O82-09ORDINANCE NO. 82-4 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA~ APPENDIX A, "ZONING" OF THE BOYNTON BEACH CITY CODE, 1981 CODIFICATION; AMENDING SECTION 1, "DEFINITIONS OF TERMS", "DEFINITIONS" BY ADDING DEFINITIONS FOR AISLE, DRIVEWAY, GROSS FLOOR AREA, PARKING LOT ABm PARKING STALL; AND BY REPEALING ALL OF SECTION 11, SUBSECTION H, "OFF-STREET PARKING" AND._SUBSECTION I, "LOCATION OF OFF-STREET PARKING"AND ENACTING NEW SUB- SECTION H, "OFF-STREET PARKING" AND SUBSECTION I, "LOCATION OF OFF-STREET PARKING"; PROVIDING FOR ALVfHORITY TO CODIFy; PROVIDING FOR A SAVINGS CLAUSE; REPEALINGPROVISION; AN EFFECTIVE DATE AND FOR OTHER PURPOSES. NOW, THEPdEFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. Section 1. Definitions of terms. DEF] is hereby amended by the addition of the following definitions: AISLE. The hard surfaced lanes in a parking lot which connect the parking stalls with a public or pti- vate street alley, or interior driveway. DRIVEWAY. The paved area 'between a public street and private property intended to provide inqress and egress for vehicular traffic from the public street or thorough-fare to a definite area of private property, or which connects parking aisles or provides access to parking aisles. GROSS FLOOR AREA. The Total floor area of a building or a use occupying part of a building, measured fro center lines of partitions and exterior of out- side walls. Gross Floor Area shall include all floor area occupied by the main or principal use plus any floor area occupied b~ accessory uses such as storage rooms, maintenance and mechal rooms, offices, lounges, restrooms, lobbies, base PARKING LOT. A surfaced area, enclosed or unen sufficient in size to store one (1) automobile with a minimum width of nine (9) feet an~ a minimum length of eighteen (18) feet. Section 2. Section 11, Subsection H, Appendix A "Zoning of the Boynton Beach City Code, Shall now read as follows: H. PROVISION OF OFF-STREET PARKING SPACES 1. All 6ff-street parking areas shall conform to the design and la~out requirements of Chapter 5, Article X of the City of Bo..vnton Beach Code of Ordinances~ and shall 'be approved according to the procedures contained therein, 2. All off-street parking facilities shall 'be main- tained and drained so as not ~to cause nuisance Or danger to the public, or to adjacent pu;blic or private property__ (5) A certificate of occupancy for a structure or premises shall not ~be issued until the required parking area has ~been inspected and approved ~by the Building Official. Driveways shall satisfy the parking space re- quirements for single-family detached dwellings and duplexes, provided such driveways are of sufficient size to meet the parking space re- quirements of this Subsection. No fewer than four (4) parking spaces shall be provided for any non-residential use. Sta'bilized sod may be substituted for up to fifty per cent (50%) of the required parking spaces, where eighty per cent (80%) or more of the parking demand falls within a twenty four (~4) hour period each week. Sod may be sub- stituted only for the area of parking stalls. All driveways, aisles, and maneuvering areas shall 'be hard surfaced and shall conform to the design requirements contained in Chapter 5, Article X.of~Tt~City of Boynton Beach Code of Ordinances. Sod parking stalls shall have a base consisting of not less than eight (8) inch, of stabilized shell rock, lime rock, or sand, or an equivalent material as approved by the Cit~ Engineer. Sod parking areas shall have dimensiol equivalent to the dimensions of paved parking areas with ninety degree (90°) parking stalls and two-way traffic in aisles, as ,specified in Chapter 5, Article X of the City of Boy,ton Beach Code of Ordinances. 7. Parking space requirements shall be computed on the 'basis of the principal use of s structure ~or lot. and using gross floor area unless stated otherwise in Paragraph 16 of this Subsection. (6) Bo 1©. Gross floor area, for the purposes of this Sub- section, shall include the floor ~area occupied by the principal use, plus the floor area occu- pied by all accessory uses, including storage rooms, maintenance and mechanical rooms, offices, lounges, restrooms, lobbies, basements, mezzanines and hallways. Where several principal uses exist in one structure or on one lot, parking space require- ments shall be computed separately for each principal use, unless stated otherwise in Paragraph 16 of this Subsection. Where parking spaces are required in Paragraph 16 for each of several principal uses that commonly occur together, this is done for the purpose of clarification only, and shall not limit the application of the requirement contained ~ this paragraph. A use shall be considered a principal use, for the purposes of this Subsection, if it could exist separately from all other uses in the same structure or on the same lot, and would by itself generate significant parking demand. Where a use is located in a shopping center, office building, or office-retail complex, the parking space requirement for the shopping center, office building, or office-retail complex in :~ which it is located shall apply; except that where a theater is located in a shopping, center the parking space requirement for theaters shall apply for the seating or gross floor area of the theater. ~]ere several principal uses exist in one buildin or part,of a building, and the floor area of each principal use cannot be clearly delineated, the 12. 