O80-38ORDINANCE NO. 80- ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING ORDINANCE NO. 79-28 AND ORDINANCE NO. 79-35 IN RELATION 'TO THE CODE ENFORCEMENT BOARD OF THE CITY OF BOYNTON BEACH TO MAKE SAID ORDINANCES C~LY WITH THE MUNICIPAL CODE ENFORCEMENT BOARD'S ACT~OF 1~80 BY PROVIDING FOR THE BOARD TO HAVE SIX (6) MEMBERS; PROVIDING FOR FOUR (4) MEMBERS TO BE A QUORUm; PROVIDING FOR THE TERM OF MEMBERS; PROVIDING FOR THE READOPTION OF THE CODE ENFORCEMENT BOARD PURSUANT TO THE 1980 LEGISLATIVE ACT; PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the Palm Beach County Municipal Code Enforcement Board Act of 1979, the City of Boynton Beach created a Code Enforcement Board, and ~EREAS, the City Council of the City of Boynton Beach recog- nizes that said Board has served to promote, protect and improve the health, safety and welfare of the citizens of the City of Boynton Beach, and WHEREAS, the Florida Legislature during their 1980 Session enacted the "Municioal Code Enforcement Board's Act" which shall apply to all incorporated areas of every municipality of the state and shall be effective on October 1, 1980, and I~EREAS, the City Council of the City of Boynton Beach, Flori~ wi~hes for the Code Enforcement Board of the City to conform with ~aid Legislative Act. NOW, THEREFORE, be and it is hereby ordained by the City Council of the City of Boynton ~Beach, Florida: Section 1. That those provisions of Ordinance No. 79-28 as amended by Ordinance No. 79-35 of said City are hereby readopted by the City Council of the City of Boynton Beach pursuant to the '"~Municipal Code Enforcement Board's Act" of 1980. Section 2. That Section 4 of Ordinance No. 79-28 of the City Council of the City of Boynton Beach, Florida, as amended by Ordinance No. 79-35 of said City is hereby further amended to read as follows: Section 4: Enforcement Board; Organization: The City Council shall appoint a ~ve-~) six (6) member Code Enforcement Board, along with ~ws-~R) one (1) alternate~ and legal counsel for the Board. The members shall have the following qualifications and terms of office: A. Members of the Code Enforcement Board shall be resi- dents of the City of Boynton Beach, Florida. Appointments shall be made by the City Council on the basis of experience or interest in the fields of zoning and building control. The members of the Code Enforcement Board shall whenever possible be as follows: 1 Architect. 2 Businessman. BUsinessperson. 3 Engineer. 4 General Contractor. 5 Subcontractor. ~= 6 Realtor. B In order for the terms of office of all members not to expire at the same time, initial appointments of the Enforcemen' Board shall be as follows: Two (2) members and one (1) alternate shall be appointed for a term of one (1) year. Two (2) members shall be appointed for a term of two (2) years. Two (2) members shall be appointed for a term of three (3)years. Thereafter, all appointments shall be made for a of three (3) years. Any member may be reappointed from term to term on approval of the City Council. Appointments to fill any vacancy on the Code Enforcement Board shall be made for the re- mainder of the unexpired term of office. Any member who fails to attend two (2) out of three (3) successive meetings without prior approval of the Chairman shall automatically forfeit his appointment and the City Council shall promptly fill such vacancy The members shall serve at the pleasure of the City Council and -2- may be removed as provided in the Boynton Beach City Code of Ordinances for removal of members of the Planning and Zoning Board. C. The members of the Code Enforcement Board shall elect a Chairman. The presence of ~h~ee-(B) four (4) or more members shall constitute a quorum of the Enforcement Board. Mem- bers shall serve without compensation, but may be reimbursed for such travel expenses, mileage expenses, and per diem expenses as may be authorized by the City Council. D. The Board Attorney shall either be counsel to the Enforcement Board or shall represent the City of Boynton Beach by presenting cases before the Boardm E. The alternate member of the Board may attend all me, tings of the Board but shall act only in the absence, disabilit or disqualification of a regular member thereof. When an alter- nate member acts, the minutes of the meeting shall reflect the absent, disabled or disqualified member and whose place and stead the alternate is acting. Section 3. Ail provisions of ordinances in conflict herewith are hereby repealed. The remaining orovisions of both Ordinance 79-28 and 79-35 as well as other City Ordinances not in conflict herewith are ratified and reaffirmed.
