problems, but if they were people with sensitive positions, it could be a problem. Mayor Cassandra reiterated that innuendos and character assassinations have been made, and people's integrities have been dragged through the mud. He said it is public information, and Attorney Vance should be able to get the answer. Attorney Vance advised that the Public Records Law relates to Members of Boards and Commissions, and he did not know of anybody who was supposed to be holding ownership of that at this point and time. He did not find out who makes up the blind trust. Attorney Vance said his office checked the records; there is nothing in the Public Records, and he had no names. Councilman Warnke thought this should be Mayor Cassandra's own inquiry as opposed to it being an issue for the Council. If Mayor Cassandra feels a Member of one of the City Boards is an owner, Attorney Vance said the Member could be asked. The public records would apply to those persons, but they would not apply to citizens in general. There was no doubt in Mayor Cassandra's mind about the integrity of any of the City's Board Members. Mayor Zimmerman thought they were endangering the entire passage of the downtown Ordinance by putting in these last minute changes. A professional group was hired to work out this Ordinance, and it went through the CRA. Mayor Cassandra said the problem was the vote was 3-2 at the time they had a full Council, and the question was whether you could make an amendment to the first reading and then amend it again. Councilman Warnke commented that all they were doing tonight was making a presentation to the public on it. No Aye Aye With respect to Mayor Cassandra's comments, the only thing Attorney Vance was familiar with were some letters that are in the public record from the Attorney representing the Marina and a letter from the Chairman of the CRA. He was informed that copies of the letters had been circulated. Proposed Ordinance No. 85-29 Re: Amending Chapter 19, establishing a Downtown Review Board and guidelines for Central Business District pro~ect review and approval Attorney Vance read Proposed Ordinance No. 85-29 by title: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 19. PLANNING AND DEVELOPMENT GENERALLY. BY ADDING A NEW ARTICLE IV. DOWNTOWN REVIEW BOARD, AND A NEW ARTICLE V. CENTRAL BUSINESS DISTRICT PROJECT REVIEW AND APPROVAL; SAID ARTICLE IV. Proposed Ordinance No. 85-30 Re: Amending Chapter 5 of the Code to provide that the Downtown Review Board has authority to grant parking variances for property with- in the Central Business District Attorney Vance read proposed Ordinance No. 85-30 by title: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 5. BUILD- INGS, HOUSING AND CONSTRUCTION REGULATIONS, ARTICLE X. PARKING LOTS, SECTION 5-144. VARIANCES TO THIS ARTICLE. (a) VARIANCES AUTHORIZED. TO PROVIDE THAT THE DOWNTOWN REVIEW BOARD SHALL TAKE THE PLACE OF THE PLANNING AND ZONING BOARD IN ALL PROCEEDINGS WITH REGARD TO APPLICATIONS FOR VARIANCES WHERE PROPERTY LIES WITHIN THE CENTRAL BUSINESS DISTRICT (CBD); PROVIDING THAT EACH AND EVERY OTHER PROVISION OF CHAPTER 5. Proposed Ordinance No. 85-31 Re: Amending Chapter 21 of the City Code and establishing regulations for signs in the Central Business District - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Attorney Vance read proposed Ordinance No. 85-31 by title: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 21. SIGNS. OF THE CODE OF ORDINANCES, CITY OF BOYNTON BEACH, FLORIDA, TO AMEND SECTION 21-15. SIGNS PERMITTED AND REGULATED. TO CREATE A NEW SUBSECTION (H) REGU- LATING SIGNS IN THE CENTRAL BUSINESS DISTRICT (CBD); PROVIDING THAT 'EACH AND EVERY OTHER PROVISION OF CHAPTER 21. SIGNS. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING AUTHORITY TO CODIFY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES." Councilman Warnke moved to approve Ordinance 85-31 on first reading. Mayor Cassandra passed the gavel to Councilman Warnke and seconded the motion. A roll call vote on the motion was taken by Mrs. Kruse, as follows: Councilman Zimmerman Councilman Cassandra Councilman Warnke No Aye Aye Motion carried 2-1. Mayor Cassandra informed the audience that Ordinance Nos. 85-26 through 85-31 inclusive had no sensitive issues and passed 2-1 at tonight's meeting. The sensitive issue is Ordinance No. 85-28, and he recommended that this become the first item of discussion on the whole agenda for the next Council meeting. If time permits, they should cut down the amount of time for Public Audience. Mayor Cassandra again passed the gavel to Councilman Warnke and moved that Public Audience at the next meeting be limited to a fixed time for speakers so that they can get Ordinance No. 85-28 thoroughly discussed. The motion died for lack of a second. Mayor Cassandra called attention to the Marina and wanted everyone to know he moved Ordinance 85-28 along but was not in full agreement with the amendments Councilman Warnke made. He also told the Community Redevelopment Agency Members that he was not happy with their form and hoped he could get answers to both of them. At the next meeting, there will be four Members on the Council, and Mayor Cassandra