O81-34ORDI CE NO. 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, 'FLORIDA, STATING THE MILLAGE RATE TO BE~ LEVIED AGAINST PROPERTY OWNERS WITHIN THE CITY FOR THE 1981 - 1982 FISCAL YEAR'; FURT~ERSTATING THE PERCENT BY WHICH THE MILLAGE RATE EXCEEDS THE ROLLED BACK RATE (AS DEFINED BY FLORIDA STATUTEs SECTION 200.065 (2); PROVIDING THAT THE CITY MANAGERSHALL HAVE THE AUTHORITY TO ADJUST THE MILLAGE RATE UPON RECEIPT OF THE FINAL TAX ROLL;~ PRO- VIDING FOR AN EFFECTIVE DATE AND FOR OTHEK PURPOSES. WHEREAS, the City Charter of the City of Boynton Beach, Florida, and the Laws of Florida require, an appropriation ordi- nance be passed by the City Council of said municipality each year adopting the budget; and WHEREAS, Florida Statutes Section 200.065 (2) (d) requires that prior to the adoption of the final budget that an ordinance stating the millage rate proposed by the municipality be passed; and WHEREAS, said ordinance must also state the percent of increase in property taxes adopted by the governing body; and WHEREAS, said millage rate must be adopted separately and before the budget of the community; and WHEREAS, the City of Boynton Beach, Florida, has followed the procedures as outlined in Florida Statutes Section 200.065; and WHEREAS, Florida Statutes Section 200.065(5) provides for a ministerial adjustment of the millage rate after receipt of the final tax roll. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section _1_. That the City Council of the C~ty of Boynton Beach,. Florida, hereby adopts ~~ills as the official \ millage rate of the City for the 1981 !~ 1982 fiscal year. To: Re: MEMORANDUM October 28, 198.1 HOnorable Mayor and City Council Millage Rate - Certification of Final Taxable Value In adopting tax rate for 1981-82, the City Council, in accordance with the TRIM Law authorized the City Manager to make an adjust- ment in the tax millage in 'accordance with the notice of "Certifi- cation of Final Taxable Value" when that certification was made by the property appraiser. The TRI~ Bill provides for a three-day period to make this adjustment in the millage either up or down so that the dollars to be received by the City are the same as they wou'!d. . have been based on the tentative taxable value. Section 3. That upon ~receipt of the final tax roll if said roll indicates that the certified taxable value within the district has decreased from the original tax roll presented to the City by the property appraiser.s office~ that the City Manager sha~l within three (3) days make the ministerial adjustment to the millage rate to assure that the same-amount of taxes shall be collected by the City. Said adjustment shall be reported to the property appraiser within three (3) days of receipt, of the final tax roll. Section 4'. THat this Ordinance shall become effective immediately upon its second reading and final passage.
