O80-44ORDINANCE NO. ~'~. -AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, STATING THE MILLAGE RATE TO BE LEVIED AGAINST PROPERTY OWNERS WITHIN THE CITY FOR THE 1980 - 1981 FISCAL YEAR; FURTHER STATING THE PERCENT BY BPHICH THE MILLAGE RATE EXCEEDS THE ROLLED BACK RATE (AS DEFINED BY FLORIDA STATUTES §200.065(2)) PROVID- ING THAT THE CITY MANAGER SHALL HAVE THE AUTHORITY TO ADJUST THE MILLAGE RATE UPON RECEIPT OF THE FINAL TAX ROLL; PROVIDING FOR A~] EFFECTIVE DATE AND FOR OTHER PUR- POSES. WHEREAS, the City Charter of the City of Boynton Beach, Florida, and the Laws of Florida require an appropriation ordin- ance be passed by the City Council of said municipality each year adopting the budget; and WHEREAS, Florida Statutes §200.065(2)(d) reauires that prior to the adoption of the final budget that an ordinance statin the millage rate proposed by the municipality be passed; and WHEREAS, said ordinance must also state the percent of increase in property taxes adopted by the governing body; and WHEREAS, said millage rate must be adopted separately and before the budget of the community; and WHEREAS, the City of Boynton Beach, Florida, has followed the procedures as outlined in Florida Statutes §2Q0.065; and WHEREAS, Florida Statutes §2Q0.065(5) provides for a ministerial adjustment of the millage rate after receipt of the final tax roll. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SeC'tion 1~ That the City Council of the City of Boynton Beach, Florida~ hereby adopts~ 7.4 mills as the official millage rate of the City for the 1980 - 1981 fiscal year~ Sectfon 2. That in accordance with Florida Statutes §200.065, the City Council of the City of Boynton Beach, Florida, hereby states that said millage exceeds the rolled back rate as defined by Florida Statutes §200.065 by 3Q.58 percent. Section 3. That upon receipt of the final tax roll if said roll indicates that the certified taxable value within the district has decreased from the original tax roll presented to the City by the property appraiser's office, that the City Manager shall within three (3) days make the ministerial adjustment to the millage rate to assure that the same amount of taxes shall be collected by the City. Said adjustment shall be reported to the property appraiser within three (3) days of receipt of the final tax roll. Section 4.