said the issue should be solved one way or the other when the second reading comes. He called attention to Hank Thompson, Chairman; Samuel Scheiner, Vice Chairman; - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 and Don Combs, Member, of the Community Redevelopment Agency, who were in the audience, and hoped they would not feel the two years of their time put into this was wasted. Mayor Cassandra told the representatives of the Marina that all the efforts they put for 20 years are not going down the drain but should be resolved at the second reading. Mayor Cassandra told the audience one representative should speak for a group, not a lot of people, and the issues of dis- cussion should be only on the second reading. He assumed a representative of the CRA would be there to discuss the pros and cons. Councilman Warnke added that both sides should be represented. There was discussion about people speaking at the next meet- ing. Mayor Cassandra said they could limit them to a certain amount of time. Attorney Vance confirmed that they could apply a reasonable time limit. Councilman Warnke moved to revert to the regular order of business, seconded by Councilman Zimmerman. Motion carried 3-0. CITY MANAGER'S REPORT Sale of Boat - Police Department Last Saturday morning, City Manager Cheney said the City sold the boat they had in the Police yard at an auction and received $19,400 for it minus about $800 for advertising and the auction's commission. They tied it in with an auction that was held at Lantana Boat Yard with several boats Boca Raton and Delray Beach had. City Manager Cheney informed Councilman Warnke that the money is being put into capital facilities for rebuilding the Police station, along with the bond issue, and he explained. Award from National Organization on Disability Community Partnership Program City Manager Cheney said the Horizons Committee was organ- ized locally, and it has brought together folks from a variety of handicap groups (hard of hearing, wheelchair groups, etc.), who have been working to highlight the City's involvement with handicap programs. The City won the award for its Accessibility Ordinance, which they could thank Sam - 12 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Scheiner; Bud Howell, Building Official; and Members of the Council for. The Counties and Cities have adopted the Ordinance, and the City will receive more information on it. The award will be given in Washington on April 18th, and the City has asked Laura Mudryk of Congressman Dan Mica's office, and formerly with the City's Recreation Department to accept the award for the City. Possibly, Congressman Mica can also be there. Post Office City Manager Cheney reported that several City officials met with representatives of Senator Lawton Chiles' office last week. A number of items were discussed, and they particu- larly discussed the issue of the post office, and that the post office should be willing to follow Boynton Beach rules and regulations. Tree City, U. S. A. Award City Manager Cheney said this award is being presented to the City and will be received at the next Council meeting. Special City Council Meeting - April 10, 1985 City Manager Cheney reminded the Council that this meeting is to discuss changes in the Code Book which was received from the Municipal Code Corporation. Fish - Golf Course The City recently bought 100 fish that came from China, through New Hampshire, for $470, and have stocked the lakes at the golf course with them. The fish are six inches long, eat the vegetation in the lakes, and grow to as much as 100 pounds. After further describing the fish, City Manager Cheney concluded by saying this means the City can avoid using all kinds of chemicals which are necessary to keep growth in the lakes under control. Councilman Warnke pointed out that some fish should not be imported and wondered if this had gone through Loxahatchee, the National Endangered Fish list, and if the City was clear on that. City Manager Cheney replied affirmatively and elaborated. - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 PUBLIC AUDIENCE Youth Program Mrs. Wilda Searcy, 402 N. E. 13th Avenue, Boynton Beach, had a letter from County Commissioners Dorothy Wilkins and Ed White and wanted the Council Members to have copies. Canal 16 Mr. White's letter referred to Canal 16. Mrs. Searcy told of talking to people making a park out of the area on Saturday. She asked the people how they would like to have a park there, and they replied that was why they were there. Mrs. Searcy suggested they clean up when they leave, which they did, and they also put a big can there. They know it is private property and know it is a vacant lot. Signs were pulled down, but tomorrow, they will try to put them back up again. Trucks Dumping on Empty Lots Mrs. Searcy talked to someone in Ocean Ridge and told of being on an ad hoc committee. She went into detail about trucks making a dump of her community and hoped the City would look into that. She said County Commissioners Wilken and Owens are looking into it too. Mayor Cassandra received a letter from Commissioner Wilken stating there is a feeling that the grass cuttings from