CITY OF BOYNTON BEACH, FLORIDA, THE PARKING
RULES AND REGULATIONS ON THE CITY'S MUNICI-
PAL BEACH PROPERTY WITHIN THE TOWN OF OCEAN
RIDGE, FLORIDA, BY RAISING THE DAILY PARKING
FEE FOR CLASS 1, MOTOR VEHICLES FROM $2.00
TO $3.00 A DAY; PROVIDING FOR A REPEALING CLAUSE;
PROVIDING A SAVINGS CLAUSE; PROVIDING A~ EFFEC?
TIVE DATE AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 19-38.1 of the Codified Ordin-
ances of the City of Boynton Beach, Florida, concerning parking
rules and regulations on the City'~s municipal beach property
within the Town of Ocean Ridge, Florida, is hereby amended to
read as follows:
Sec. 19-38.1. Rules, regulations controlling parking of vehicles
at municipal beach property located within the
Town of Ocean Ridge.
The policy manual setting forth certain administrative
rules and regulations regarding utilization of the City of Boyntom
Beach, Florida, municipal beach property located within the Tovm
of Ocean Ridge, Florida, a copy of which is attached hereto and
hereby' made a part hereof, is hereby, ratified, adopted and approved~
and the city manager is hereby directed to imolement subject pro-
cedures at the earliest possible date. [Said regulations are
set out below.] The responsibility for the administrative issuan¢
and control of parking permits is hereby vested in the City Clerk
of the City of Boynton Beach, Florida.
PARKING PE~ITS
Policy No. 1
Parking permits will be issued on an annual basis (Oct. 1
thru Seot. 30) with issuance beginning Sept. 1 each year to resi-
dents (see "DeCinitions") of the City of Boynton Beach, for a
charge of one dollar ($1.00) for the first decal issued to a resi-
dent vehicle, upon satisfactory completion of appropriate appli-
cation forms. Applicants will be required to establish proof of
residency in the City of Boynton Beach (see "Definitions") and
to present his official state motor vehicle tag registration
certificate.
When application is made for more than one permit, each
separate individual vehicle registration must be presented.
Residents who are not property owners must establish, residency
by some suitable, means such as voter's registration, executed
lease, utility bills or other legal document.
Permanent beach parking decals shall be issued only to
residents owning real estate and/or residing in the city for at
least six 46) months of each year. In all other cases, temporary
parking permits shall be issued to residents at a charge of two
dollars ($2.00). Proof of six (6) months residency shall be
established via lease agreements, rent receiots, or written lessoz
verification.
In the event that a decal, .which has been issued to a
resident vehicle, is lost .or deStroyed, a new decal shall be
reissued to the said resident vehicle for a charge of one dollar
($1.00).
Definitions.
RESIDEI~f: Anyone ov~ing real estate and/or leasing, rent
ing or occupying real estate or living accommodations within the
City of Boynton Beach for a time period of at least six (6) con-
secutive months each calendar year, as well as members of their
immediate family residing with them.
VISITOR: Paying guests at hotels and motels located with:
Boynton Beach and guests staying in Boynton Beach with residents
thereof.
CITY E}~LOYEES: Ail city employees, classified and non-
classified, regardless of residency shall be eligible to receive
one parking permit. Proof of employment shall be established
through the personnel department of the City. Persons who termin-
ate their employment with the City and who are not city residents

shall be required to scrape off their stickers and return remains
to issuing office.
PROCEDURE FOR ISSUANCE OF PARKING PEPfMITS
Policy No. 2.
(1) Insure that applicants are residents as defined in
Police #1.
(2) Have applicant complete permanent application form.
(3) Request proof of residency. Proof established in
accordance with Policy #1.
(4) Request separate vehicle registration for each park-
ing permit to be issued.
(5) Residents leasing automobiles should provide contract
documents establishing the lease agreement or arrangement~
(6) Issuing authority shall complete parking permit ap-
plication by listing separate permit numbers opposite the make,
model, and year of each vehicle.
(7) All parking permits shall be permanently affixed upon
the lower, right-hand side. (passenger side) of the inside of the
front windshield of such vehicle. Decals placed on a vehicle
other than the one for which it was originally issued shall be
considered void and shall be confiscated.
(8) Parking permits issued to motorcycles, motor bikes,
and motor scooters shall be displayed on the right front fork of
such vehicle, or other visible location.
TEMPORARY PARKING PEP~ITS
Policy No. 3,
Temporary parking permits will be issued by the City of
Boynton Beach in accordance with Policy Numbers 1 and 2,
RESIDENTS: Residents who do not own property and who
lease, rent, or occupy living accommodations for less than six ~6
months of each year shall be issued a temporary parking oermit fo~
a charge of two dollars ($2.00) which shall be valid for a maximu~
period of six (6) months from the date the permit is issued.

VIS ITORS:
A. Guests staying with residents shall be issued a tem-
porary parking permit at a charge of two dollars
($2.00). Such permits shall be valid for a maximum
time period of four (4) consecutive weeks~
B. Paying guests at hotels and motels shall be
issued motel guest verification, permits by
the hotel manager or his designee. Upon
presentation of said form at the beach entrance
station, said guest shall be charged fifty ($.50)
cents per day.
The original copy of the permit will be given to the appl:
cant while the duplicate copy will be filed with the application
form.
PARKING FEES FOR MOTOR VEHICLES
A daily parking fee is hereby established for all motor
vehicles parking at the public beach except those hereinafter
excepted in accordance with the following rates and charges.

Exceptions:
Vehicle 'having affixed thereto a parking permit issu~
in accordance with the rules and regulations of polio
1 and 2.

(2) Official state, county, and city vehicles entering
the park in the performance of governmental function~
(3) The vehicles of public utility companies, workmen,
tradesmen, or salesmen when engaged in official park
business.
(4) School buses transporting Florida school, college
or university students in a group or body for a
field trip for educational purposes. This exception
shall not apply to vehicles transporting such groups
to the park for recreational purposes°
Florida school groups, as mentioned in exception (4)
must make prearrangements with the director of rec-
reation or his designee by submitting a letter from
the school principal certifying that the trip is a
part of the school curriculum.
Parking permits will be available to all city residents
as outlined in Policies 1 and 2. Vehicles not exhibiting the
permit'will be required to pay the parking fee in accordance with
th~s policy.
PARKING AREAS FOR MOTOR VEHICLES
(1) Ail motorcycles, motor bikes, and motor scooters sha]
park in the designated areas on the upper level of the parking
area at the public beach.
(2) The parking spaces in the upper level of the parking
area at the public beach shall be used exclusively by automobiles
Additionally, only vehicles having affixed thereto a parking
permit issued in accordance with the rules and regulations of
Policies 1 and 2 may park in said upper level; provided, however,
that handicapped persons may park in designated spaces on the
upper level without having a parking permit affixed to their
vehicles.
(3) All other motor vehicles, including all vans, camper~
trucks, buses and trailers shall park in the lower level spaces
of the parking area at the public beach.

PENALTY FOR NONCOMPLIANCE WITH RULES AND REGULATIONS
It shall be unlawful for any person to falsify informatio~
in the process of applying for a parking permit, for any person
to sell a parking permit, for any person to transfer a parking
permit to a nonresident, or for any person to fail to follow the
rules and regulations pertaining to the use of the parking
facilities at the public beach.
Section 2. Ail Ordinances in conflict herewith are
hereby repealed.
Section 3. That should any section or provision of
this Ordinance or any portion thereof be declared by court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 4. This Ordinance shall become effective
immediately upon its passage.
