A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH,
FLORIDA, RATIFYING THE ACTION TAKEN
BY THE SOUTH CENTRAL REGIONAL
WASTEWATER TREATMENT AND DISPOSAL
BOARD ON OCTOBER 19, 1995 AS SET
FORTH HEREINBELOW; AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK
TO EXECUTE SAID RATIFICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, The South Central Regional Wastewater Treatment
& Disposal Board (SCRWTDB) requests ratification of the action
taken by the Board on October 19, 1995, as set forth in the
attached composite Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
~ The City Commission of the City of Boynton
Beach, Florida, does hereby ratify the action taken by the
South Central Regional Wastewater Treatment & Disposal Board
on October 19, 1995, as set forth in the attached composite
Exhibit "A".
~ This Resolution shall take effect
immediately upon passage.

EXHIBIT "A"
1. Approved the Third Amendment to Interlocal
Agreement;
2. Approved the expenditure of $55,000 from Repair and
Replacement Fund to purchase new 600 HP Effluent Pump Motor
($35,000) and repair existing 600 HP Effluent Pump Motor
($20,000);
3. Approved the expenditure of $2,600 from Repair and
Replacement Fund to repair Effluent Pump Controller;
4. Approved the expenditure of $18,500 from Repair and
Replacement Fund to replace Batch Polymer System with New Dyna
Blend System.
THIRD AMENDMENT TO INTE~LOCAL AGREEMENT
THIS THIRD AMENDMENT TO INTERLOCAL AGREEMENT is made and

and between the CITY OF BOYNTON BEACH, FLORIDA, a municipal
corporation, hereinafter referred to as "BOYNTON," and the CITY OF
DELEAY BEACH, FLORIDA, a municipal corporation, hereinafter
referred to as "DELRAY."
W I T N E S S E T H=
WHEREAS, BOYNTON and DELRAY pursuant to Section 163.0I,
Florida Statutes, have heretofore entered into that certain
Interlocal Agreement dated the 26th day of December, 1974,
establishing the South Central Regional Wastewater Treatment and
Disposal Board (the "BOARD"), as amended by First Amendment dated
May 27, 1981 and by that certain Second Amendment thereto dated
September 15, 1983, a copy of which such Interlocal Agreement and
above referenced Amendments thereto are attached hereto as
composite Exhibi~ "A"; and
WHEREAS, the BOARD has determined in accordance with the
Florida Department of Environmental Protection Regulations that it
is in the public's interest to institute, operate and administer a
Reclaimed Water Program providing advance treatment to a portion or
all of its effluent to standards allowing such Reclaimed Water to
be utilized for irrigation and other beneficial purposes; and
WHEREAS, in order to institute, administer and operate such a
Reclaimed Water Program, BOYNTON and DELRAY have determined that it
is appropriate that the BOARD be authorized to enter into
agreements for the sale of treated Reclaimed Water to third parties
upon terms and conditions determined by the BOARD to be in the
public's best interest.
NOW, THEREFORE, be it resolved as follows:
That certain Interlocal Agreement entered into on the
26th day of December, 1974 by and between the City of Boynton
Beach, Florida, and the City of Delray Beach, Florida, as amended,
is further amended as follows:
1. Section 3, powers and Procedures, Subsection
(B) is hereby amended to add a Subsection 14 which shall read as
follows:
"14. Enter into contracts for the sale and
disposal of Reclaimed Water for irrigation and
other beneficial uses to third parties."
2. Annex I, Allocation of Operatinq Costs, of the
Interlocal Agreement is hereby amended to add a Paragraph 6
entitled Reclaimed Water as follows:
"6. Reclaimed Water: It is agreed that the
disposal of effluent in a cost effective and
environmentally responsible manner is appropriate
and necessary to the operation of the Regional
Facility and in that regard, the BOARD shall be
authorized to enter into contracts with third
parties for the sale and disposal of all or a
portion of effluent produced and treated by the
Regional Facility to standards required by the
Florida Department of Environmental Protection for
the utilization of such Reclaimed Water for
irrigation and other beneficial uses. The revenues
received from the sale of such Reclaimed Water by
the BOARD shall be applied to the operating budget
of the BOARD."
3~ This Amendment shall become effective upon
ratification by a majority vote of each City Council.
4. This Amendment shall be filed with the Clerk of
the Circuit Court of the Fifteenth Judicial Circuit in West Palm
Beach, Florida.
