R95-128 RESOLUTION NO. R95-/~$ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTBORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND PALM BEACH COUNTY FOR THE ANNEXATION OF ENCLAVES; AND PROVIDING AN EFFECTIVE DATE. WHERE,AS, Section 163.01, Florida Statutes (1991), known as the "Florida Interlocal Cooperation Act of 1969", authori~es " local governments to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and, thereby, to provide services and facilities that will harmonize geographic, economic, population and other factors influencing the needs and development of local communities; and WHEREAS, Section 18 of Chapter 93-206 of the Laws of Florida created Section 171.'046, Florida Statutes, providing for annexation of certain enclaves by entering into an Interlocal Agreement between the Mupicipality and the County having jurisdiction over such enclaves; and WHEREAS, Palm Beach Co~nty (County) and the City of Boynton Beach (City) have determined that it is appropriate and will promote efficient provision of governmental services for the City to annex certain enclaves; and NOW, THEREFORE, BE IT. RESOLVED BY THE CITY COMMISSION OF . THE CITY OF BOYNTON BEACH, iPLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach, Florida, hereby aut~orizes the Mayor and City Clerk to execute an Interlocal Agreement between the City of Boynton Beach and Palm Beach County'providing for the annexation by the City of certain unincorporated enclaves which are identified in Composite Exhibit "A", attajched hereto and made a part hereof. NOW, THEREFORE, in consideration of the mutual representations, terms and covenants hereinafter set forth, the parties hereby agree as follows: Section 1. Purpose The purpose of this Agreement is to allow annexation by the City of certain unincorporated enclaves which are identified in Composite Exhibit "A" which is attached hereto and made a part hereof. The term "enclave" shall be defined as set forth in Section 171.031 (13)(a) and (b), Florida Statutes, as adopted by the Legislature in Chapter 93-206, Section 15, Laws of Florida. 2. "Agreement" means this Interlocal Agreement, including any amendments or supplements hereto, executed and delivered in accordance with the terms hereof. Section 3. Annexation The unincorporated enclaves identified in Composite Exhibit "A", which is attached hereto and made a part hereof, are hereby annexed into and is included in the corporate boundaries of the City of Boynton Beach. Annexation Procedure The annexation plan has been reviewed and approved by all concerned depart11\ents of Palm Beach County: Planning, County Attorney's Office,Z~oning. Environmental Resources Management, Sheriff, Fire-Rescue, Water Utilities, PropeIty.& Real Estate Management, Financial Management &' Budgetand Parks & Recreation. The plan was also reviewed by relevant city departments including Planning and Zoning, Police, Fire/Re~cue and Public Works. The interlocal agreement itself has been 'reviewed and found acceptable by the. Palm Beach COl.lnty Attorney's Office. While the interlocalagreement .will effect the tI"ansferof the enclaves from Palm13each County to the City ,of Boynton Beach, the annexation will becelllented tlu'ough the use ofa resolution plus two city ordinances for each enclave. Pending approval by the County and the City Commission, one ordinance per enclave will be enacted which will establish zoning for the enclave and one which will amend the .city's Comprehensive Plan. Thus, annexing these ~nclaves will notextend the geographic service areas for emergency and other services beyond those which already exist Minimal demand will be placed upon roadway. electricity, stormwater or parks and. recreation facilities. and the city's initiation of solid waste removal service (only a small ~ncreasejn,d~mandupon the city's solid waste system) will be deferred until the expiration of the ralmBeachCounty Solid Waste Authority's contract with County Sanitation (see Appendix F: Provision of Urban Services to Annexed Areas"). Although these annexations will increase the demands for services from the Public Works (water arrdsewer installation and maintenance; solid waste collection), Police and Fire-Rescue Departments~ ,all ~epartments are capable of maintaining their respective levels of service with little or no need for additional staffing or equipment. Infrastructure Financing The City has two primary options for financing water and sewer infrastructure improvements. In current typical development. infrastructure costs are passed directly on to theproprty owner or buyer by the developer. As the areas to be annexed are already built-up and excluded these facilities at the time of construction, this financing option is not available to the City. Instead. the costs of ' improvements must be passed on to property owners through the use of special assessments. Chapter 170.0 I, Florida Statutes authorizes municipalities to provide for the construction or reconstruction of Water mains, water laterals and other water distribution facilities including necessary appurtenances thereto as well as sanitary sewers and storm water sewers. Pursuant to this Section, municipalitiesrnay recover the costs of such improvements by the creation of special assessments against the properties'deemed benefitted by the improvement. The process forthe establishment of a special assessment is prescribed by statute. The initial step is the passage of a resolution stating the nature of a proposed improvement and designating the location of thein.frastructure. The applicable statute sets forth a list of subjects which must be disclosed within the body of the resolution. At the time of adoption of the resolution referenced above the City must have ,an assessment plat showing the area to be assessed with plans, specifications,and estimates of costs of the Proposed improvement. These steps would precede implementation of the Utilities Qepartment's improvement plan for the enclaves (see "Appendix