Minutes 10-15-83MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, NOVEMBER 15, 1983 PRESENT James R. Warnke, Mayor Carl Zimmerman, Vice Mayor Nick Cassandra, Councilman Joe deLong, Councilman Samuel L. Wright, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W. Vance, City Attorney Mayor Warnke called the meeting to order at 7:30 P. M. He announced the invocation tonight will be given by one of our prominent citizens, Mr. Jim O'Meara, followed by the Pledge of Allegiance to the Flag. AGENDA APPROVAL Councilman deLong stated under Administrative, he would like input from the Council in reference to the letter received from Futura Printing. Mr. Cheney referred to submitting a supplemental agenda and stated he would like to make two additions to the Consent Agenda: an additional bill under Approval of Bills from Jim Graham, Auctioneer, in the amount of $3,717.48, and request for approval of a cemetery refund. Under Legal, there are two additions, an ordinance for first reading in reference to annexation of the Melear property and a resolution rela- tive to the annexation of the Melear property. Also, under the Consent Agenda, he would like to delete Item E - Approval of Boynton Beach Elks Lodge No. 2676 to use Jaycee Park for Craft Bazaar, because we have not received the material relative to this request. Councilman Wright stated under New Business, he would like to add the communication from Motorola regarding the unitary tax. Under New Business, he also requests the item of replacement for the representative on the Community Action Board. Mr. deLong moved adoption of the agenda with these additions and deletions, seconded by Mr. Cassandra. Motion carried 5-0. ANNOUNCEMENTS Mayor Warnke acknowledged the presence in the audience of our immediate past mayor, Marty Trauger, and the Director of the Chamber of Commerce, Owen Anderson. The Mayor announced that City Hall will be closed on November 24 and 25 in observance of the Thanksgiving holiday. - 1 - REdULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Mayor Warnke announced the Christmas Parade will be held on Sunday, December 4. Mayor Warnke advised that he has received a communication from the Statue of Liberty Committee of Florida asking him to be the representative for forwarding funds from this area to them. He has requested further details about this. It will cost the citizens one-quarter billion dollars to reno- vate the Statue of Liberty and Ellis Island and he questions this amount and wants more information before agreeing to take donations in the name of the City. Mayor Warnke announced that he received a communication from Senator Paula Hawkins advising that her aide will be at Boynton Beach City Hall from 2:00 to 3:00 P.M. on November 30 for any questions anyone may have of Senator Hawkins. Mayor Warnke read a Proclamation proclaiming the month of December, 1983, as "Let There Be Peace on Earth and Let It Begin With Me". The Mayor then proclaimed the decade of 1983-1992 as "The Decade of Disabled Persons". Mayor Warnke read the holiday sanitation schedule pertaining to garbage and trash pickup. MINUTES Regular City Council Meeting Minutes of November 1, 1983 Mr. Cassandra moved to accept the minutes as presented, seconded by Mr. deLong. Motion carried 5-0. CITY MANAGER'S REPORT Beach Renovation Project Mr. Cheney announced this project is advertised for receiving bids on December 6. As of now, 16 bidders have picked up documents. A pre-bid conference was held today and about 12 general contractors were present, which suggests a lot of interest in the project and hopefully we will receive a good price. It is anticipated that bids will be opened on December 6 with construction starting just after the new year. State Nursery Mr. Cheney told about the Dept. of Transportation owning a large nursery south of here and giving away trees and - 2 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 advised we have brought about 170 trees back to the City, which we are putting in our nursery for future planting. Girl Scout Park Mr. Cheney reported that we have finally received the recorded deed for Girl Scout Park. We are now the owners of Girl Scout Park, as long as we use it for public purposes. We have no specific plans or money now for the park. Utility Line Construction The City Manager referred to the Council approving construc- tion of utility lines for the V.F.W. building and access street and reported that the contract was awarded two weeks ago and he believes construction has begun. Also included is construction of the utility line on S. W. 8th Street and construction will begin very soon. This street will give additional access to the east end of the Leisureville development. Golf Course Mr. Cheney referred to the golf course permits being sold out and reported that as of the beginning of this month, there are 353 for