O83-45AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 5, BUILDING CODE, SECTION 5-70 ADOPTION OF THE STANDARD MECHANICAL CODE AND GAS CODE BY ADOPTING THE STANDARD MECHANICAL CODE AND GAS CODE, 1982 EDITION, TOGETHER WITH UNIFORM MINIMUM PALMBEACH COUNTYWIDE AMENDMENTS AS RECOMMENDED BY THE BUILDING CODE ADVISORY BOARD OF PALM BEACH COUNTY AS AMENDED; PROVIDING FOR A SAVINGS CLAUSE; REPEALING PROVISIONS; AUTHORITY TO CODIFY; AND EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the City of Boynton Beach is mandated by Palm Beach County to adopt the same basic construction codes as all municipalities in Palm Beach Count~; and WHEREAS, the Building Code Advisory Board of Palm Beach County has recommended the adoption of the 1982 adden- dum to standard codes with uniform minimum countywide addendums. NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 5 of the Codified Ordinances of the City of Boynton Beach, Florida, Mechanical Code and Gas Code is hereby amended as follows: Sec. 5-70 Mechanical Code and Gas Co_de Adopted The Standard Mechanical Code and Gas Code, 1982 Edition, together with uniform minimum Palm Beach countywide amendments thereto as amended, copies of which are now on file in the office of the Building Official of the City, is hereby adopted and established as the Uniform Standard Mechanical Code and Gas Code of the City. Section 2. That the addendum listed as Appendix A is attached hereto and made a part hereof by reference. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. Should any section or provision of this ordinance or any portion hereof be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. The Standard Mechanical Code, 1982 Edition is amended by the following additions and deletions: Section 105.3 - Annual Industrial Permits: Add new Section Upon written request to the Building Official, any industrial plant may be issued an annual permit for mechanical work, installation, maintenance and equipment rearrangement covering units, ducts, and piping in or on the premises owned or occupied by the holder as descri- bed in the permit, but to be issued Subject to the following conditions: 1) The payment of an annual fee of one hundred dollars ($100.00) for each calendar year, and permit fees computed monthly according to the fee schedule above. ~i 2) The regular employment of one or more full-time mechanics competent in the safe installation, extension, maintenance and repair of industrial mechanical systems and equipment. 3) The right of the Mechanical Inspector to check the premises of the permit holder at a reasonable time, unless prohibited by governmenn regulations- 4) The performance of all work shall comply with the applicable provisions of this chapter. 5) The annual industrial permit shall cover the rearrangement of industrial equipment including extension of duct systems required therefore and inspection fees therefOre. Section 1Q6.3 - Schedule of Permit Fees. Delete the existing~paragraph and substitute the following: On all mechanical work covered by this code requiring a permit as set forth in Section 104, a fee shall be paid as required at the time of filing application in accordance With the fee schedule established by the City of Boynton Beach. A reinspection fee of $15.00 may be charged for each reinspection made due to the rejection of work, or due to the fact that work was not ready at the time specified in the request for inspection, or failure to call for inspection. Payment of such fee must be made prior to the reinspection. -1- Plan Filing Fee - Thirty percent (30%) of estimated permit fee upon filing. Deduct amount from actural fee if permit is obtained within four (4) months from approval date; if not, permit fee is kept. Ma~or working drawing review fee - One hundred dollars ($100.00) deducted from permit fee if permit is obtained within eight (8) months from submission date. Major changes fee after plans are. approved and permit issued - Two hundred and fifty dollars ($250.00) fee, however, in no case more th~n the original permit fee. Ma~or plan rechecking fee - Second (2nd) and additional check lists ten percent (10%) of permit fee for checking service each time rechecked. Section 111 - Board of Adjustments and Appeals. Delete existing section and substitute the following: The Board of Adjustments and Appeals, as established by Section 111 of the Standard Building Code, shall hear all appeals concerning the interpretation and enforcement of this code. Section 112 - Delete Section 201 - Definitions. Delete the existing first paragraph and substitute the following: For the purpose of this code, the following terms shall have the meaning indicated in this chapter and as listed in the Standard Building Code. Section 901 - General - 1982 Code. Add to last sentence: "or as invoked by local ordinance". -2-
