AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. 79-24 OF
SAID CITY, BY AMENDING LANDUSE ELEMENT
OF THE COMPREHENSIVE PLAN OF THE CITY BY
CHANGING THE LAND USE OF CERTAIN PROPERTY
MORE PARTICULARLY DESCRIBED HEREINAFTER
FROM "LOCAL RETAIL" TO "OFFICE COMMERCIAL"
AND DELETING THE CERTAIN REQUIREMENT NOTED
IN THE TECHNICAL REPORT AS ADOPTED BY THE
COMPREHENSIVE PLAN; PROVIDING FOR A SAVINGS
CLAUSE; REPEALING PROVISION; AN EFFECTIVE
DATE AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has adopted a Comprehensive Land Use Plan and as part
of said Plan a land use element by Ordinance No. 79-24 in accor-
dance with the Local Government Comprehensive Planning Act; and
WHEREAS, the procedure for amendment of a Land Use
Element of Comprehensive Plan as set forth in Florida statutes
163~3184 has been followed; and
WHEREAS, after public hearings and study, the City
Council deems it to be in the best interest of the inhabitants of
said City to amend the aforesaid Land Use Element of the Compre-
hensive Plan as adopted by the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Ordinance No. 79-24 of the City is
hereby amended to reflect the following. That the land use of
the following described land located in the City of Boynton Beach,
Florida, shall heretofore be "Office Commercial" rather than
"Local Retail". Said land is more particularly described as
follows:
A parcel of land in Section 30, Township 45 South,
Range 43 East, Palm Beach County, Florida, more
particularly described as follows:
Commencing at the Southeast corner of said Section
30; thence N 0°51'37'' W, a distance of 40 feet, thence
S 88°22'15'' W, a distance of 50~00 feet to the point
of beginning; thence continue S 88°22'15'' W, a dis-
tance of 445.08 feet; thence N l°20'08'' W, a distance
of 774.00 feet; thence along the arc of a curve concave
to the northwest, having a central angle of 6o43'40''
a radius of 1949.86 feet, a length of 228.96 feet;
thence along the arc of a curve concave to the
Southeast, having a central angle of 4°52'0'' a radius
of 1869.86 feet, a distance of 158.82 feet; thence S
3037'36'' E, a distance of 5.00'; thence along the
arc of a curve concave to the South, having a central
angle of 0046'05", a radius of 1864~86 feet, a dis-
tance of 25.00 feet; thence S 46°48'21'' E, a dis-
tance of 35.00 feet; thence S 0°51'37'' E, a distance
of 25.00 feet; thence S 88°12'32'' E, a distance of
14~74 feet; thence S 0°51'37'' E, a distance of
744.47 feet to the point of beginning. Containing
8.06 acres more or less.
Section 2. That Ordinance No. 79-24 of the City is
hereby amended to reflect the following:
That the special condition placed on the tract of land
more particularly described in Section 1 of this Ordinance re-
quiring vehicular access from the piece of property to Woolbright
Road as noted on Page 41, Item Number 5 of the Boynton Beach
Comprehensive Plan Technical Report, is hereby repealed and
deleted.
Section 3. That any maps adopted in accordance with the
Land Use Element of said Comprehensive Plan shall be amended
accordingly.
Section 4. That should any section or provision of this
Ordinance or any portion thereof be declared by a court of compe-
tent jurisdiction to be invalid, such. decision shall not affect
the remainder of this Ordinance,
Section 5. Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 6. This Ordinance shall become effective
immediately upon its passage.
