AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
SECTION 13-20, SPECIAL EVENTS BY DELETING SAID
SECTION IN 1TS ENTIRETY, AND CREATING A NEW
SECTION 13-20 ENTITLED "SPECIAL EVENTS';
PROVIDING FOR DEFINITION, APPLICATION PROCESS
FOR SPECIAL EVENT PERMITS, STANDARDS FOR
ISSUANCE OF PERMITS, CONDITIONS FOR PERMITS,
POLICY AND PROCEDURES; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, the City Commission has recognized that it is prudent to
establish regulations for "special Events", for the preservation of public health and
safety, and for the orderly maintenance of such business in a manner best suited to
benefit the citizens and residents of the community;
WHEREAS, based on the recommendation of staff, the City Commission has
determined that it is in the best interest of the citizens and residents to set forth the
following policy and procedures for the issuance of permits for Special Events;
NOW~ THEREFORE, BE TT RESOLVED BY THE Cl'TY COMMI'SSTON OF
THE C1'TY OF. BOYNTON BEACH, FLORZDA, THAT:
Section 1. That Section 13-20. Special Events shall be deleted in it entirety
and a new Section 13-20 shall be created, as follows:
Sec. t3-20. Special Events
1. Permits for Special Events.
It shall be unlawful to organize, conduct or participate in any special event on
the streets of the City or at any of the city's outdoor recreation facilities unless a
permit for such special event has been issued by the City Manager or his/her
designeev, by the City Commission ' ·

All requests for special events related to:
1) the sale and/or disbursement of alcoholic beverages;
2) any religious or political activity;
3) any multi-business related event;
4) any gathering with an expected attendance of 250 or more people
will be reviewed and considered solely by the City Commission.
2. Definition.
A. A "Special Event" shall mean any meeting, activity, gathering, or group of
persons, animals, or vehicles, or a combination thereof, having a common purpose,
design or goal upon any public or private facility, street, sidewalk, alley, park or
other place or building where the special event substantially inhibits the usual flow
of pedestrian or vehicular traffic or which occupies any public area or building and
preempts use by the general public. A special event shall include but not be limited
to City co-sponsored events, festivals, carnivals, concerts, parades, walks, races,
fund raising sales and similar gatherings, block parties, grand opening promotions,
and other similar events not specifically permitted by City Ordinance. City of Boynton
Beach Leisure Services Department events are exempt from this Ordinance.
B. "Special Event Handbook" shall mean a publication issued by th~
City of Boynton Beach Leisure Services Department entitled "Special Event
Handbook" which sets forth procedures for the application process and
City requirements for special event activities, and which is attached
hereto as Exhibit "A" and made a part hereof. This booklet may b~
amended from time to time by Resolution of the City Commission.
3. Application for a special event permit.
Any person or organization seeking to conduct a special event in the City shall file an
application with appropriate fee, for a special event permit with the Leisure Services
Department on forms provided by the City, on or before the following deadlines prior
to the event:

All information solicited on the special event permit application form must be.
provided by the appliCant. Tncomplete information may result in denial of the permit
application.
For events with an expected attendance of fifty thousand (50,000) persons or
greater, a letter of intent shall be filed at least one year prior to the event with the
City Manager describing dates, times and location of all event activities.
Notwithstanding the foregoing procedure, the City Commission reserves the right to
waive application fi'linq deadlines on a case by case basis.
4. Standards for issuance of permit.
A special event permit shall be issued by the Leisure Services Department unless'
(a) The application is not complete in all material respects and all
information co. ntained therein accurate within the knowledge of the Special Event.~
Coordinator;
(b) All of the conditions set forth herein and all contractual
requirements imposed by the City, if any, have not been or will not be met:
(c) The special event will interfere with or unduly burden the City's
provision of municipal services to the community including but not limited to police,
fire and emergency medical protection, water and sanitary sewer service, and solid
waste removal;
(d) The public benefit provided by the event has not been
demonstrated;
(e) The appropriate fee established by resolution of the City
Commission has not been paid.
5. Conditions for Permit.
All special event permit applications approved pursuant to this article shall be
subject to the following conditions:
(a) The public area utilized shall be cleaned up following any special
event and in all respects restored to its former condition. A refundable security
bond, or similar financial pledge, may be required in amount to be determined by
the Leisure Services Department, to ensure that any damage is repaired and the
premises returned to its previous condition.
(b) The use or construction of platforms, chairs or other equipment
may be prohibited or restricted by the Leisure Services Department and/or the City
Manager if such would result in permanent damage to City property or constitute a
hazard to public safety.
(c) A detailed site plan shall be submitted showinq the locations of
any tents, port-o-lets, parking lots, stages,, booths, etc., and the time periods for set
up and break down of the event. This plan shall be subject to review and approval
by City and staff.
(d) All City ordinances, rules or regulations applicable to the use of the
City property on which the special event will occur shall be obeyed, unless
specifically waived by the City Commission.
(e) Indemnification and insurance to protect the City shall be provided
as required by the City's Risk Management Department.
(f) Unless extended by the Leisure Services Department and/or the
City Manager, all permits necessary to conduct the special event shall be obtained
and copies thereof provided to the City not less than fourteen (14) days prior to the
first day of the event.
(g) When a City employee is required at a special event, he/she shall
Complete, within thirty (30) working days of the conclusion of the special event, an
evaluation of the event on forms provided by the City. The permit holder for the
special event will be provided with a copy of said evaluation. The need for a City
employee at the special event will be determined by the City Manager or his/her
designee.
(h) The fee schedule as adopted by Resolution R93-:~50 is
incorporated in this Ordinance, and may be amended by Resolution of the City
Commission from time to time.
5. Enforcement/Penalty. It shall be unlawful to operate Or hold
any special event in the City without compliance with this Ordinance.
Failure to comply with any section of this Ordinance shall be deemed a
violation of the City Code punishable by up to a five hundred ($S00.00)
fine and/or sixty (60) days in the county jail._
Section 2. That each and every other section of said Chapter not herein
specifically amended shall remain in full force and effect as previously enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
Section 4. Should any section or provision of this ordinance or portion

hereof, any paragraph, sentence or word be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the remainder of this
ordinance.
Section 5. Authority is hereby given to codify this Ordinance.
Section 6. This ordinance shall become effective immediately upon
passage.

HANDBOOK
Neighborhood Block Parties
Neighborhood block parties will normally be approved on local streets, which are not primary traffic
streets (i.e., bus routes). All private block parties must have their neighborhood association, (if one does
not exist signatures from the majority of the homeowners), submit an application for road closures.
Neighborhood Associations must submit an application, including the $25.00 fee for street closures 30
days before the event date. Late applications may or may not be approved based on the availability of
city services. Insurance may be required depending upon the risk level of the event.
Neighborhood Associations are not allowed to serve alcoholic beverages on city property unless they
apply three (3) months in advance of their event date and comply with all insurance requirements.
COMMUNITY EVENTS ON-CALL FEF
Should a Special Events team member be required to be on call during an event, the event promoter will
be charged $14.00 per houdper team member. If the Special Events team member is required to be on
site during non-working hours at an event, the promoter will remit the rate of $18.00 per hour with a
minimum of three (3) hour shifts. The Special Events Section will determine the Special Events team
member's need to be on call.
SPECIAL EVENT REQUIREMENTS
NOT/F/CATION LETTER, Special Events Section, 742-6222
The City of Boynton Beach requires each event promoter to provide a written notice one month prior to
the event, including dates, times of the event and road closures to all businesses and neighborhoods
surrounding the event. The event promoter shall also provide a copy of such notice to the Special Events
Section.
INSURANCE, Risk Management Division, 742-6040
Insurance requirements depend upon the risk level of the event. The event promoter may be required to
provide the city a certificate of General Liability Insurance in the amount of $1 million dollars, naming the
City of Boynton Beach as additionally insured. Worker's Compensat on is required for any employees
hired by the promoter. If alcoholic beverages are being served at the event, an additional $1 million dollar
Liquor Liability Insurance shall be required, naming the City of Boynton Beach as additional insured. Both
insurance policies are due two (2) weeks before the event.
Please obtain the required insurance and mail an original insurance certificate to: City of Boynton Beach,
Special Events Section, 100 E. Boynton Beach Blvd., Boynton Beach, FL 33425-0310.
ADA REQUIREMENTS, 742-6243
It is the event promoter's responsibility to comply with all City, County, State and Federal Disabilities
Access Requirements applicable to the event. All indoor and outdoor sites for special events must be
accessible to persons with diSabilities. This would also include portable restroom facilities.
SECURITY, Police Department 742-6107
For the safety of participants, volunteers, etc., police may be necessary for your event. A police officer
will be required at each location where alcoholic beverages are served and at any location deemed
necessary by the Special Events Police Liaison to maintain order and protect persons and property.
If a private security firm or individuals associated with the event are acting as security guards, the event
promoter shall indicate in the Special Events Application. The Police Liaison will also coordinate with
each promoter on how many secudty guards the promoter would need to hire for street closures and
other responsibilities. All race/walks will be required to hire security guards in order to help close the
roads and monitor street closings.