1¸3 o ~arking space requirement for the use requiring the greatest number of parking spaces shall apply. ~nere a use is not listed below, parking space r~quirements shall be determined by the City Council after review and recommendation by the Planning and Zonin~ Board. Parking spaces required in this ordinance for one use or structure may be allocated in part or in whole for the required parking spaces of another use or structure,s, if quantitative evidence is provided showing that parking demand ~or the different uses or structures would occur on days of the week or at different hours Evidence for joint allocation of uired space shall be submitted to the Technical Review 14. 15. Board, and approval of joint allocation of ~'~T required parking spaces shall be made by the Council, after review and recommendation by the Planning & Zoning Board. Wh~re the number of required parking spaces as computed includes a fraction, the number of required parking spaces shall be the computed number rounded to the next highest whole number. There shall be provided off-street handicapped parking spaces consistent with Section 5-141 (j~ of the Boynton Beach Code at the time of the erection of any structure or the enlargement of any structure. (8) 16. There shall be provided, at the time of the erection of any structure or establil~hment of any use, a number of off-street parking s~aces in accordance with the following minimum~require- ments, and subject to Paragraphs 1-15 of this Subsection. Where a structure or use is enlarged or increased in capacity by any means, including adding dwelling units, ~uest rooms, floor area, or seats, the minimum number of parking spaces shall be computed by applying these requirements to the entire structure or use. a. Dwellings, Lodging, and Other Buildings for Habitation (1) Single-family and Duptex~~ Dwellings: Two (2) parking spaces per dwelling unit. (2) Two or More Bedroom Apartments: Two (2) parkinq spaces per dwelling unit. (3) One - Bedroom and Efficiency.Apartments: Two (2) parkinq spaces.per dwelliDq unit for the first ten (10) efficiency and one-bedroom apartments in a sinqle structure~ one and one-half (1.5) park- ing spaces per dwelling unit for each efficiency and/or one-bedroom apartment over ten (10) units. Dormitories: One (1) parkinq space per rooming unit. L5) Rooming and Boarding Houses~ One (1) parking space per rooming unit. (6) Hotels, Apartment Hotels, Motels, merit Motels, and Time-Sharing Hotels and Motels: One and one-quarter (1.25) parking spaces per bedroom. (9) (7) Hospitals: Two (2) parking spaces per bed. (8) Nursing Homes, Convalescent Homes, and Sanitariums: One (1) parking space per three (3) beds. Assembly (1) Churches, Temples, and Other Places of Worships: One (1) parking space per four (4) seats in the auditorium, but not less than one (1) parking space per (2) (3) one hundred (100) square feet of gross floor area for the auditorium, plus required parking spaces for any other ~incipal uses, including offices, class- rooms, meeting rooms, recreation facilit: and dwellings. Theaters, Auditoriums, Meeting Rooms, and Other Places of Assembly: One (t) parking space per four (4) seats, but not less than one (1) one hundred (100) square feet of gross floor area. clubs, Lodges, and Fraternal Orqanizatio] One (1) parking space per one hundred (~Q0) square feet of gross floor area. Community Centers: One (1) parking space per one hundred (100) square feet of gross floor area. (10) (3) Libraries and Museums: One (1) parkin~ space per three hundred (300) square feet of gross floor area. (4) Day Care Centers and Nursery Schools: One (1) parking space per two hundred (200) square feet of gross floor area. (5) Elementary and Junior High Schools: One (1) parking space per five hundred (500) square feet of classroom floor area, including floor area of shops. (6) Secondary Schools and High Schools: One (1) parking space per one hundred (100) square feet of classroom floor area, plus one (1) parking space per two hundred (200) square feet of floor area occupied by shops. (7) Colleqes, Universities, Seminaries, and Technical or Vocational Schools: One (1) parking space per fifty (50) square feet of classroom area, plus one p_a_rkin~ space per two-hundred (200) square feet of floor area occupied by laboratories or shops, plus required space for any other principal uses, including offices, libraries, auditorium and recreation facilities. (8) Specialized Instruction, including Dance Art, and Self-Defense Instruction: One (1) parking space per two hundred (200) square feet of gross floor area. (11) Retail,. Services, Restaurants, and Offices Restaurants, Bars, Cocktail Lounges, Dance Halls, and All Other Eating or Drinking Establishments: One (1) parking space per two and one-half (2.5) seats, but not less than one (1) park- .i.~g space per one hundred (100) square feet of gross floor area. Section ll, Subsection H, Appendix A, "zoning" of the Boynton Beach City Code, shall now read as follows I. LOCATION OF OFF-STREET PARKING SPACES 1. Required parking spaces fo~ all dwellings shall be located on the same lot as the dwelling to be served. 2. Required parking spaces for all other uses shall be owned by the owner of the building or lot to be served, and shall be located on the same lot, or not more than three hundred (300) feet di as measured along the nearest pedestrian walkway. 3. Parking space requirements of two or more uses of the same or different types may be satisfied by the allocation of the required number of spaces for each use in a common parking facility Joint allocation among several uses of a lesser number of parking spaces may be permitted in accordance with Paragraph 13 of this Subsection. Section 6. T~at all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 7. That should any section or provision of this Ordinance or any portion hereof be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 8. That this Ordinance shall be effective immediately upon its passage. Section 9. That authority is hereby granted to codify this Ordinance. (20) 1982.