H: Utilities Report on Provision of Services"). This Interlocal Agreement is made the 1 th day of th -` 199 5 , between the City of Boynton Beach, a municipality located in Palm Beach County, Florida, hereinafter referred to as "City ", and Palm Beach County, a political subdivision of the State of Florida, hereinafter referred to as "County ", each one constituting a public agency, as defined in Part I of Chapter 163, Florida Statutes. WHEREAS, Section 163.01, Florida Statutes (1991), known as the "Florida Interlocal Cooperation Act of 1969 ", authorizes local governments to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and, thereby, to provide services and facilities that will harmonize geographic, economic, population and other factors influencing the needs and development of local communities; and WHEREAS, Part I of Chapter 163, Florida Statutes, permits public agencies, as defined therein, to enter into Interlocal Agreements with each other to jointly exercise any power, privilege, or authority which such agencies share in common and which each might exercise separately; and WHEREAS, Section 18 of Chapter 93 -206 of the Laws of Florida created Section 171.046, Florida Statutes, providing for annexation of certain enclaves by entering into an Interlocal Agreement between the Municipality and the County having jurisdiction over such enclaves; and Page 1 of 5 WHEREAS, Section 171.046, Florida Statutes, limits annexation by Interlocal Agreement to enclaves of ten (10) acres or Tess in size; and WHEREAS, Section 171.031 (13) (a) and (b), as amended by Chapter 93 -206, Laws of Florida, defines enclaves as developed or improved property bounded on all sides by a single municipality, or bounded by a single municipality and by a natural or manmade obstacle that allows passage of vehicular traffic to that unincorporated area only through the municipality; and WHEREAS, the County and the City have determined that it is appropriate and will promote efficient provision of governmental services for the City to annex certain enclaves; and WHEREAS, the County and the City have determined that the parcels to be annexed pursuant to this Interlocal Agreement are improved property based upon the available capacity of water and sewer systems, the availability and access to a public right- of-way; that the lots have previously been cleared or partially cleared ; and that the lots have been subdivided in recorded or unrecorded plats; and WHEREAS, it has been determined by the City and by the County that the parcels to be annexed via this Interlocal Agreement meet the requirements set out in Sections 171.031(a) and (b) and 171.046, Florida Statutes, as such enclaves are developed or is improved, is ten (10) acres or less in size, and are completely surrounded by the City or is surrounded by the City and a natural or manmade obstacle that allows passage of vehicular traffic to the enclaves only through the City; and WHEREAS, the City has prepared a report setting forth the plans to provide urban services to the areas to be annexed; and Page 2 of 5 WHEREAS, the County and the City agree that the parcels to be annexed via this Interlocal Agreement are subject to the Land Use Atlas of the Palm Beach County Comprehensive Plan and County zoning and subdivision regulations until the City adopts a comprehensive plan amendment to include the parcel to be annexed in the comprehensive plan. NOW, THEREFORE, in consideration of the mutual representations, terms and covenants hereinafter set forth, the parties hereby agree as follows: Section 1. Purpose The purpose of this Agreement is to allow annexation by the City of certain unincorporated enclaves which are identified in Composite Exhibit "A" which is attached hereto and made a part hereof. Section 2. Definitions The following definitions shall apply to this Agreement: 1. The term "enclave" shall be defined as set forth in Section 171.031(13)(a) and (b), Florida Statutes, as adopted by the Legislature in Chapter 93 -206, Section 15, Laws of Florida. 2. "Act" means Part I of Chapter 163, Florida Statutes. 3. "Agreement" means this Interlocal Agreement, including any amendments or supplements hereto, executed and delivered in accordance with the terms hereof. Section 3. Annexation The unincorporated enclaves identified in Composite Exhibit "A ", which is attached hereto and made a part hereof, are hereby annexed into and is included in the corporate boundaries of the City of Boynton Beach. Page 3 of 5 Section 4. Effective Date This Agreement shall take effect upon execution by both parties. Section 5. Filing. Upon execution by both parties, a copy of this Agreement shall be filed with the Clerk of the Circuit Court in and for Palm Beach County. Section 6. Notification The City hereby acknowledges that it has provided written notice to all owners of real property located in the enclaves identified in Composite Exhibit "A" whose names and addresses are known by reference to the latest published ad valorem tax records of the Palm Beach County Property Appraiser. The written notice, shall describe the purpose of the Interlocal Agreement and shall state the date, time and place of the meeting of the City Commission of the City of Boynton Beach where this Interlocal Agreement shall be considered for adoption. The written notice shall also indicate the name and telephone number of a Palm Beach County staff person to contact regarding the date, time and place when the Palm Beach County Board of County Commissioners shall consider the adoption of this Interlocal Agreement. Section 7. Captions The captions and section designations herein set forth are for convenience only and shall have no substantive meaning. Section 8. Severability In the event that any section, paragraph, sentence, clause, or provision hereof be held by a court of competent jurisdiction to be invalid, such shall not affect the remaining portions of this Agreement and the same shall remain in full force and effect.
