AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, AMENDING SECT~'ON 22-25(a),
"SIDEWALKS · REQUIRED", ARTICLE II, "CON-
STRUCTION, REPAIR OR ALTERATION", CHAPTER
22, "STREETS AND SIDEWALKS" , TO ALSO APPLY
WHEN A CHANGE IN OCCUPANCY AS DEFINED IN
THE STANDARD BUILDING CODE OCCURS AND/OR
WHeN ANY BUILDING IS RECONSTRUCTED IN AN
AMOUNT WHICH EXCEEDS 70% OF ITS CURRENT
ASSESSED VALUATION AS DETERMINED BY THE
PALM BEACH COUNTY PROPERTY APPRAISER;
PROVIDING FOR A REPEALER CLAUSE; PROVI DING
A SAVINGS CLAUSE; REPEALING ALL ORDINANCES
IN CONFLICT; PROVIDING AN EFFECTIVE DATE
AND FOR OTHER PURPOSES.
NOW-, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1.~ That Section 22-25 (a), "Sidewalks Required",
Article II, "Construction, Repair or Alteration", Chapter 22,
"Streets and sidewalks" is hereby amended by adding the following:
"This requirement shall also apply when a change
in occupancy as defined in the Standard Building
Code occurs and/or when any building is recon-
structed in an amount which exceeds 70% of its
current assessed valuation as determined by the
Palm Beach County Property Appraiser."
Section 2. Authority to Codif¥.~ Specific authority
is hereby granted to codify and incorporate this Ordinance in
the City's existing Code.
Section 3. Separability. Each o~ the provisions o~ this
ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4. Repealing Provisions. All Ordinances or
parts of Ordinances in conflict herewith are hereby repealed.
Section 5. Effective Date.
effective immediately upon its passage.
