O81-29ORDINANCE NO. si- / AN OP~INANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ANNEXING A CERTAIN UNINCORPORATED TRA'CT OF LAND THAT IS CONTIGUOUS TO THE CITY LIMITS WITHIN PAI2R BEACH COUNTY AND THAT WILL UPON ITS ANNEXATION, CONSTITUTE A REASONABLY COMPACT ADDITION TO THE CITY TERRITORY PURSUANT TO A PETITION OF THE OWNER OF SAID TRACT OF LAND,'REQUESTING ANNEXATION PURSUANT TO SECTION 7(32) OF THE CHARTER OF ~THE CITY OF BOYNTON BEACH, FLORIDA AND FLORIDA STATUTES 171.044; PROVIDING THAT ORDINANCE NO. 80-19 OF THE CITY IS HEREBY AI~ENDED TO REFLECT THAT THE ZONING OF SAID TRACT OF LAND SHALL BE WITHIN THE (REC) "RECREATION" DISTRICT OF THE CITY; A2~END~NG SECTION ~6 and 6A OF ' THE CITY CHARTER BOUNDARIES AND BOUNDARIES AND TERRITORIEs OF GREATER BOYNTON BEACH AREA TO INCLUDE THE SAID PARCEL; PROVID- ING FOR THE AMENDMENT OF ORDINANCE 79-24 BY DESIGNATING THIS PARCEL OF LAND~ ON THE LAND USE PLAN AS CLAUSE; FOR FOR OTHE OF THE COMPREHENSIVE REPEALING ALL OF OP~INANCES IN PROVIDING A SAV!INGS DIFY; PROVIDING AN EFFECTIVE DATEi; AND I~4EREAS, Palm Beach County, the owner of the following tract of land described as: A parcel of land located in Section 5, Township 46 South, Range 43 E of Palm Beach County, Florida, being more particularly described as follows: From the NW Corner of Government Lot 3, bear South 0o20'43'' East along the West line of the same, to a point of beginning, which point ms also the SW corner of a 55.6 acre parcel conveyed to Boynton Beach, April 25, 1978, per Resolution No. R-78-526. From this point, continue along the southern extension of the same course to the North right- of-way line of the L-29 canal; thence easterly along t.his line to the West right-of-way line of the SAL Railway; thence northeasterly along this right-of-way to the SE corner of the aforementioned parcel; thence westerly along the south line thereof to the point of begin- ning. Containing 10 acres, more or less. filed a Petition for Annexation to the City of Boynton Beach directed .to the City Council pursuant to Article 7(32) of the Charter of the City of Boynton Beach, Florida and Florida Statutes §171.044(1980); and WHEREAS, the said tract of land lying and being within Palm Beach County is contiguous to the existing City limits of the City of Boynton Beach, Florida, and will upon its annexation constitute a reasonably compact addition to the City territory; an~ WHEREAS, the proposed use of said land is recreational and the Palm Beach County Commission has no objection to said use. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. Pursuant to Section 7(32) of the Charter of the City of Boynton Beach, Florida, and Florida Statutes §171.044, the following described unincorporated and contiguous tract of land situated and lying and being in the County of Palm Beach, Florida, to wit: A parcel of land located in Section 5, Township 46 South, Range 43 E 'of Palm Beach County, Florida, being more particularly described as follows: From the NW Corner of Government Lot 3, bear South 0o20'43'' East along the West line of the same, to a point of beginning, which point is also the SW corner of a 55.6 acre parcel conveyed to Boynton Beach, April 25, 1978, per Resolution No. R-78~.526. Containing 10 acres, more or less. -2- is hereby annexed to the City of Boynton Beach and such land so annexed shall be and become part of the City with the same force and effect as though the same had been originally incorporated in the territorial boundaries thereof. Section 2. That Section 6 and 6(a) of the Boynton Beach City Charter is hereby amended to reflect the annexation of that tract of land more particularly described in Sections 1 of this Ordinance. Section 3. That Ordinance No. 80-19 of the City of Boynton Beach is hereby amended to reflect that the aforesaid parcel of land is hereby annexed to the City of Boynton Beach in the following zoning category with the full consent of the County. Subject tract of land is hereby zoned (REC)"ReCreat~.onal District" of the City of Boynton Beach and the revised zoning map as reflected in Ordinance No. 80-19 of the City of Boy, ton Beach is hereby amended accordingly. Section 4. That Ordinance No. 79-24 of tie City of Boynton Beach is hereby amended to reflect that the aforesaid parcel of land is hereby anneXed to the City of Boynton Beach with the following land use designation within the Boynton Beach Comprehensive Plan with the full consent of the County. Subject tract of land is hereby designated residential withi the land use plan of the City of Boynton Beach and that all m.~ps adopted in accordance with Ordimance No. 29-24 are amended at:cordingly. Section 5. Ail ordinances or parts of ordi~ances in conflict herewith be an the same are hereby repeale Section 6. SI ~uld any section or provisio~ of this ~ Ordinance any portior thereof, any paragraph, sentence or or word be declared by a court of competent jurisdictio~| to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. Section 7. Specific authority is hereby granted to codify this Ordinance. Section 8. This Ordinance shall not be impassed until the same has been advertised for four (4) consecutive weeks in a newspaper of general circulation in the City of Boynton Beach as required by the City Charter and Florida Statutes §171.044. Section 9. This Ordinance shall become effective immediately upon its final passage. Section 10. This Ordinance after adoption, shall be filed with the Clerk of the Circuit Court of Palm Beach County. FIRST READING this ~ day of ~~ , 1981.
