O80-49AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMEbIDING SECTION 4-23 OF ORDINANCE 69-36 BY INCREASING THE FEES FOR IMPOUNDING FROM TWO DOLLARS TO FIVE DOLLARS FOR THE FIRST OFFENSE, FROM TWO DOLLARS TO TEN DOLLARS FOR THE SECOND OFFENSE AND FROM TWO DOLLARS TO FIFTEEN DOLLARS FOR THE THIRD OFFENSE, BY INCREASING THE FEE FOR KEEP OF THE DOG FOR EACH DAY IMPOUNDED FROM TWO DOLLARS- TO THREE DOLLARS AND BY ESTABLISH- ING A FEE OF TWO DOLLARS FOR SPRAYING, PRO- VIDING FOR A SAVINGS CLAUSE, REPEALING PRO- VISION, AN EFFECTIVE DATE AND FOR OTHfl~R PURPOSES. WHEREAS, the charges for animal shelter services provided by the City of Boynton Beach have not been revised since 1969; and WHEREAS, the costs of providing animal shelter services have increased substantially over the intervening period of 11 years; anid t,H{EREAS, the City of Boynton Beach is desirous of bringing its charges for animal shelter services in line with actual costs. NOW, THEREFORE, BE A2~D IT IS P~REBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 4 of the Code of Ordinances of the City of Boynton Beach, Florida, Section 4-23, Impounding; redemptic fees, is amended to read as follows: Sec. 4-23. Impounding, redemption; fees. Any dog found in the city that has not been vaccinated and tagged as provided in section 4-22 shall be impounded by the city. The owner of any dog impounded may redeem the same for a period of three (3) days after notice of impounding, which may be by one (1) publication at the city hall, upon the payment of an t fee of ~we-Rstta~s-~$R=QQ), five dollars ($5~00) for the impounding first offense, ten do'llars ($I0.'00) for the second off'ense and fief'teen doll'ars ($1'5.00) ~f'or the third of'fense, and in addition thereto, ~we-~etta~s~=~, three dollarS ($3.00), for keep of the dog for each day impounded;provided that the dog shall be vaccinated, tagged and registered as herein provided, and a fee in the amount of two dollars ($2.00) for spraying. Ail dogs shall be painlessly destroyed after three (3) days from the notice of impounding of the chief of police without further notice to the owner , If the owner of any dog impounded is unknown, the chief of police shall make an investigation, exercising ordinary dili- gence, for the purpose of ascertaining the owner thereof. If the owner is not ascertained within three (13) days from the date of notice, the dog shall be painlessly destroyed. If the owner is ascertained, upon investigation by the chief of police, the owner may redeem such dog within forty-eight (48) hours after the chief of police shall notify the owner of the impounding by the payment of all impounding, keeping and licensing fees. If the dog is not redeemed within the forty-eight (48) hour period, it shall be painlessly destroyed without further notice to the owner~ Such forty-eight (48) hOur oeriod shall cormnence after actual notice or three (3) days after notice by publication. Section 2. Ail Ordinances or parts of Ordinances in con- flict herewith are hereby repealed. Section 3. Should any section or provision of this Ordinanc~ or any portion thereof, be declared by a Court of competent juris- diction to be invalid, such decision shall not affect the remainde; of this Ordinance.
