AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 5 - BUILDING, HOUSING, AND
CONSTRUCTION REGULATIONS, ARTICLE I. IN
GENERAL, OF THE "CODE OF ORDINANCES, CITY
OF BOYNTON BEACH, FLORIDA," TO ADD A NEW
SECT~_ON 5-5, REQUIRING INSTALLATION OF
ON~ iNCH WIDE DOOR IN AT LEAST ONE
BATHROOM IN EACH SINGLE FAMILY AND DUPLEX
RESIDENCE IN THE CITY; PROVIDING
AUTHORITY TO CODIFY; PROVIDING A
CONFLICTS CLAUSE, A SEVERABILITY CLAUSE,
AND AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, the City Council of the City of Boynton
Beach, Florida, finds it to be in the public interest to
have accessibility to single family and duplex residences
within the City by all residents and visitors of the City,
including the handicapped; and
WHEREAS, the State Statutes concerning
Accessibility By Handicapped Persons, Section 553.45, et
seq., Florida Statutes, exempt from its provisions single
family dwellings and duplexes.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Chapter 5 - Buildings, Housing and
Construction Regulations, Article I. In General, of the
Code of Ordinances, City of Boynton Beach, Florida, is
hereby amended to add a new Section 5-5 as follows:
Section 5-5. Accessibility by Handicapped
In each single family dwelling and duplex
constructed in the City, there shall be
installed to at least one bathroom, one
door of at least ~ inches in width.
Section 2: Each and every other provision of
Chapter 5 - Building, Housing and' Construction Regulations,
Article I. In General, shall remain in full force and
effect as previously enacted.
Section 3: Specific authority is hereby granted to
codify this Ordinance.
Section 4: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 5: Should any section or provision of this
Ordinance or a portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remaihder of this Ordinance.
Section 6:
This Ordinance shall become effective
ten (10) days after passage.
