AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 7 "COMMUNITY
ANTENNA TELEVISION SYSTEMS" SECTION 7-1,
"DEFINITIONS" BY ADDING A DEFINITION FOR
COMMUNITY ANTENNA TELEVISION SYSTEMS,
EXEMPTING SAID SECTION FROM THE PROVISIONS
OF CHAPTER 7; PROVIDING FOR A SAVINGS
CLAUSE: REPEALING ORDINANCE NO. 81-12;
AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Chapter 7 "Community Antenna Television
Systems" Section 7-1 "Definitions" of the Codified Ordinances
of the City of Boynton Beach is hereby amended to read as follows:
Section 7-1. Definitions
For the purpose of this chapter, the following terms,
phrases, words, abbreviations, and their derivations shall have
the meaning given herein. When not inconsistent with the context,
words used in the present tense include the future tense, words
in the plural number include the singular number, and words in the
singular number include-the plural number.
CATV. 'CATV" shall mean a community antenna television
system as hereinafter defined.
City. "City" shall mean the City of Boynton Beach, a
municipal corporation of the State of Florida, mn its present
incorporated form or in any later reorganized, consolidated,
enlarged or reincorporated form.
Community antenna televmsion system. "Community antenna
television system" shall mean a system of antenna, coaxial cables,
wires wave guides, or other conductors, equipment or facilities
designed, constructed or used for the purpose of providing tele-
vision or FM radio service by cable or through its facilities
as herein contemplated. CATV shall not mean:
(.a). The transmission of any special program or
event for which a separate and distinct charge is made to the
subscriber in the manner commonly known and referred to as "pay
television".
(b) A private community antenna system, e.q., which
is a system of equipment designed to receive and distribute
televisions and radio siqnals servin~ a minimum of 10 residential
units in a Condominium or non-profit Homeowners Association.
Section 2. Should any section or provision of this
Ordinance or any portion thereof 'be declared by a court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. This Ordinance shall become effective immedi-
ately upon its passage.