Ocean Ridge/Boynton Beach are dumped on empty lots instead of being taken to the appropri- ate area. In her letter, Commissioner Wilken suggested that maybe unlimited amounts of bags be allowed during regular Sanita- tion pickups. Councilman Cassandra knew the Sanitation Department does that anyway but said these are private people charging to cut the grass and then having the City pick it up for them. City Manager Cheney wished people would know what they are talking about when they talk. He suspected this City had more of an amount of unlimited pickup than any other City in Palm Beach County. The suggestion by Commissioner Wilken was ridiculous. Also, the City requires that private contractors and collectors take their own "stuff" away. Also, City Manager Cheney did not think there was any proof that private contractors who cut in Ocean Ridge dump their trash in Boynton Beach, and he did not think that it happens. He thought private contractors in Boynton Beach sometimes - 14 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 dump in Boynton Beach, even though the City tries to catch them. City Manager Cheney said the most serious problem in the City is Boynton Beach citizens dumping their grass clippings on vacant lots in their neighborhood. Mrs. Searcy vehemently disagreed, saying the people in her area do not even have grass. Tour of Neighborhood Mayor Cassandra made arrangements to meet Mrs. Searcy at City Hall on Saturday, April 6, at 10:00 A. M. to take a tour of her neighborhood. Mrs. Searcy wished other Members of Council would also go and said it would only take an hour. Change of Name from Council to Commission Mrs. Dee L. Zibelli, 440 Ocean Parkway, said sooner or later, there will be a woman on the Council. She thought the name "Council" should be changed to "Commission" so a woman Member would be called Commissioner instead of Councilwoman, Council Person, etc. and she explained. Heavier Fines for Parkinq in Handicapped Zones Mrs. Zibelli told of people who are not handicapped parking in handicapped zones and a handicapped person having to park at the north end of Sunshine Square and push his wheel chair. She wanted to see a heavier fine imposed on people who park in handicapped zones and thought it should be $50. Widening of North Seacrest Avenue Mr. Morton Goldstein, 130 N. E. 26th Avenue, spoke to County Commissioner Jerry Owens, who is pushing the widening of North Seacrest Avenue. Mr. Goldstein understood from a letter he saw that the City was obligated to move the electrical wires and trees first and coordinate with the County. Then the County would come in. City Manager Cheney assured Mr. Goldstein that the City will coordinate with the County in any way they should. The City does not move electrical wires, but they are coordinating with the County on underground utilities, funding for them, relocation of them, and storm drainage. Councilman Warnke interjected that it is on the priority list. City Manager Cheney said the City provided the information the County - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 needed and will continue to do that in accordance with the County's time schedule. City Manager Cheney said the City also agrees with the County that when the contract is actually issued, the reloca- tion of the water and sewer lines will be paid by the City (which is required, even though it is on the County road), but the relocation will be done under the terms of the County contract. Only one contractor will be doing the job, so it will be much more efficient. City Manager Cheney assured Mr. Goldstein that the City is well coordinated with the County Engineer's Office. Vacany on Council in District 2 Mr. Goldstein noticed that Mayor Cassandra made the state- ment that at the next Council meeting, there would still only be four Members on the Council to vote on the issue of the Marina, etc. Since a quorum was present this evening, Mr. Goldstein asked why the Members could not appoint the fifth Council Member from District 2 this evening. Mayor Cassandra replied that it could be done, but it would create a complete change of administrative paperwork that was set up for the announcement of Board Members, and it might create a problem for the next meeting. City Manager Cheney said there was still one pending item which the Council delegated to the staff to handle. He hoped in the next ten days those things could be worked out. City Manager Cheney said the staff may have to come back to the Council at the next meeting with some interpretations of subdivision regulations but are trying to work it out with the directions the Council gave them. He did not want the Council to think it had been worked out at this point. Mayor Cassandra asked if they made a stipulation. City Manager Cheney replied negatively and added that they approved it on the condition that the staff would find a solution to the problem. City Manager Cheney was jus% letting the Council know that the issue may get back to them because staff may not think they can resolve it, the applicant may want the Council to reconsider it, or he may recommend that the Council consider some interpretations of the Ordinance. Since