Cost
The cost for providing off-duty police services is $20.00 per police officer per hour with a minimum of
three (3) hour shifts. The estimated fee for off-duty police services will be determined when the Special
Events Police Liaison receives a finalized site map. Payments will be billed accordingly.
BARRICADES, STREET DIVISION 742-6200
The City will provide barricades at no cost contingent on availability, unless the event requires special
barricades for night street closures or re-routing traffic. Events requiring special barricade rentals shall
meet with a representative from the Public Works Department, Division of Streets, The Special Event
Police Liaison, Special Events Section. The promoter shall be responsible for the rental of any necessary
barricades.
SANITATION DEPARTMENT 742-6200
All city grounds must be cleaned of any debris resulting from your event. An extra fee will be charged if
any garbage is left on site. Any event held on a street or any business right-of-way is responsible for
clean up and removal of debris from business steps and alcoves, and may be responsible for cleaning up
to two (2) blocks surrounding the event area depending on the estimated attendance.
Dumpsters
Arrangements for dumpsters will be handled by the Special Events Team. The event promoter must
submit dumpster needs in writing, including a site map, to the Special Events Section no less than 30
days prior to the event. However, all dumpster fees incurred by the promoter will be billed after the event
by the Sanitation Department.
Dumpster fees are as follows:

To#et Facilities
Portable toilets may be required for an event depending on the estimated attendance and availability of
public facilities. The minimum number of facilities should be one male/female per 200 people per day.
The acquisition of and payment for portable toilets shall be the sole responsibility of the applicant.
Portable toilets must be on the finalized site map in order to be approved. If necessary, the number
required will be determined by the Special Events Team Leader. Toilet facilities shall be handicapped
accessible.
Recycling
Each event is encouraged to utilize its best efforts to recycle materials.
FIRE SAFETY/EMS COVERAGE, Fire Rescue Department 742-6600
If any event occurs within the city limits, the Fire Rescue Department must approve the site plan to assure
adequate fire and emergency access as prescribed by the Fire Code. The site plan must be submitted 30
days prior to the event to the Special Events Section. Each event utilizing city streets must leave a 15-
foot emergency access lane. The Fire Rescue Department will delineate fire and life safety requirements
depending on the nature and size of the event using approved codes and standards.
EMS Coverage 742-6325
The Fire Department is authorized to require employment of standby firefighters, EMS and/or Fire
Inspectors for events held within the city. The Fire Chief will make the determination of the need for such
coverage and the event promoter is responsible for calculating such charges incurred based upon 'the
department's costs including any administrative expenses.

Costs
The rate is approximately $25 per hour/per personnel.
SPECIAL EVENT PERMITR
Payments will be billed accordingly.
The City of Boynton Beach City Code regulates all carnivals, circuses and special events when they are
on public property or require city services or facilities. Prior to the event, the following items are reqUired:

