O83-36ORDINANCE NO. 83- ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING BOYNTON BEACH CODE OF ORDINANCES CHAPTER 10, "GARBAGE, TRASH AND OFFENSIVE~ CONDITIONS", ARTICLE II, "REFUSE, GARBAGE AND TRASH", SECTION 10-29, "RATES AND CHARGES FOR CITY SERVICE", PROVIDING FOR A NEW FEE SCHEDULE; PROVIDING FOR A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR AN EFFECTIVE DATE AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That the Code of Ordinances of the City of Boynton Beach, Florida, Chapter 10, "Garbage, Trash and Offensive Conditions", Article II, "Refuse, Garbage and Trash", Section 10-29, "Rates and Charges for city Service" be amended to read as follows: Sec. 10-29. Rates and Charges for City Service. The following rates and charges shall be made for refuse collection service provided by the City. A. Commercial Containerized, excluding Residential Units: (1) Monthly commercial charges shall con- sist of a total of the following five items: (a) Container rental charge - A monthly charge to cover the actual cost of the container (amortized over five (5) years) as annually calculated and certified by the City Council. The certified con- tainer rental charge, effective on November 1, 1983 will be as follows: 2 cu yd container -.$3.82 per month 3 cu yd container - 4 cu yd container - 6 cu'yd container - 8 cu yd container - 4.57 per month 4.92 per month 6.87 per month 7.78 per month -1- (2) (b) Disposal charge - A fixed charge per cubic yard as charged by the County for disposal of Waste at the land- fill as annually calculated and cer- tified by the City Council. The amount certified as the disposal charge on November 1, 1983 will be eighty cents ($0.80) per cubic yard of container capacity per pick up (uncompacted). (c) Operating charge - A fixed charge per pick up to cover the operating cost less disposal cost. The certified operating charge on November 1, 1983 (d) will be twenty-two dollars and forty-one cents ($22.41) per month per pick up. Capital equipment reserve charge - A fixed charge per pick up to cover total capital costs for vehicles as annually calculated and certified by the City Council. The certified capital equipment reserve charge on Nov. 1, 1983 will be four dollars and sixty-five cents ($4.65) per month per pick up. (e) Overhead charge - The overhead charge will be as annually calcu- lated and certified by the City Council. The overhead charge on Nov. 1, 1983 will be one dollar and sixty-one cents ($1.61) per cubic yard per pick up. Partial monthly service will be charged on a pro-rated basis,~as appropriate, based on the guidelines in (1) above. Be Co (3) Removal charges for mechanically compressed refuse shall be computed at three-to-one (3:1) (containers furnished by owners). (4) Two (2) or more places of business establishments using a single container shall share equally the charges for the container per pick up as outlined in (1) above. Any joint use generating two (2) cubic yards or less per month shall be charged a minimum of forty-five dollars ($45.00) per month to be shared equally. Non-Containerized Commercial Service: (1) Refuse picked up from bins shall be charged at twenty dollars ($20.00) per cubic yard (non-compacted measure). Small businesses generating one cubic yard a month or less shall be charged at the rate of twenty dollars ($20.00) per month. (2) Refuse picked up from residential type cans at commercial establishments shall have their level of service negotiated by the Public Works Department with an opportunity to appeal the rate to City Council. Residential Rates (Non-containerized): (1) Six dollars and twenty-five cents ($6.25) per month for single family dwellings. (2) Six dollars and twenty-five cents ($6.25) per month for each family unit duplex or tri-plex. (3) Six dollars and twenty-five cents ($6.25) per month for each family unit for apartments and condominiums. (4) Trailer parks, six dollars and twenty- five cents ($6.25) per month per trailer. 3 (2) Residential Rates (Containerized): (1) Five dollars and seventy-five cents ($5.75) per month for each family unit for apartments and condominiums that are served by high volume containers (containerized). Five dollars and seventy-five cents ($5.75) per month per trailer in trailer parks. E. Special Pick Up - Scheduled: Special Pick Up will be scheduled by con- tacting the Public Works Department. Section 2. That should any Section or provision of this Ordinance, or any portion thereof, be declared by a court of competent-jurisdiction to be invalid, such decision shall not effect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall become effective immediately upon its passage.