this was first reading, Mayor Cassandra commented that they would have that option at second reading. Resolutions Proposed Resolution No. 85-U Re: Adopting Design Guide- lines for the Central Business District "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ADOPTING DESIGN GUIDELINES FOR THE BOYNTON BEACH CENTRAL BUSINESS DISTRICT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES" - 25 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 City Attorney Vance pointed out that this was a part of the CBD package. The Resolution could be adopted on first reading and, without the remainder of the package, it might not make a lot of sense. City Attorney Vance thought the Council may wish to postpone it until the next meeting. Since they did not know what action the Council would take on April 16, Councilman Warnke thought it might be more appropriate to table Resolution No. 85-U, and he so moved. Councilman Zimmerman seconded the motion, and the motion carried 3-0. Other Consider request from Boynton Beach Housing Authority ................................................. TABLRD Councilman Warnke recalled the reason this was tabled at the last meeting was because they wanted input from the County or any other source as to the effect it might have on future funds. Since Councilman Wright had raised the question, City Manager Cheney thought Councilman Wright was going to do that. He said he would contact Barry Seaman, Palm Beach County Housing Authority, before the next meeting. Mayor Cassandra reminded City Manager Cheney that they had a letter written by the Chairman of the Boynton Beach Hous- ing Authority asking that the Housing Authority disband. City Manager Cheney reiterated that he would call Mr. Seaman before the next meeting and would have a report for the Council. As the Housing Authority was set up by an Ordinance, Councilman Zimmerman asked if they would have to pass an Ordinance to disband it. City Attorney Vance replied that it was established by Ordinance, so it would be appropriate to draft a simple Ordinance if they wanted to take that route. Councilman Warnke thought it would make more sense to leave the Housing Authority established but put it on the back burner. They could just say there would be no more appoint- ments or meetings until further notice. Councilman Warnke hated to see the whole thing abolished. It was decided to leave this matter on the table. Approve contract with Miller and Meier for architectural work related to the City's Capital Improvements Program - 26 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Mayor Cassandra believed City Manager Cheney was supposed to clarify some questions in the contract. City Manager Cheney advised that the contract had been reviewed and suggested that, at this point, they did not need to clarify anything. When they get into construction, he said there may be some clarification appropriate as to the relationship of the City, the Architects, and the Contractor. Messrs. Jordan A. Miller and Craig W. Kenyon, Miller & Meier & Associates Architects and Planners, Inc., Fort Lauderdale, were in the audience, and City Manager Cheney said they came tonight because they were interested in the project. City Manager Cheney explained that the real concerns he and City Attorney Vance had was clarifying at construction time the role of the Architects and the role of the City. In some ways, they do not think the standard American Institute of Architects' contract is what they want to do at that time. Mayor Cassandra questioned whether that would jeopard- ize the City. City Manager Cheney answered, "Not at this point." He clarified that some of the conventional language as to the role of the Architects, the role of the City, who calls the shots, and who makes the decisions makes sense in some places, but City Manager Cheney did not think they made sense for this City. He thought this City wanted a bigger role in decision making, but said that could be addressed later on. In reading the contract, City Manager Cheney asked the Members to recall there is a master plan of this project that starts out first, and then there are two sections as to the actual design. He said they agreed that the City's design of a satellite fire station is a relatively simple project, and they would drop that down to 71/2%, which would save the City $3,000 or $4,000. With that change at this point, City Manager Cheney was satisfied that the percentages they put forth were reasonable and appropriate for the amount of work they are going to do. He was also satisfied that the money for the master plan made sense. City Manager Cheney called attention to the letter from Miller & Meier, dated March 20, 1985, which identified the processes that take place in the master plan preparation and the hours involved. He thought it made sense in the total cost. If the Council approved this, City Manager Cheney said the whole process of developing a master plan and going through - 27 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 the construction design will begin tomorrow morning (April 3, 1985). The first steps will take place next week. and there will be a major staff meeting tomorrow