RESOLUTION NO. R95-/~~-
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, REQUESTING THE
TRANSFER OF THE JURISDICTIONAL POWERS FROM THE
FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) TO
THE CITY OF BOYNTON BEACH FOR A PORTION OF AN
ACCESS ROAD APPROXIMATELY 750 FEET LONG
DEPICTED IN EXHIBIT "A" ATTACHED HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Florida Department of Transportation (FDOT) as
part of the construction of 1-95 in 1973, built an access road for
the construction of the Boynton Beach Boulevard interchange in the
NE quadrant of said interchange and as shown on attached exhibit
"A"; and
WHEREAS, the FDOT still owns the remalnlng portion of said
access road and has no further use for it; and
WHEREAS, Chapter 90-136 of the Laws of Florida provides for
the transfer of ownership as long as the FDOT and the City of
Boynton agree to the transfer and waive all rights to a hearing;
and
WHEREAS, the City of Boynton is desirous of transferring the
jurisdictional authority of said access road from FDOT to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach,
Florida, hereby requests the FDOT to transfer by deed the ownership
of the aforementioned acces s road to the City for its use and
control, and hereby authorizes and directs the City Clerk to
forward a copy of the resolution to District Four of FDOT and
further directs the City administration to pursue transfer of the
road from FDOT to the City of Boynton Beach.
Section 2. That this Resolution shall become effective
immediately upon passage.
