O83-55ORDINANCE NO. ~ AN ORDINAINCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, PROPOSING AN AMEND~NT TO THE CHARTER OF THE CITY, AS ADOPTED BY THE FLORIDA LEGISLATURE AND BEING KNOWN AS CHAPTER 61-1889, SPECIAl. LAWS OF FLORIDA AS AMENDED, PROPOSING AMENDMENTS TO THE CHARTER THAT SHOULD ORDINANCE NO. 83-55 BE ADOPTED BY THE ELECTORS AT THE MARCH, 1984 ELECTION AS FOLLOWS: BY ~4ENDING ARTICLE IV-A. MERIT SYSTEM FOR PERSONNEL, SECTION 72.4(a) OF THE CHARTER OF THE CITY OF BOYNTON BEACH, FLORIDA, TO SPECIFY THAT CIVIL SERVICE BOARD MEMBERS SHALL BE APPOINTED BY THE CITY COUNCIL AT THE FIRST MEETING AFTER THE ANNUAL MUNICIPAL ELECTION AND THAT THE CIVIL SERVICE BOARD MEMBERS ELECTED BY THE MEMBERS OF THE CIVIL SERVICE SHALL BE ELECTED ON OR ABOUT THE S~E DATE; BY A~ENDiNG ARTICLE IV-A. MERIT SYSTEM FOR PERSONNEL, SECTION 72.4 OF THE CHARTER OF THE CITY OF BOYNTON BEACH, FLORIDA, BY ADDING A NEW SUBSECTION (bll) TO PROVIDE THAT THE FIVE CIVIL SERVICE BOARD MEMBERS Si{ALL APPOINT TWO (2) ALTERNATES TO SERVE AT LARGE FOR A PERIOD OF ONE YEAR, SAID ALTERNATES TO SERVE IN THE EVENT OF THE DEATH, DISQUALIFICATION OR ABSENCE OF ANY OR ALL OF THE REGULAR OR ALTERNATE MEMBERS OF THE BOARD; PROVIDING A BALLOT TITLE; PROVIDING THE OFFICIAL SUBSTANCE OF THE A~4ENDMENT TO BE PLACED ON THE BALLOT; DIRECTING THE CITY CLERK TO SUBMIT A CERTIFIED COPY OF THE ORDINANCE TO THE SUPERVISOR OF ELECTIONS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE ~ND IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1: That should Ordinance No. 83-55 be approved by the electors in March of 1984, then the City Council proposes an amend/n~nt to Chapter 61-1889, more commonly known as the Charter of the City of Boynton Beach, Florida, by amending Article IV-A. Merit System for Personnel, Section 72.4.civil SerVice Board; created, term of office., subsection (a) to read as follows: Section 72.4 Civil Service Board; created, term of office. (a) Upon this act [article] taking effect, the Civil Service Board created pursuant to section 1, Chapter 28910, Special Acts of 1943, shall be abolished and shall be superseded by a Civil Service Board consisting of five (5) members. Two (2) members shall be appointed by the City Council of the C~.y at the first meeting of the Council following the annual municipal election, and two (2) members shall be elected by the members of the Civil Service of the City on or about the same date. The fifth member shall be named by the other four (4) members. In the event said four (4) members shall not agree upon the fifth member within fifteen (15) days after said four (4) members take office, the County Judge of Palm Beach County, Florida, shall designate such fifth member. The said board shall elect one of their members to be chairman. The two (2) members named by the City Council and the two (2) members of the board named by the employees shall serve for a term or a period of two (2) years, except (that) the second members appointed by the CitY Council and the second member appointed(elected) by the City employees shall serve only for a one-year period. All subsequent members appointed by the City Council and the City employees shall serve two-year terms, therefore staggering the term of office. The fifth member of the board named by the other members thereof shall hold office for a period of one year, except (that) the term of said member initially appointed shall expire on the date of the first meeting of the City Council in January 1982. All members of the Civil Service Board shall hold office until their successors are duly elected or named and qualified. Section 2. Should Ordinance No. ~'5~ be approved by the voters in March of 1984, then the City Council proposes an amendment to Chapter 61-1889~ more commonly known as the Charter of the City of Boynton Beach, Florida, by amending Article IV-A. Merit System for Personnel, Section 72.4. Civil Service Board; created, term of office, to add a new subsection (b.1), which shall read as follows: (b.1) The fi~e (5) Board members shall appoint two (2) alternates to serve at large for a period of one year. Said alternates may serve in the event of the death, dis- qualification or absence of any or all of the five (5) members of the Board or the alternates of the said Board. Section 3. That the official ballot title of said Referendum, as required by ~lGl.161, Florida Statutes, shall read as follows: CHARTER AMENDMENT CONCERNING APPOINTI~NT OF CIVIL SERVICE BOARD MEMBERS AND CREATING TWO ALTERNATES AT-LARGE MEMBERS. Section 4. That the official substance of the amend- ment to be placed on the ballot in said Referendum as required by ~101.161, Florida Statutes, shall read as follows: Are you in favor of an amendment to the City Charter as follows: Providing that members of the City's Civil Service Board be appointed, when appropriate, at or near the time of the first meeting of the City Council following the annual municipal election and further providing for two (2) alternates at-large to serve in the absence of regular and alternate members to be appointed -2- by the regular members of the Civil Service Board. Yes Section 5. No That the City Clerk is hereby instructed to immediately submit a certified copy of this Ordinance to the Supervisor of Elections for Palm Beach County in order that said Referendum be placed on the ballot for March of 1984 and that said City Clerk is further required to take all actions necessary to see that said Referendum is placed on the ballot at the time of the municipal election. Section 6. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 7. That should any section or provision of thi Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 8. That this Ordinance shall become effective ten (10) days after said Ordinance has been passed by a majority of the qualified electors of the City voting in the Referendum election.
