O81-27 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, RELATING TO ZO~NG~; AMENDING APPENDIX A "ZONING", CODE OF ORDINANCES, TO DEFINE TIME SHARING HOTEL, TO INCLUDE WITHOUT LIMITATION ANY BUILDING OR PART THEREOF IN WHICH THE RIGHT OF USE OR OCCUPANCY OF ANY UNIT CIRCULATES AMONG VARIOUS OCCUPANTS IN ACCORDANCE WITH A FIXED TIME SCHEDULE ON A PERIODICALLY RECURRING BASIS, AND REQUIRING TIME SHARING UNITS TO BE A MINIMUM OF 750 SQUARE FEET PER ~UNIT, AND TO AMEND SECTION 6C-1 OF APPENDIX A "ZONING" TO INCLUDE AS A PERMITTED USE, TIME SHARING HOTEL~ REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR AUTHORITY TO CODIFY; PROVIDING FOR A SAVINGS CLAUSE; EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach ~ to regulate time sharing or interval-ownership condominiums in the same manner as hotels are currently regulated under the zoning code of the City, ~but without regard to the form of owner- ship of property or residential units therein. NOW, THEREFORE, BE IT AND IT IS HEREBY ORDAINED BY THE COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. Section 1 of Appendix A "Zoning" is amended to read: Section 1. Definition. Time sharing hotel. The term shall include, but shall be limited to an~ buildinoq_~art thereof in which the ri~ use or occupanco~__q_~_~ unit circulates among_various occ ecific periods of time l~ss than a full year duri but not necessarily for consecu;.ive_years in accordance with fixed time schedule on a periodically recurring basis extendin~ for more than one year. The determination that a building, or part thereof is a time sharing hotel shall be made without regar~ to the form of ownership of the property or of the un~ts therein and shall ~be immaterial whether the right of use or occu.pa~c~ is derive. from a leasehold or fee interest. Each of the provisions of this ordinance- is separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not 'be affected, 'but shall remain in full force and effect.
