3 AN ORDINANCE OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, REGARDING THE
5 APPLICATION OF EASTSIDE LOFTS
6 DEVELOPMENT, LLC., AMENDING ORDINANCE
7 02-013 TO REZONE A PARCEL OF LAND
8 LOCATED AT 623 SOUTH FEDERAL HIGHWAY,
9 AS MORE FULLY DESCRIBED HEREIN, FROM
10 MIXED USE-LOW INTENSITY (MU-L) TO MIXED
11 USE-LOW INTENSITY 2 (MU-L2); PROVIDING
12 FOR CONFLICTS, SEVERABILITY, AND AN
13 EFFECTIVE DATE.

15 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
16 adopted Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City;
17 and
18 WHEREAS, Bradley Miller, of Miller Land Planning Consultants has filed a petition
19 on behalf of the owner to rezoning a parcel of land more particularly described hereinafter;
20 and
21 WHEREAS, the City Commission, following required notice, conducted a public
22 hearing to consider the rezoning and heard testimony and received evidence which the
23 Commission finds supports a rezoning for the property hereinafter described; and
24 WHEREAS, the City Commission finds that the proposed rezoning is consistent with
25 the Land Use described in the City's Comprehensive Plan; and
26 WHEREAS, the City Commission deems it in the best interests of the inhabitants of
27 said City to amend the aforesaid Revised Zoning Map as hereinafter set forth.
28 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
29 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

I: Section 1. The foregoing Whereas clauses are true and correct and incorporated
2 herein by this reference.
3 Section 2. The following described land located at 623 South Federal Highway, is
4 hereby rezoned from Mixed Use-Low Intensity (MU-L) to Mixed Use-Low Intensity 2 (MU-
5 L2):
6 LOTS 5, 6, 7, AND 8, LESS THAT PORTION CONVEYED TO
7 THE STATE OF FLORIDA FOR ROAD RIGHT OF WAY IN
8 OFFICIAL RECORD BOOK 123, PAGE 263 AND OFFICIAL
9 RECORD BOOK 615, PAGE 479, BLOCK C, PENCE
10 SUBDIVISION NO. 1, ACCORDING TO THE PLAT
11 THEREOF, ON FILE IN THE OFFICE OF THE CLERK OF
12 THE CIRCUIT COURT IN AND FOR PALM BEACH
13 COUNTY, FLORIDA, RECORDED IN PLAT BOOK 1, PAGE
14 33.

16 A location map is attached hereto as Exhibit "A" and made a part of this Ordinance by
17 reference.
18 Section 3. That the Zoning Map of the City is amended to reflect this rezoning.
19 Section 4. All ordinances or parts of ordinances in conflict herewith are hereby
20 repealed.
21 Section 5. Should any section or provision of this Ordinance or any portion thereof
22 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
23 the remainder of this Ordinance.
24 Section 6. This ordinance shall become effective immediately upon passage.
