R95-175RESOLUTION NO. R95-/2'..4' A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, SUPPORTING SUPERFUND REFORM 95 PRINCIPLES; DIRECTING THE CITY CLERK TO FURNISH A COPY OF SAID RESOLUTION UPON PASSAGE TO OUR STATE SENATORS AND THE CONGRESSIONAL DELEGATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in 1980 Congress passed legislation known as the Superfund Law to ensure the nation's hazardous waste sites would be cleaned up; and WHEREAS, in the 15 years since its inception, Superfund has cost the government and the private sector more than $20 billion dollars with the majority of the fund going to attorneys and litigation as opposed to cleanup efforts; and WHEREAS, a broad based coalition of small and large businesses, local governments, school systems and insurers have developed a plan to restructure the Supedund program, with reform resulting in cutting transaction costs by $1 billion dollars annually, removing large liabilities faced by business and local, state and federal government agencies, cutting cleanup bureaucratic expenditures .by $400 million dollars and redirecting those funds toward clean-up; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. out below: The Supedund Reform 95 principles are hereby supported, as set A. Retroactive Liability - Removal costs and response actions related to hazardous substances disposed of before January 1, 1987, should be paid for by the Superfund Trust Fund. Retroactive liability for hazardous substances disposed of before this date should be repealed for non- federal facility waste sites, as should joint-and-several liability. B. Remedy Selection - Human health risk ranges should be used as goals to guide remedy selection at all National Priorities List (NPL) sites. C. Size/Scope - Qualified states should be given the opportunity to be delegated-authority and funding to manage NPL sites, and provided with incentives to both implement similar financing/liability and remedy selection reforms in a fair and cost-effective manner, and to establish voluntary cleanup programs. D. States Qualified states should be given the opportunity to be delegated authority and funding to manage NPL sites, and provided with incentives to both implement similar financing/liability and remedy selection reforms in a fair and cost-effective manner, and to establish voluntary cleanup programs. E. Cleanup Contracting - Contracting paid for by the Superfund Trust Fund, under the new liability provisions, should be the responsibility of new contracting authorities, which use competitive, entrepreneurial incentives to minimize costs. F. Program Budget - EPA should be given a fixed annual budget that ties the overall size of Superfund to congressional direction. EPA should be required to prioritize spending from the Trust Fund to implement remedies that maximize risk reduction to human health while minimizing costs. Section 2. Authorizing the City Clerk, upon passage of this Resolution, to forward a copy of the same to Senators Mack and Graham, as well as the Florida Congressional delegation. Section 3.
