O98-34ORDINANCE O98- ~.~,/' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE PERSONNEL POLICY MANUAL OF THE CITY OF BOYNTON BEACH, BY AMENDING CHAPTER 1, GENERAL PROVISIONS; CHAPTER 19, VACATiON LEAVE; CHAPTER 20 SICK LEAVE WITH PAY; CHAPTER 24 LONGEVITY BENEFITS; CHAPTER 30 EFFECTIVE DATE; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, on February 2, 1998, the City Commission of the City of Boynton Beach adopted a Personnel Policy Manual for the City of Boynton Beach; and WHEREAS, after further review and upon recommendation of staff, there appear to be several areas which require clarification and/or amendments in said Policy; and NOW, THEREFORE, BE I'T ORDA'rNED BY THE CI'TY COMMi'SSI'ON OF THE CI'TY OF BOYNTON BEACH, FLORI'DA, THAT: Section 1. That Chapter 01 General Provisions is hereby amended by adding the words and figures in underlined type, and by deleting the words and. figures in struck-through type, as follows: CHAPTER 0:1. GENERAL PROV~'S]:ONS SECTION 1. PURPOSE OF THESE POLICIES: These policies are to be followed by the City in the administration of the City's personnel program. It is the intent of these policies that City employees will be dealt with on an equitable basis, so that the citizens of the City may derive the benefits and advantages which can be expected to result from a competent staff of City employees. SECTION 2. POSITIONS COVERED BY THESE POLICIES: A_ These policies shall apply to all non-contract employees. These policies apply to union employees only when they are incorporated in the union employees collective bargaining agreement, and have been ratified by the City Commission DRAFT Revised 8/13/98 and the bargaining unit. These policies apply to employees with individual contracts only if incorporated by reference in the employee's contract. :' pi .-.., .............. An em oyee who is promoted after October Z, Z998, shall be subiect to the provisions of the PPM as .~ cOndition of promotion, notwithstandinq previous status as a civil service employee. An employee may reiect a promotion and maintain their civil service status. SECTION 3. APPROVAL OF POLICIES: These policies shall be in force and effect when approved by Ordinance of the City CommisSion and replace existing policies, rules or regulations which are in conflict with these policies. SECTION 4. AMENDMENT OF POLICIES: These policies may be amended from time to time by Ordinance of the City Commission, unless otherwise specified in this document. SECTTON, 5. CODTFZCATZON: The City Administration, from time tn time, reserves the riqht to recodify the Personnel Policy Manual tn facilitate its use. Section 2. That Chapter 19 Vacation Leave is hereby amended by adding the words and figures in underlined type and by deleting the words and phrases in struck-through type, as followS: Each full time employee shall earn vacation leave at the rates shown in the schedule oUtlined :" ~'" ~h...~..,~ below ="'*' "~'"' ...... ~" ~ ~h-' ^~,~ -,~ -,~::: "~"+' ........... In computinq vacation leave, no vacation leave will accrue for any week in which the employee is not in a paid status for 2~ or more houm. A reqUlar employee shall upon termination of employment with the C{~, be paid for unused accumulated vacation leave. Employees on their initial one year probation are not eligible to take vacation for the first six months of employment. Employees who leave their employment with the C{~ within the tilt six (6) months of empIoymenf_ are not e{{qib{e to be paid for any accrued vacation time. Section 3. That Chapter 20 Sick Leave With Pay is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: DRAFT Revised 8/13/98 CHAPTER 20 SICK LEAVE WITH PAY Employees serving a probationary period on an original appointment shall accrue sick leave in accordance with the provisions of this section. In computing sick leave taken, all employees shall be charged one hour sick leave for each hour not worked because of illness. Section 4. That Chapter 24 Longevity Benefits is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: CHAPTER: 24 LONGEV/TY BENEF:~TS PURPOSE To provide benefit incentives to long-term employees, giving recognition for continuous and meritorious service. Longevity benefits are available within these guidelines. BENEFIT Employees will receive a cash Lump Sum Bonus as follows: On the employees filth (5th) anniversary a lump sum payment of $500.00. DRAFT Revised 8/13/98 On the employees tenth (10th) anniversary a lump sum payment of $1,000.00. On the employees fifteenth (15th) anniversary a lump sum payment of $1,500.00. On the employees twentieth (20th) anniversary a lump sum payment of $2,000.00. (An-emoloyee who opts into the Personnel Policy Manual before October :L, :L998, and who has a 5th, :~0th, :L5th or 20th anniversary date after March 3:~, :~998, will. incur the lump sum bonus listed above) Section 5. That Chapter 30 Effective Date of Policies is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: CHAPTER: 30 EFFECTIVE DATE OF POLICIES The effective date of this policy will be March 30, 1998. The policies shall be appliCable to all employees hired after March 30, 1998, and to all employees hired before March 30, 1998, if that employee files a written election, on or before 3'..'nc I October l, 1998, to be covered by these policies and not by Civil Service Rules and Regulations. A permanent employee who timely makes the election to be covered by these policies, will continue to accrue sick and vacation time in the same manner he or she accrues it under Civil Service. " .... : shall upon termination of employment with the City, be paid for unused sic~ and vacation time in the same manner as they would have been entitle~ to be paid under Civil Service Rules and Requlations. Section 6. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 7. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance.
