AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 5, BUILDING CODE,
BY THE ADDITION OF SECTION 5-4, WHICH SHALL
BE THE ADOPTION OF THE STANDARD MECHANICAL
CODE, 1979 EDITION, BY ADOPTING SAID
MECHANICAL CODE WITH THE UNIFORM MINI~IM
COUNTY-WIDE ADDENDUMS AS RECOMMENDED BY THE
BUILDING CODE ADVISORY BOARD OF PALM BEACH
COUNTY; PROVIDING FOR A SAVINGS CLAUSE,
REPEALING PROVISIONS; AUTHORITY TO CODIFY;
AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, the City of Boynton Beach is mandated by the
Florida Legislature to adopt the same basic construction codes
as all municipalities in Palm Beach County; and
WHEREAS, the Building Code Advisory Board of Palm Beach
County has recommended the adoption of the 1979 addendum to
standard codes with uniform minimum county-wide addendums.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 5 of the Code of Ordinances of
the City of Boynton Beach, Building Code, Section 5-4 is hereby
added to said Code to read as follows:
The standard Mechanical Code, 1979 edition,
copies of which are filed with the Clerk
of the City of Boynton Beach, Florida, be and
the same are hereby adopted as the Mechanical
Code of the City of Boynton Beach, Florida.
Subject, however, to such amendments, cor-
rections and additions as shall appear in
Section 5-5 of this Chapter.
Section 2. That Chapter 5 of the Code of Ordinances of
the City of Boynton Beach, Florida, Building Code, Section 5-5 is
hereby adopted to read as follows:

There is hereby established a Mechanical Inspection Division, within
the Building Department, which shall be in the charge of the official
so legally designated by the local governing body.
102.2 - Inspectors.

Authority of the governing body may appoint such number of officers, inspec-
tors, assistants and other employees as shall be authorized from time to
time. No person shall be appointed as inspector of mechanical systems who
has not had a least five (5) years experience as a mechanical inspector,
engineer, or as a superintendent, foreman, or competent mechanic in charge
of mechanical construction. The inspector appointed shall be certified
within twelve .(12) months of appointement by the Building Officials
Association of Florida. '
103.6 - Delete and Substitute the following:
See Section 103.6 of the Standard Building Code for Product Control

103.7 - ~end by identitying the existing paragraph as sub-section (a)
and add a new sub-section (b) to read:

104.3 - Form. Delete and substitute the following:
Each application for a permit with the required fee, shall be filed
with the Building Official, on a form furnished for that purpose, and
shall contain a general description of the proposed work and its location.
The application shall be signed by the owner, or his authorized agent.
105.2 - Conditions of the permit. Delete existing paragraph and rewrite
as follows: ~
The Building Official shall act upon an application for a permit with
plans as filed, or as amended~ without unreasonable or unnecessary delay.
A permit issued shall be construed to be a license to proceed with the
work and shall not be construed as authority to violate, cancel, alter,
or set aside any of the provisions of this code or any other regulations~
nor shall such issuance of a permit prevent the Bu!~ng' '] ~' Official from
thereafter requiring a correction of errors in the plans or in construction,
or of violations of thiS code.
.... Permits may be issued subject to either of the following conditions:
(a) Every Permit issued shall become null and void unless the work

has no progressive inspeCtion for a period of ninety (90) days
after the time the work is commenced.
Before work, for which the permit has, for any reason, become null and
void, may be subsequently commenced, orrecommences,= a new permit shall
first be obtained. A null and void permit may be renewed, for a prorate~
amount of the original fee, provided the proposed work conforms with all
requirements, ordinances, rules and regulations effective at the time of
such renewal.
In every case, a courtesy notice shall be mailed by the Building
Official to the permit holder advising that said permit is null and
void.
105.3 - Annual Industrial Permits: Add the following paragraph:
Upon written request to the Building Official, any industrial plant
may. be issued an annual permit for mechanical work, installation,
maintenance and equipment raarrangement covering units, ducts, and piping
in or on the premises owned or occupied by the holder as described in
the permit, but to be issued subject to the following conditions:
(1) The~ payment of an annual fee of one hundred, dollars ($100.00) for
each calendar year, and permit fees computed, monthly according to the
fee schedule above.
(2) The regular employment of one or more full time mechanics competent
in the safe installation, extension, maintenance and repair of industrial
mechanical systems and equipment.
(3). The right of the Mechanical Inspector to check the premises o'f the
permit holder at a reasonable timer unless prohibited by government regula-
tiOns. - ~
(4) The performance of all work shall comply with the applicable provisions
of this chapter. '~ ·
(5) The annual industrial permit shall cover the rearrancement of indus-
trial equipment including extension of duct systems required therefore and
inspection fees therefore~
105.4 - Qualifications of Applicant. Add new paragraph as follows:
Application for permits shall be accepted only'from contractors currently
licensed in their respective field and for whom no revocation or suspension
of license is existing except that a sole o%~ner may make application for
permit and install the work in connection with the construction, replace-
ment or alterations of a single family residence or two family residence for
his own use an~ occupancy and not intended for sale~ Such license~ contrac-
tor or sole owner shaI1 be held responsible to the Building Official for
the proper supervision and conduct of all work covered thereby.

On all mechanical work covered by this co~e· requiring a permit as set
forth in Section 10~, a fee shall be paid as require~ at the time of
filing application in accordance with the fee schedule established by

for each reinspection made due to the rejection of work, or due to the fact
that work was not ready at the time specified in the request for inspectiont

Any person, firm, or corporation who shall violate a provision of
this Code, or fait to comply therewith, or with any of the requirements
thereof, shall be guilty of misdemeanor. Each such person shall be
deemed guilty of a separate offence for each and every day or portion there-
of during which any violation of any of the provisions of this Code
is committed or continued, and upon conviction of any such violation, such

All condensate piping shall be ga!vanize~ steel, copper pipe or tubing
or rigid plastic plpe~ Black steel pipe shall not be used. Rigid plastic
pipe shall be a minimum of PVC schedule 40. Condensate lines shall be
a minimum of three/fourths inch (3/4") size pipe or seven/eights inch
(7/8") size copper tubing size. When more than one unit is manifolde,/
together for condensate.drainage~ the pipe or tubing must be sized in
accordance with good engineering practices. In no case shall the conden-
sate line be smaller than the outlet of the unit it serves. Connections
to the Unit drain may be either flexible connections or rigid piping
and shall be provided with a trap having a minimum three inch (3") seal.
Flexible connections used to form a trap shall not exceed eighteen inches
(18") in length. Care should be taken to prevent double trapping.
Air conditioning or any water from an air-conditioning system of any
building which wouId flow by gravity over any public property or adjacent
private property shall be carried away by means of conductors. The
Building Official may require the air conditioning system waste water
be connected to a storm sewer or catch basin~ if available. Condensate

Section 3. Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. Should any section or provision of this
ordinance or any portion hereof be declared by a Court of com-
petent jurisdiction to be invalid, such decision shall not affect
the remainder of this ordinance.
Section 5. Authority is hereby gramted to codify this
Ordinance.
Section 6.
This Ordinance shall become effective
immediately upon its passage.
