O82-10ORDINANCE NO.. 82- /~ AN ORDINANCE AMENDING SECTION 16-82, "RULES, REGULATIONS CONTROLLING PAR~ING OF VEHICLES AT MUniCIPAL BEACH PROPERTY LOCATED WITHIN THE TOWN OF OCEAN RIDGE, POLICY NO. 1. PARKING PERMITS". WHEREAS, the City Council has adopted by Ordinance Section 16-82 of the City Code concerning Beach Decals; and WHEREAS, the City Council wishes to change the previous provisions for reissuing lost or destroyed 'beach decals; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That Section 16-82, "Rules, regulations, controlling parking of vehicles at municipal beach property locate~ within the Town of Ocean Ridge, Policy No. 1. Parking Permits." of the Boynton Beach Code, 1981 Codification, which reads as ... · follows, is hereby ~repe~ted: (1) (2) Section 2. Parking Permits." of the Boynton Beach Code is hereby amended to read: Section 16-82. Rules~ rggulations controlling parking of vehicles at municipal beach property located within the Town of Ocean Ridge. The city manager is here'by directed to implement sub- ject procedures at the earliest possible date. (Said regulations are set out below. ) The responsibilitv for the administrative issuance and control of parking per- mits is hereby vested in the city clerk of the CitV of .Bovnton Beach, Florida. POLICY NO. 1. PARKING PERMITS Parking permits will be issued on an annual basis (October 1 through September 30) with issuance beginning September 1 each year to residents (see "definitions") of the City of Boynton Beach, for a charge of three dollars ($3.00) for the first decal issued to a resident (3) vehicle, upon satisfactory completion of appropriate application forms. Applicants will be required to establish proof of residency in the City of Boynton Beac (see "definitions") and to present his official state motor vehicle tag registration certificate. when application is made for more than one permit, each separate individual vehicle registration must be presented. Residents who are not property owners must establish residency by some suitable means, such as voter'.s registration, executed .lease, utility bills or other legal document. Permanent beach parking decals shall ~be issued onl~ to residents owning real estate and/or residing in the City for at least six (6) months of each year. In all other cases, temporary parking permits shall 'be issued to residents at a charge of five dollars ($5.00). ProoJ of six (6) months residency shall be established via lease agreements, rent receipts, or written lessor verification. In the event that a beach decal which has been to a resident vehicle is lost or destroyed or in the event that the vehicle ~o which the decal was issued ham been sold or otherwise changed ownership, anew 'decal shall be reissued to the said resident's vehicle or to a. replacement vehicle of the resident for a charge 9f one dollar 01.00) providing that portions of the old. decal adequate to show the old decal number are turned in to the City Clerk '~ a signed statement is executed by the resident to the effect that either the vehicle was sold to another party without the decal 'beinq re- moved or the decal was destroyed by accident, fire or other reason that it could~not 'be returned to the Cit~_ (4) Definitions. Resident: As~one owning real estate and/or .leasing, renting or occupying real estate~ . or living accomodations within the City of Bo~nton Beach for a time period of at least six (6) consecutive months each calendar year, as well as members of their immedia, te family residing with them. Visitor: Paying guests at hotels and motels located within Boynton Beach and guests staying, in Boynton with residents thereof. City employees: All City employees, classified and nonclassified, and retired regardless of residency be eligible to receive one parking permit. Proof of employment shall be established through the~.Bersonne.1 Department of the City. Persons who terminate (not retired) their employment with the City and who are not City residents shall be required to scrape off their s~.ickers and return remains to the issuing Office. Section 3. That all Ordinances or parts of Ordinances conflict herewith are hereby repealed. Section 4. That should any Section or Provision of Ordinance or any portion hereof 'be declared by a Court of competen~ jurisdiction to be invalid, such decision shall not affect the re- mainder of this Ordinance. Section 5. That this Ordinance shall be effective immediately upon its passage. Section 6. That authority is hereby granted to' codify this Ordinance. FIRST READING this 20th day of April, 1982.