morning to bring all of the key people that are involved. Beginning next week, they will do space analysis for what is needed now, in ten years, and in twenty years. When they finish the master plan, it will be finished only when the Council ends up approving it, so the development of the master plan will come to the Council along the way. When they know the kind of space they are talking about, then City Manager Cheney said they will have to pass that down to the dollars they have. When they build for the dollars they have, they will know how it fits in to a plan for ten or twenty years and what is coming down the road. City Manager Cheney concluded by saying minutes will be kept of all of the meetings, they will keep all of the analyses, and the master plan will be sent back and fOrth to the Council all of the time. City Attorney Vance confirmed that they have some concerns about the role of the City and the Architects when the construction phase begins, but he gathered the Architects understood their concerns and have no problem with it. Councilman Zimmerman moved to approve the contract, seconded by Councilman Warnke. Motion carried 3-0. Consider request to appoint representative to Palm Beach Countywide Beaches and Shores Council and approve Interlocal Agreement City Attorney Vance drew the Council's attention to page 4, paragraph 6A, and read, ". . each Party to this Agreement agrees to raise for Council consideration each such project involving beaches or shores within its jurisdiction for which its approval will be needed or about which it has concerns." In the event the City signs the agreement, he said they would be agreeing that if they have any project within the City's jurisdiction it would be presented to the Council. Councilman Zimmerman asked if only the southern part of the beach, which is in the City limits, would be involved. City Attorney Vance replied affirmatively. Councilman Zimmerman commented that Ocean Front Park would not be involved at all. Attorney Vance confirmed City Manager Cheney's statement that it is not in the City's jurisdic- tion, but the beach in front of St. Andrews would be. - 28- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Councilman Warnke told of being on the original Inlet Improvement League which dealt with this issue and of all of the studies made. He imagined the Municipal League would want to take a stand on it. Councilman Warnke did not think it would serve much purpose and said he would not want to be a delegate to it. Councilman Zimmerman thought the Countywide Committee would go on, with or without Boynton Beach, and if the City had a representative, they could keep up with what is going on. Councilman Warnke pointed out that we could still have representation without going into an agreement. He had reservations about the whole thing and could see some rami- fications coming where the Countywide Council might put in zoning tax districts across the County so those closest to the coast would pay a higher tax than those in Belle Glade. Councilman Warnke wanted more information. Councilman zimmerman noted that the Countywide Council was suggesting that the Mayor sit on this, and he felt they should give Mayor Cassandra the honor of sitting. City Manager Cheney said Bob Klinger is a staff person in the County who is charged with finding the solutions to beach erosion. A part of what he is saying is maybe getting everybody together is an answer. One of the ideas is to possibly consider some kind of financial funding arrangement. It seemed to City Manager Cheney that the City would be better off being a part of the process and having some input into it formally, even if they vote against it, than to sit on the outside and say they did not think what the County- wide Council did was right. City Manager Cheney read in the paper that the South Lake Worth Inlet District apparently proposed an addition to the north jetty. Vera Kline, Ocean Ridge Commissioner, reported that the Ocean Ridge Commission took a position against it. It seemed to City Manager Cheney that the long north jetty is what is raising havoc with the natural flow of sand to the south. If it was true that they are proposing an addition to the jetty and that the City Council will have some role in reviewing all of the proposals, and if an addition to the jetty would further damage the City, it seemed to City Manager Cheney that would be one reason to be part of that discussion process. Councilman Warnke moved to enter into the Interlocal Agree- ment just so the City can be a part of the say so, seconded by Councilman Zimmerman. Motion carried 3-0. - 29 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 It was decided to wait before picking someone to represent the City. City Manager Cheney agreed with Councilman Warnke that there will be a lot of controversy about this. Consideration of request for amendment to C-3 zoning district to allow leasing of cars for conditional us~ City Manager Cheney informed Councilman Warnke that this is a request for an amendment to the text of the C-3 zoning to allow leasing of rental cars. There is a travel agency in the Promenade, and they asked if they could have