O82-18ORDINANCE NO. 82- ~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 75-19 OF 'SAID CITY, BY ZONING A CERTAIN PARCEL OF LAND MORE PARTICULARLY DESCRIBED HEREIN WHICH IS BEING SIbRILTANEOUSLY HEREWITH ANNEXED INTO THE CITY OF BOYNTON BEACH BY ORDINANCE AS (C-3) COMMUNITY COMMERICAL; PROVIDING FOR A SAVINGS CLAUSE; REPEALING PROVISIONS; AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the City Council 'of the'City of Boynton Beach Florida, has heretofore adopted Ordinance No. 80-19, in which a Revised Zoning Map was adopted for said City; and WHEREAS, the City Council of the City of Boynton Beach simultaneously herewith adopted an Ordinance annexing a parcel o land more particularly described herein into the City limits of said City. WHEREAS, the owners and agents of said property have requested the above-mentioned zoning category; and WHEP~AS, the Planning and Zoning Board of the City of Boynton Beach, Florida, has heretofore approved said development and has reconnnended approval thereof; and WHEREAS, the City Council deems it the best interest of the inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That the following described land, locate in the City of Boynton Beach, Florida: A parcel of land lying in Section 19, Township 45 South, Range 43 East, Palm Beach County, Florida, being more particularly described as follows: Commencing at the Southeast corner of said Section 19 thence N 00° 59' 39" W a distance of 1242.~20 feet to a point; thence N 89° 46' 34" W a distance of 50.01 feet to a point on the West right-of-way line of Congress Avenue (S.R. 807); thence N 00° 59' 39" W along said West line a distance of 2145.01 feet to a point; thence S 88° 05' 26" W a distance of 10.00 feet to the principal point and place of beginning of the following description: Thence continuing S 88° 05' 26" W a distance of 328.87 feet to a point; thence N 00° 59' 39" W a distance of 472.86 feet to a point on the South line of Boynton Canal; thence N 88° 05' 26" E along said South line'a distance of 328.87 feet to a point-, thence S 00° 59' 39' E a distance of 472.86 feet to the point of the beginning and containing 3.57 acres of land more or less, but subject to all legal highways and easements of record. ~e and the same is hereby zoned as "C-3" (Community Commercial). Section 2. That the aforesaid Revised Zoning Map of the :ity shall be amended accordingly. Section 3. ~nat should any section or provision of thi~ )rdinance or a portion thereof be declared by a court of ;ompetent jurisdiction to be invalid, such decision shall not .ffect the remainder of this Ordinance. Section 4. Ail Ordinances or parts of Ordinances _in' ~onflict herewith are hereby repealed. SeCtion 5. This Ordinance shall become effective _rmnediately upon its passage.
