AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH', FLORIDA, AMENDING
CHAPTER 2. ZONING SECTION 6. COMMERCIAL
DISTRICT REGULATIONS AND USE PROVISIONS,
PROVIDING FOR PROHIBITION OF COMMERCIAL
PARKING FACILITIES IN THE CENTRAL BUSINESS
DISTRICT; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
.WHEREAS, the City Commission of the City of Boynton Beach has
determined that a proliferation of commercial parking facilities would deter more
productive redevelopment of land in the in the 'Central Business District; and
WHEREAS, the City Commission of the City of Boynton Beach deems it
t° be in the best interests of efficiency and the general welfare of the citizens of
Boynton Beach to prohibit commercial parking facilities in the Central Business
District;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Chapter 2. Zoning, Section 6. Commercial district
regulations and use provisions, E. Central Business District. is hereby amended
by creating a new subsection 2. S., by adding the words and figures in
underlined type, as follows:
E. CBD CENTRAL BUSINESS DISTRICT.
2. Uses prohibited. Within the central business district, no
building, structure, land, or water, or any portion thereof, shall be used for any
of the following uses:
s. commercial parking facilities
Section 2.. All ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.
Section 3. Should any section or provision of this ordinance or portion
hereof, any paragraph, sentence or word be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the remainder of this
ordinance.
Section 4. Authority is hereby granted to codify said ordinance.
Section 5. This ordinance shall become effective immediately upon
passage.