the City and 447 for the County. We have no problem filling ~acancies because there are 544 names on the waiting list. We can keep 800 names on the annual per- mit list full for some time. PUBLIC AUDIENCE Mayor Warnke announced that anybody who wished to speak on any item not on the agenda may come forward and do so at this time. He added if anyone wishes to speak on an item on the agenda to please give their name to the City Clerk and they will be called upon at that time. Mr. Earl Hawk, Principal of Atlantic High School, came before the Council to discuss a mutual problem and requested assistance. He told about field improvements being needed for activities to serve all the people. He referred to the funds needed and advised the County has agreed to put up $87,000 for an automatic irrigation system, plus the School Board has said they will participate with matching funds and they have secured $16,000 from Delray Beach and are asking Boynton Beach to participate to that extent° Dr. McOwen showed a sketch and explained the proposed field improve- ments. He told about various events held at the school. They are asking the Council to give consideration to the proposal made here tonight. Councilman deLong replied that - 3 - · REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 the Council will have to find out from the City Manager if we have these funds available and suggested in the future that they make a presentation at the budget session. Mr. Cassandra referred to Caloosa Park having four fields and questioned the possibility of this being annexed to Atlantic High School and Mr. Hawk informed him they are using that facility right now. and it is an overbooked situation. Mayor Warnke asked the City Manager if he had any answer as to possibly where this money would come from if approved and Mr. Cheney replied that if given a couple weeks, he will look at it and consider our expected use of the facility and what they might do about funding. It is possible we could plan to use some of the recreation subdivision money for this project. It serves the entire city. He will have to check this with the City Attorney. Mr. Hawk advised the timing on this is fairly critical as they are booked tight with activities. The Palm Beach County School Board is set to start irrigation in March, so it will be ready for summer programs. They would appreciate any consideration which can be given. Mr. Cassandra asked how much time was needed for an answer and Mr. Cheney replied he could give it at the next Council meeting. At this time, Mr. deLong moved to dispense with the regular order of business and move to the Public Hearing. Mr. Zimmerman seconded and the motion carried 5-0. Mayor Warnke advised that he talked to Mr. Cheney and Mr. Vance about this and in the future, the public hearing will be adver- tised at 8 o'clock or as soon thereafter as the agenda permits. PUBLIC HEARING Proposed ordinance which places a moratorium on the issuance of building permits, subdivision plats, master plans, planned unit developments and rezonings in the designated Community Redevelopment Area Mr. Annunziato stated as noted in his recommendation, the Planning & Zoning Board reviewed this ordinance and their responsibility was to make a finding of consistency with the adopted comprehensive plan. The Board did conduct a public hearing on this proposed moratorium ordinance. At that time, he explained the ordinance in detail. The Board did make a unanimous finding of consistency with the comprehen- sive plan and further enhances the ability to implement the downtown redevelopment plan. - 4 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Mayor Warnke ascertained nobody wished to speak either in favor or in opposition to this proposed ordinance and then declared the public hearing closed. Approve request for annexation of Lake Worth Christian School submitted by George Kibben, President, Board of Trustees. This proposal provides for annexation of a 10.13 acre site which is currently developed. The existing faci- lities include a school and ancillary recreation. Also included is a request by staff to annex rights-of-way for High Ridge Road. Location: The South 1/2 of the North 1/2 of the Northwest Northwest 1/4 of the Southwest 1/4 of Section 9, Township 45 South, Range 43 East, excepting there from the right-of-way of the Seaboard Air Railway, and also excepting from the West half of the foregoing premises the South 10 feet thereof as conveyed in Deed Book 947, Page 23, of the Public Records of Palm Beach County. Also to be annexed is the right-of-way for High Ridge Road described as a 50 ft. right-of-way in Sections 8 and 9, Township 45 South, Range 43 east, lying 25 feet on each side of the Section line betWeen Sections 8 and 9, extending northerly on the Section line for 489.63 feet from a point on the Section line a distance