OCCUPATIONAL LICENSE TAX, Occupational License Division of Department of Development
742-6360
Even though the special event itself pays an occupational license tax, it does not eliminate the
requirement of all the event vendors to be properly licensed. If the event vendor has a permanent
business location or branch office properly licensed in the city, no other license tax is due. If the event
vendor does not have a permanent business location or branch office within the city, but holds a valid and
currently effective occupational license issued by the county or another incorporated municipality, a copy
of license shall be made available to the City of Boynton Beach
Carnivals and special events have an occupational license tax rate schedule of $450 per event. Any
short term special event of one day or less and not requiring city services has an occupational license tax
rate schedule of $150 per event. Not for profit organizations are exempt from fees but must meet all
other requirements and fill out all paperwork.
FOOD VENDORS
If the food vendor has a valid and currently effective occupational license and State of Florida Division of
Hotels and Restaurants license for their restaurant or other place of business, then no other license or fee
is due.
If the food vendor has a Division of Hotels and Restaurants approved mobile food vending unit or Health
Department approved mobile food vending cart, then the vendor must obtain a Palm Beach County
Mobile Occupational License (561-355-2272). A copy must be submitted with special event application.
If the food vendor is established specifically for the event and does not meet the previous two group's
criteria, then the vendor must contact the Division of Hotels and Restaurants to obtain a copy of the
· temporary license to be submitted with the application.
The special event occupational license tax rate is per event which may be more than day. The city
individual vendor occupational license expires September 30 of each year. It is the responsibility of the
event promoter to inform the State of Florida Division of Hotels and Restaurants at (954) 958-5520 of
his/her event times, dates, number and type of food vendors.
TEMPORARY ELECTRICAL WIRIN~
Events requiring electricity must hire an electrician, meeting the licensing requirements of 489 Florida
Statute. The City of BoYnton Beach will strictly enforce the requirements of the National Electrical Code.
Temporary Wiring for all special events. Electrical permit application shall be submitted a minimum of two
(2) weeks in advance of the event. This will allow for verification that all other required permits, licenses
and insurance certificates have been obtained prior to the release of the permit. Application for electrical
permits can be obtained in the Building Division of the Department of Development.

TENTING
BUILDING DIVISION OF THE DEPARTMENT OF DEVELOPMENT 742-6350
FIRE RESCUE DEPARTMENT 742-6325
Tents require a building permit and building inspections. This application shall be made to the Building
Division of the Department of Development.
If the event involves the placement of tents, the event promoter or tent representative will need to bring
the following to the Building Division for your application for permit. This permit application will be
reviewed for code compliance.
Site plan indicating tent placement must be provided. Tent placement is not permitted within ten (10) feet
of any structure, or within 10 feet of an adjoining property line that is not participating in the event.
Flame certificate for the tent or tents must be provided. All tents, booths or canopies used for cooking or
vending shall be of fire retardant material. This does not include 10'x10' shade canopies for exhibitors.
TENT REQUIREMENTS FOR ASSEMBLY USE
· A supplemental lighting system in addition to the regular system for emergency lighting is required.
· A certificate of flame retardant fabric is required to be provided to the authority having jurisdiction.
· A confirmatory field inspection is required after the tent is erected and prior to use by the public to
confirm flame resistance.
· The storage of flammable liquids or the use of combustible materials, not flame retardant treated, are
not permitted inside the tent. There will be no smoking or open flame allowed inside the tent.
· A method to provide for emergency communications shall be provided.
· The ten-pound ABC fire extinguisher will be prominently displayed and persons operating the
assembly shall be trained.
· The public will be protected from tripping hazards and all electrical connections shall be enclosed.
Inspection Costs
Fire code Inspections of the tent will take place prior to the event and billed according to the following
schedule:
$25 per site
The maximum fee for fire code inspection of tents at any one special event shall not exceed $2,000.

When the special events permit application is received by the Special Event Team, a copy will be
forwarded to the Fire Department and the Department of Development.
SPECIAL EVENT OPTIONS
Temporary Signage
Special civic event, recreational or expositional signs of a temporary nature, not to exceed seventy-five
(75) square feet in area, which are of general benefit to the community and which are individually
approved by the Director of Development, may be permitted. Such signs shall be located at specified
points for the convenience of the traveling public. The signs shall be removed within five (5) days of the
completion of the event.
To obtain approval the permittee shall submit a written letter 30 days before the event date indicating the
size, design and location on a site map.

Directional Signage
Directional signs may be permitted on existing city signposts to direct traffic to the event site. Each sign
will require a seven (7) foot clearance between the bottom of the sign and the ground surface. The
Special Events Supervisor and the Department of Public Works must approve all directional signs. Utility
poles are not owned by the city, therefore approval must be received by Florida Power and Light (FPL),
Department of Transportation (DOT), Special Events Manager and the Engineering Department as
follows:
