A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE
AN AMENDMENT TO THE FINANCIAL ASSISTANCE
AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH
AND PALM BEACH COUNTY, DATED APRIL 15, 1997, FOR
GATEWAY BOULEVARD FROM SEACREST BOULEVARD
TO THE FEC ~ILROAD, EXTENDING THE DATE FOR
ACCOMPLISHING THE DESIGN, RIGHT-OF-WAY
ACQUISITION AND CONSTRUCTION TO JUNE 30, 2001;
AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, on April 15, 1997, the City of Boynton Beach and Palm Beach
County entered into a financial assistance agreement for Gateway Blvd,, from
Seacrest Boulevard to the FEC Railroad; and
WHEREAS, the City and the County have reached an agreement, extending
the date for accomplishing the design, right-of-way acquisition and construction to
]une 30, 2001; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
rilE CITY OF BOYNTON BEACH, FLOI~DA~ THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida,
upon recommendation of staff, hereby authorizes and directs the Mayor and City
Clerk to execute an Amendment to the Financial Assistance Agreement, FOR
Gateway Boulevard from Seacrest Boulevard to the FEC Railroad, extending the
expiration date to .lune 30, 2001, which Amendment is attached hereto as Exhibit
Section 2.

AMENDMENT TO FINANCIAL ASSISTANCE AGREEMENT
DATED APRIL 15, 1997, FOR GATEWAY BOULEVARD FROM
SEACREST BOULEVARD TO THE FEC RAILROAD
THIS AMENDMENT is made as of this day of , 2001,
to the Financial Assistance Agreement dated April 15, 1997, by and
between the CITY OF BOYNTON BEACH, a municipal corporation of the
State of Florida, hereinafter "CITY", and~ PALM BEACH COUNTY, a
political subdivision of the
~COUNTY".

WHEREAS, on April 15, 1997, the CITY and COUNTY entered into
a Financial Assistance Agreement (R-97-454-D) providing for partial
funding of installation of improvements along-Gateway Boulevard
from Seacrest Boulevard to the Florida East Coast Railroad
Crossing; and
WHEREAS, 'on May 18, 1999, the CITY and COUNTY executed an
Amendment (R99-795D) to the Financial Assistance Agreement dated

2. The Financial Assistance Agreement (R97-454-D) dated
April 15, 1997, by and between the CITY and COUNTY, is amended as
hereinafter set forth:
3. Paragraph 2 of the Amendment to Financial Assistance Agreement
dated May 18, 1999
accomplishing the design, right-of-way
(R99-795D) is amended to extend the date for
acquisition, and
construction of the PROJECT to June 30,2001.
4. Except as modified hereby,
the terms and provisions of the
Agreement remain in full force and effect, are ratified and
confirmed, and incorporated herein by this reference.
IN WITNESS WI~EREOF, the parties have executed this Agreement
and it is effective on the date first above written.

Dear Mr. Sugarman:
In response to your letter of January 16, 2001, regarding
the completion of the above project, I have enclosed two
original Amendments to the Financial Assistance
Agreement. As you indicated, since the project is not
complete, it will be necessary to extend the expiration
date of the original Agreement. While you asked for a 90
day extension, we have taken the liberty of extending the
expiration date' to June 30, 2001.
Please have both Amendment originals executed and return
same to this office so that they may be presented to the
Board of County Commissioners. Upon approval, one fully
executed Amendment will be returned to you.