some leased cars. Under our current zoning, they cannot. Councilman Warnke moved to forward this request to the Planning and Zoning Board for review and comment, seconded by Councilman Zimmerman. Motion carried 3-0. NEW BUSINESS A. City Attorney Vance thought that would be OK, as everybody was appointed April 17th or 19th. Also, Mayor Cassandra believed that all Boards would stay in operation. A vote was taken on the motion, and the motion carried 3-0. B. Board of Governors Cemetery Board - Rules and Regulations City Manager Cheney explained that the only major change was some added control over the number of items that go on the - 30 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 various grave sites. It was recommended that the Council adopt the rules and regulations. Councilman Warnke moved to adopt the rules and regulations, seconded by Councilman Zimmerman. Motion carried 3-0. Consider Industrial Revenue Bond Application - Door World Corporation City Manager Cheney said the City received an application for this from the representatives of Door World Corporation, and the principals of that company were present. It was reviewed by the Screening Committee, and the Screening Committee recommended unanimously that the Council concur and accept the application. The next step after this would be an Inducement Resolution, which will be prepared by the Attorneys for Door World Corporation and our Attorneys, and it will come back to the Council for adoption. From that point on, it will be up to Door World Corporation to proceed with their financing arrangements. City Manager Cheney said all of this will be at no cost to the City. In fact, the City will receive a payment when the bond issue is sold. If this continues along, the City Attorney will arrange for the normal validation of the bonds and, eventually, a bond issue in the amount of $2,619,500 will be sold. Such a revenue bond does not obligate the City to any financial liability but means the company will be able to develop. The proposed location is at the southeast corner of High Ridge Road and Industrial Way. 25 employees will be moved from Boca Raton to this location, and they will gradually add another 10 or so. City Manager Cheney said it is an indus- trial use, consistent with our industrial zone and what is taking place there. They will meet our Codes, and he explained. Councilman Warnke said the CPAs made a statement that Door World Corporation's analytical procedures applied to the financial procedures were substantially less in scope in examination, according to the generally accepted standards. Also, in the whole pamphlet the Council received, there was nothing dealing with a credit rating or anything else. He wondered if it was brought out at the meeting last night. City Manager Cheney replied that it was not really a concern of the City but a concern of the bond institution that lends them the money. The City has no financial liability or - 31 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 obligation to them. If they cannot convince a bank or institution that they have a good credit rating, they will not go forth. Dennis Neilon, President, Door World Corporation, 1000 N. W. 1st Avenue, Boca Raton, said it was more or less up to the banks. Councilman Cassandra asked Mr. Neilon to deviate between mill work and contracting work. Mr. Neilon replied that they are not allowed to be a mill work contractor in that area, and they are not one. What they do is buy a prefinish- ed mill product and assemble it into a door. City Manager Cheney commented that this question came up six or eight months ago, when they first met with these people. They sent a letter to Mr. Annunziato as to what they do, so the City could make a determination of what they do. Based on what they told the City, City Manager Cheney said staff concluded that they are assembly. Councilman Cassandra asked if any saw dust would be gener- ated. Mr. Neilon answered that most of their work would be done at the job site. If a door did not fit, the milling or cutting down of it would be done on the job site. They will create a certain amount of saw dust in the shop. They will cut a piece of trim, baseboard, or jamb, but they will not build a piece of jamb. As a Member of the Screening Committee, Councilman Zimmerman moved to proceed to the next step in the consideration of the Industrial Revenue Bond application of Door World Corpora- tion. Councilman Warnke seconded the motion, and the motion carried 3-0. D. Consider appointment to fill vacant Council position Councilman Warnke moved to have all four Members present and to postpone the appointment until April 16. Councilman Zimmerman seconded the motion. If a decision is not made on April 16, Mayor Cassandra said the City would have to have a Special Election. A vote was taken on the motion, and the motion carried 3-0. Discussion on Comprehensive Annual Financial Request At the last meeting, there was a question on the quick approval of the above, so Mayor Cassandra asked if there were any questions. City Manager Cheney advised that the Finance Director was at a State Conference of Finance Directors this week, but he would try to answer