AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 1, "GENERAL
PROVISIONS", SECTION 1-7, "COSTS ASSESSED
FOR LAW ENFORCEMENT EDUCATION" OF THE
BOYNTON BEACH CITY CODE, 1981 CODIFICATION;
PROVIDING FOR A ~0 DOLLAR ($2.00) ASSESS-
~NT AS ADDITIONAL COURT COSTS AGAINST
EVERY PERSON CONVICTED FOR VIOLATION OF
MUNICIPAL ORDINANCES AUTHORIZED BY SECTION
943.25 OF THE FLORIDA STATUTES; PROVIDING
FOR AUTHORITY TO CODIFY; PROVIDING FOR A
SAVINGS CLAUSE; REPEALING PROVISION; AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, the 1981 Session of the Florida Legislature
amended Florida Statutes 943.25 to provide for an assessment of
Two Dollars ($2.00) additional court costs to fund law enforce-
ment education; and
WHEREAS, the City of Boynton Beach feels that it is in
the best interest of the public to participate in said program;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA;
Section 1. That Chapter 1, "General Provisions",Section
1-7 "Costs Assessed for Law Enforcement Education" of the Boynton
Beach City Code, 1981 Codification is hereby amended to read as
follows:
Sec.
(a)
1-7. Cost Assessed for Law Enforcement
Education.
The court trying city ordinance violations
shall assess eme-detta~-<~t=00) two dollars ($2.00) as additional
court costs against every person convicted for violation of a
municipal ordinance as authorized by Section 943.25 of the Florida
Statutes. Ail such sums shall be turned over to the finance
director to be deposited in a fund as established in (b) to be
known as the law enforcement education fund.
(b) There is hereby established a fund to be known
as the law enforcement education fund. Ail funds received by the
City from the assessment of court costs established in this sectio¼
shall be segregated from all other funds of the city and set apart
by the finance director in a separate fund to be known and desig-
nated as the ~law enforcement education fund. Such funds may,
from time to time, in the discretion of the City Council, be
invested. The interest received upon such funds and the principal
thereof may, u.pon the request of the chief of police, be used for
law enforcement education expenditures for the benefit of members
of the city police department. Expenditures shall be permitted
by the city manager, upon approval of the City Council, when
authorized in accordance with law.
Section 2. Specific authority is hereby granted to
codify and incorporate this Ordinance in the City's existing
Code.
Section 3. Each of the provisions of this Ordinance is
separable, including word, clause, phrase or sentence, and if
any portion hereof shall be declared invalid, the remaining
portions shall not be affected but shall remain in full force
and effect.
Section 4. All Ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5. This Ordinance shall become effective in the
manner and the time provided by the law.
