AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. 79-24 OF
SAID CITY BY AMENDING THE'LAND USEELEMENT
OF THE COMPREHENSIVE PLAN OF THE CITY BY
CHANGING THE LAND USE OF CERTAIN PROPERTY
MORE PARTICULARLY DESCRIBED HEREINAFTER
FROM LOCAL RETAIL TO MEDI~4 DENSITY
RESIDENTIAL; PROVIDING FOR A SAVINGS
CLAUSE; A REPEALING PROVISION; AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has adopted a comprehensive land use plan and as part of
said plan a land use element by Ordinance No. 79-24 in accordance
with the Local Government Comprehensive Planning Act; and
WHEREAS, the procedure for amending of the land use
element of the comprehensive plan is set forth in Florida
Statutes 163.3184, having been followed; and
WHEREAS, after public hearings and study, the City deems
it in the best interest of the inhabitants of the City to amend
the aforesaid land use element for the comprehensive plan as
adopted by 'the City.
NOW~ THEREFORE, be it ordained by the City Council of
the City of Boynton Beach, Florida:
Section 1. That Ordinance No. 79-24 of the City of
Boynton Beach is hereby amended to reflect the following. That
the land use of the following described land located in the City
of Boynton Beach, Florida, shall heretofore be medium density
residential rather than local retail. Said land is more particula~
described as follows:
East 10 feet of Lot 10, Block 2
Lake Boynton Estates, Plat 1,
recorded in Plat Book 13, Page
32 of the Official Public Records
of Palm Beach County, Florida.
Section 2. That any maps adopted in accordance with
the land use element of said comprehensive plan shall be amended
accordingly.

Section 3. That should any section or provisions of
this Ordinance or any portion thereof be declared by a Court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 4. Ail ordinances or parts of ordinances in
conflict herewith are repealed.
Section 5. This ordinances shall become effective
immediately upon its passage.
