AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING LAND DEVELOPMENT REGULATIONS,
CHAPTER 2.5 PLANNED UNIT DEVELOPMENTS.
SECTION 9, INTERNAL PUD STANDARDS, TO
CREATE A NEW SUBSECTION "F." ENTITLED
"RIGHT-OF-WAYS"; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, staff has determined that setting a forty (40') foot minimum in
a right-of-way, will allow greater flexibility in the Planned Unit Developments
(PUD); and
WHEREAS, upon recommendation of staff, the City Commission of the
City of Boynton Beach has deemed it to be in the best interests of the citizens
and residents of the City of Boynton Beach to amend Chapter 2.5, Section 9,
Internal PUD Standards, to add a new Section "F", entitled "RIGHT-OF-WAYS";
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 2.5 Planned Unit Developments, Section 9. is
hereby amended by adding the words and figures in underlined type, and by
deleting the words and figures in struck-through type, as follows:
9. Internal PUD standards.
A. ACCESS: Every dwelling unit...
F. RIGHT-OF-WAYS. The minimum width of a right-of-way in a PUD
is forty (40) feet. In the event of a conflict with this section and any other
provision of the City's Land Development Regulations regulating the width of
right-of-ways, this section shall prevail
Section 2. Each and every other provision of Chapter 2.5 Planned Unit
Developments of the Land Development Regulations not herein specifically
amended, shall remain in full force and effect as originally adopted.
Section 3. All laws and ordinances applying to the City of Boynton
Beach in conflict with any provisions of this ordinance are hereby repealed.
Section 4. Should any section or provision of this Ordinance or any
portion thereof be declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the remainder of this Ordinance.
Authority is hereby given to codify this Ordinance.
This Ordinance shall become effective immediately.
