AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, RELATING TO ZONING;
AMENDING APPENDIX A "ZONING"
(ORDINANCE NO. 75-19), CODE OF ORDIN-
ANCES, BY DELETING THE MINI~{UM SEVEN
HUNDRED FIFTY (750) SQUARE FOOT REQUIRE-
MENT CONTAINED IN THE DEFINITION OF
TIME SHARING HOTEL; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR
AUTHORITY TO CODIFY; PROVIDING FOR
A SAVINGS CLAUSE; EFFECTIVE DATE AND
FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach
desires to regulate time sharing or interval-ownership condominium~
in the same manner as hotels are currently regulated under the
zoning code of the City, but without regard to the form of owner-
ship of property or residential units therein.
NOW, THEREFORE, BE IT AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. Section 1 of Appendix A "Zoning" (Ordinance
No. 75-19) is amended to read:
Section 1. Definition.
Time sharing hotel. The term shall include, but
shall not be limited to any building or part thereof in which the
right of use or occupancy of any unit circulates among various
occupants for specific periods of time less than a full year
during any given year but not necessarily for consecutive years
in accordance with a fixed time schedule.~on a periodically
recurring basis extending for more than one year. The determina-
tion that a building, or part thereof, is a ~time sharing hotel
lshall be made without regard to the form of oWnership of the prope=t]
lor of the units therein and shall be immaterial w~ether the right

Section 2. Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 3. Each of the provisions of this ordinances
is separable, including word, clause, phrase or sentence, and if
any portion thereof shall be declared invalid, the remaining
portion shall not be affected, but shall remain in full force
and effect.
Section 4. This ordinance shall become effective
immediately upon adoption.
