AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 15 "OF-
FENSES, MISC~.IANEOUS", SECTION 15-3 "CIRCULARS,
THROW AWAYS AND HANDBTI.LS; DISTRIBUTION"; BY
REPEALING SAID SECTION AND AMENDING CHAPTERS 21
"SIGNS", SECTION 21-17, "CIRCULARS, THROW AWAYS
AND HANDBTT.I.S, DISTRIBUTION PRDHIBITED" BY RE-
PEALING SAID SECTION; PROVIDING A REPEAL CLAUSE;
PROVIDING A SAVINGS CLAUSE; PROVIDING AUTHORITY
TO CODIFY; PRDVIDING AN EFFECTIVE DATE AND FOR
OTHER PURPOSES.
WHEREAS, the First Amendment of the United States Constitution
guarantees the persons right to free speech; and
WHEREAS, Sections 15-3 a~J 21-17 of the Boynton Beach City Code may be
interpreted to be in violation of said First ~nendment.
NF~, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, AS FOI~J3WS:
Section 1.
That Chapter 15- Offenses/Miscellaneous of the codified ordinances of
the City. of Boynton Beach, Section 15-3, Circulars, Throw~ays and Handbills;
Distribution is hereby rep. ealed.
Section 2.
That Chapter 21, Section 21-17- Circulars, Throwaways, Handbills
Distributed of the codified ordinances of the City of Boynton Beach is
hereby repealed.
Section 3.
Ail ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 4.
That should any section or provision of this ordinance or a portion
thereof be declared by a court of competent jurisdiction be invalid, such
decision shall not affect the r~nainder of this ordinance.
Section 5.
Authority is hereby granted to remove said section from the codified
ordinances of the City.
Section 6.
This ordinance shall become effective inmediately upon second reading
and final passage.