any questions. Councilman Zimmerman thought the letter of March 27 from City Manager Cheney explained most of the deficiencies and criticism made by the Auditor in his report. City Manager Cheney said the City is really making no changes on the matter of investments but is continuing to do what has been done. Two things happened very lately that had to do with the investment issue. A community in Palm Beach County had an investment program which was questionable, and it caused a lot of auditors in the area to be very concerned that they address these questions. City Manager Cheney assured the Council that the City's investments are backed up fully, and he explained. City Manager Cheney said the fidelity bond coverage was a good point, and the City's insurance agent has already been contacted to raise that amount of money. Councilman Warnke referred to City employees being able to get a checking account without a service charge and said it only applies to a regular checking account and did not apply to an interest bearing checking account. Mr. Don Zyto, Barnett Bank, advised that was so because o~ Federal require- ments. They normally have a minimum requirement for regular checking accounts but waived it for all City employees. City Manager Cheney said the City is not sure the Check Signing Machine is the right way to go. If the City does get it, they will keep the signature blank separate. - 33 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 Councilman Warnke did not think this needed a motion or any more discussion, as he thought it was very comprehensive. Accept resignation from Nicholas F. Falgione, Alternate Member of the Boynton Beach Municipal Golf Course Advisory Committee Councilman Warnke moved, seconded by Councilman Zimmerman, to accept the resignation with a letter thanking him for his participation. Discussion of Selection of Financial Consultant City Cheney gave the Council six applications and suggested that the Council let him know by Friday, April 5, or Monday, April 8, the ones they would like to interview. After discussion, it was decided to set up an interview evening for Monday, April 29, at 7:00 P. M. City Manager Cheney thought they could interview three or four applicants. G. Appointments to Industrial Revenue Bond Board Last year, the appointments w.ere Mayor Zimmerman and Council- man Cassandra. Mayor Cassandra asked if they wanted to maintain the same two but reverse the roles. This was agreeable to the Council. H. Announcement Mayor Cassandra had a phone call from former Councilman Joe deLong, who emphatically wanted the City Council to know that he does not want to be appointed to any City Boards, specifically Civil Service. He has been nominated by the employees and, win or lose, he will stick by his commitment to those employees that nominated him. Mayor Cassandra made the announcement so that the City Council would not consider former Councilman deLong in any of the Civil Service appoint- ments and that, in their picking of Board Members, they will not consider him. Councilman Warnke said they would take Mayor Cassandra's word that former Councilman deLong said that. In the past, as they went through the election process for Members that the employees elect, City Manager Cheney said they have done the - 34 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 2, 1985 election process and have not opened or counted the results until after the Council has made its appointments. It seemed that same procedure was OK with everybody, based on what Mayor Cassandra said. The idea was that the Council could appoint whoever they wanted, because it is important that the Council make its appointments and the employee appointments come after that. City Manager Cheney asked if the Council wanted to keep that policy. Councilman Warnke thought it made sense. If anyone puts their name up for nomination, Mayor Cassandra felt they should not be considered for City Council or hold up the employee, s nomination. If that result came out a week prior to the Council's nomination and the Council would consider that person again, that would be the Council's prerogative. When a person is going to accept the nomination of an employee, it was Mayor Cassandra's opinion that would remove him from the Council's consideration, win or lose. City Manager Cheney said Mayor Cassandra knew whose names were put up. Mayor Cassandra knew of one. City Manager Cheney said the City could give him the whole list. The list of nominees is public. First of all, City Manager Cheney said they cannot do the election by the 16th. Secondly, if that was Mayor Cassandra's position, the City will tell him who the nominees are, and Mayor Cassandra did not have to consider them in his appointment. Mayor Cassandra said you do not say I am going to go for this position, and if I do not win, consider me for the other position. He stressed that he was only speaking for himself. In other words, he did not think an election should be held off, based upon the Council's assignments. If those people accept a nomination, they accept, win or lose. City Manager Cheney commented that, in the past, other people on the Council hgve felt differently.
