BOYNTON BEACH, FLORIDA, ~4ENDING ORDINANCES NO.
82-26 and 82-27 BY PROVIDING FOR THE ANNEXATION
OF CERTAIN RIGHTS-OF-WAY LOCATED WITHIN PALM BEACH
COUNTY CONTIGUOUS TO RECENTLY ANNEXED LANDS WHICH
WHEN ANNEXED WILL CONSTITUTE A REASONABLY COMPACT
ADDITION TO THE CITY LIMITS; REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVID-
ING FOR A SAVINGS CLAUSE; AN EFFECTIVE DATE~ AND FOR
OTHER PURPOSES.
WHEREAS, The City of Boynton Beach, Florida annexed
certain real properties into the municipal corporate limits
by Ordinances No. 82-26 and 82-27; and,
WHEREAS, it was contemplated that as a part of
Ordinances No. 82-26 and 82-27 certain contiguous rights-of-
way were to be annexed simultaneously therewith; and,
WHEREAS~ the CitY' Planning and Zoning Board conducted
public hearings in this regard on August 10, 1982, and the
City Council conducted public hearings in this regard on
August 17, 1982; and,
~EREAS, owing to a clerical error, the legal
descriptions for these contiguous rights-of-way were in-
advertently omitted, and,
~EREAS, it is the intent of the City Council to
annex these rights-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. Pursuant to Section 7 (32) of the Char~er
of the City of Boynton Beach, Florida, and Florida Statutes,
Section 171.044, the following described unincorporated and
contiguous rights-of-way situated and lying and being in
the County of Palm Beach, Florida, to wit:
(1) Rights-of-way for Congress Avenue, the Boynton Canal
and Lake Worth Drainage District Canal ~ L-2! adjacent
to the real property annexed by Ordinance No. 82-27;~
(2) A dedicated right-of-way located in Sections 7, 8, 17,18~
and 19 all in Township 45 South, Range 43 East, Palm
Beach County, Florida, more particularly described as
follows:

The easterly portion of said Section 7 and the westerly
portion of said Section 8 dedicated as Congress Avenue
and described in the Official Record Book Number 1132,

The East fifty feet of the North East one quarter (NE 1/~)
of the North East one quarter (NE 1/4) of said Section 18;
The West fifty feet of the North West one quarter (NW
1/4) of the North West one quarter (NW 1/4) of said
Section 17;
The West ten feet of the East sixty feet of the South
three quarters (S 3/4) of said Section 18, and the
West ten feet of the East sixty feet of that portion
of said Section 19 North of the North right-of-way line
of the Lake Worth Drainage District C-16 Boynton Canal
all as recorded in Official Record Book Number 3560,
Pages 1115 through 1120 inclusive, all in said Public
Records of Palm Beach County, Florid~
A 100' dedicated right-of-way located in Section 18,
Township 45 South, Range 43 East, Palm Beach County,
Florida, named North West 22nd Avenue as recorded and
more particularly described in the Official Record Book
Number 1785, Page 1569, Public Records of Palm Beach
County, Florida~
(4) That portion of the Seaboard Airline Railroad right-of-
way and the Interstate 1-95 right-of-way lying in the
South 3296~96 feet of Section 9, Township 45 South,
Range 43 East, Palm Beach County, Florida;
(5) That portion of High'Ridge Road lying in the south 1819.
64 feet of Sections 8 and 9, Township 45 South, Range 43
East, Palm Beach County, Florida; and,
(6) That portion of Interstate 1-95 right-of-way and the
Seaboard Airline Railroad right-of-way lying in the
northeast one-quarter (NE 1/4) of the northwest one-
quarter (NW 1/4)of Section 16, Township 45 South, Range
43 East, Palm Beach County, Florida.

are hereby annexed to the City of Boynton Beach and such
rights-of-way so annexed shall be and become part of the
City with the same force and effect as though the same had
been originally incorporated in the territorial boundaries
thereof.
Section 2. That Section 6 and 6 (a) of'the Boynton
Beach City Charter is hereby amended to reflect the annexation
of the rights-of-way more particularly described in Section
1 of this Ordinance.
Section 3. That all Ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
Ordinance or any portion thereof, any paragraph, sentence
or word be declared by a court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as a whole or any part hereof other
than the part declared to be invalid.
Section 5. Specific authority is hereby granted to
codify this Ordinance.
Section 6. This Ordinance shall become effective
immediately upon its final passage.
Section 7. This Ordinance after adoption, shall be
filed with the Clerk of the Circuit Court of Palm Beach
County.
