AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
CHAPTER 18, ARTICLE VI, PROVIDING FOR THE
CREATION OF AN EX OFFICIO, NON-VOTING
POSITION ON THE BOARD OF TRUSTEES OF THE
MUNICIPAL FIREFIGHTERS' PENSION FUND; AND
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, upon recommendation and request of the Firefighters
Pension Board, it has been determined by the City Commission of the City
of Boynton Beach, Florida to be in the best interests of the fund members
and citizens of the City of Boynton Beach to create an honorary position
on the Firefighters Pension Board, which position will be occupied by the
Fire Chief;
NOW THEREFORE, BE IT ORDAZNED BY THE CITY ¢OMHISSZON
OF THE CZTY OF BOYNTON BEACH, FLORZDA, THAT:
Section 1. That Chapter 18, Article VI, is hereby amended by creating
Section 18<[84 by adding the words and fiqures in underline type and by
deleting the wOrds and figures in struck througl~ type as follows:

Notwithstandin an other rovision of this Chater there is hereb
created an ex officio non-votin osition on the Board of Trustees which shall be
counted for the ur ose of a uorum nor shall the ex officio.member be entitled
to move or second the ado tion of an issue or vote on an matter before the
Board. The ex officio member shall receive al official Board communications and

Section 2. All laws and ordinances applied to the City of Boynton Beach
in conflict with any Ordinance are hereby repeated.
Section .3. . Should any section or provision of this Ordinance or any
portion thereof be declared by a court of competent jurisdiction to be invalid,
such as decision shall not affect the remainder of the Ordinance.
_Section 4.
Authority is hereby given to codify this Ordinance.
Section 5. This ordinance shall become effective immediately upon
passage.
