AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING LAND DEVELOPMENT REGULATIONS,
CHAPTER 1. GENERAL PROVISONS, ARTICLE II.
DEFINITIONS TO INCLUDE "COSMETOLOGY AND
BARBER SCHOOLS"; AMENDING CHAPTER 2,
ZONING, SECTION 6. COMMERCIAL DISTRICT
REGULATIONS AND USE PROVISIONS,
SUBSECTION C. C-3 COMMUNITY COMMERCIAL
DISTRICT TO ALLOW COSMETOLOGY SCHOOLS AS
A CONDITIONAL USE IN THE C-3 ZONING
DISTRICT; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WltEREAS, Chapter 1, General Provisions, Article I1 of the Land Development
sets forth defmitions and staff has recommended that the definition for
Cosmetology and Barber Schools be included; and
WHEREAS, staff has also recommended that cosmetology schools be added as a
use in the C-3 zoning;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing whereas clauses are tree and correct and are now
and confirmed by the City Commission.
Section 2. That Chapter 1. Article II, Defmitions, is hereby amended to add
following definition:
COSMETOLOGY AND BARBER SCHOOLS - An establishmenI primarily
in offering training i.n barbering, hair styling, or the cosmetics arts, such a_s
or skin cre. These schools provide job-specific certification.
Section 3. That subsection C. C-3 Community Commercial District is hereby
amended by adding language, as follows:
gg. Cosmetology schools including barbering, hair styling, or the
cosmetics arts, such as makeup or skin care, if in conjunction with the delivery of
the se~ice to the general public on a daily basis *
Section4. Each and every other provision of the Land Development
Regulations not herein specifically amended, shall remain in full force and effect as
originally adopted.
Section 5.
All laws and ordinances applying to the City of Boynton Beach in
conflict with any provisions of this ordinance are hereby repealed.
Section 6. Should any section or provision of this Ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 7. Authority is hereby given to codify this Ordinance.
Section 8. This Ordinance shall become effective immediately.