of 1819.64 feet from the Southeast corner of Section 8. A 40 ft. strip of land adjacent to the east line of Section 17, Township 45 South, Range 43 East, extending southerly from the north line of Section 17 a distance of 1311.10 feet as measured along the east line of Section 17. Mr. Larry Kooi, Principal of Lake Worth Christian School, told about serving students in the area and stated they would like to be a part of Boynton Beach. Mayor Warnke ascertained there were no further speakers in reference to this request and declared the public hearing closed. Mr. deLong moved to accept the recommendation of the Planning & Zoning Board and instruct the City Attorney to draft the appropriate ordinance. Mr. Zimmerman seconded the motion. No discussion. Motion carried 5-0. - 5 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Approve request for amendment to the Land Use Element and Rezoning for Lake Worth Christian School submitted by George Kibben, President, Board of Trustees. The Lake Worth Christian School is located at 7592 High Ridge Road. The request is to show the 10.13 acre tract of land as Low Density Residential on the Future Land Use Element of the Comprehensive Plan and to rezone from RS Single Family Residential (Palm Beach County) to R1AA Single Family Residential (Boynton Beach). Mayor Warnke ascertained nobody in the audience wished to speak in favor or in opposition to this requested amendment and declared the public hearing closed. Mr. deLong moved to approve the recommendation of the Planning & Zoning Board, seconded by Mr. Wright. Motion carried 5-0. Approve request for conditional use to operate the Woolbright Children's Day Care and Private School at 204 S.E. 22nd Avenue submitted by David M. Selby. The property in question is Lot 45, Crestview Subdivision, which is occupied by a 2,685 sq. ft. single family house. The lot size is 10,500 sq. ft. Mr. Annunziato informed the Council the Planning & Zoning Board conducted a public hearing and made the unanimous recommendation that this application be denied. He told how the Board members decided there was just not enough site for the uses proposed with giving consideration to parking lot variances requested. Consideration was also given to the existing zoning in the area, traffic noise and congestion. The applicant did not appear before the Community Appearance Board last night and this was tabled. Mr. Wright asked if there was much citizen input at the Planning & Zoning Board meeting and Mr. Annunziato replied negatively as only one person spoke in objection. Mayor Warnke asked if anybody in the audience wished to speak in favor of this request for conditional use and received no response. He asked if anyone wished to speak in opposition to this request and received no response. He asked if the applicant was present and received no response. The public hearing was then declared closed. Councilman deLong referred to attending the Planning & Zoning Board meeting and stated he believes the members had good and sufficient reason to deny this and moved to deny this request. Mr. Wright seconded and the motion carried 5-0. Mr. Wright moved to revert to the regular order of business. Mr. deLong seconded and the motion carried 5-0. - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 PUBLIC AUDIENCE (Continued) Col. Marty Trauger stated he would like to invite the Council's attention to the potential economic opportunity in Boynton Beach being to have the Veterans, Administration build a hospital in this area. He thinks Boynton Beach should make a concerted effort to get this. He then read an article from the Sun Sentinel in reference to plans for the proposed hospital to locate somewhere in the county. He further emphasized the importance of having the hospital located in this area. Mr. deLong moved to refer this to the City Manager and Planning & Zoning Board for some input as to the exact consequences and the drain which would be on our local facilities. Col. Trauger clarified that this would not necessarily be within the city limits. Mr. deLong changed his motion to notify our Representatives Lewis and Mica and Senators Chiles and Hawkins to see this is located in Palm Beach County. Councilman Wright seconded the motion. Under discussion, Mr. Wright told about attending a meeting when this hospital was discussed and advised another city is actively seeking this hospital. He thinks we stand a chance of getting this hospital and should move in that direction. After further discussion regarding the location, Mayor Warnke clarified that the motion is to refer this to the City Manager and Planning Department to come up with ideas to forward to the appropriate government represen- tatives. Councilman deLong clarified that the composition of the resolution will be left up to them Motion carried 5-0. · Mr. Jim O'Meara stated on behalf of the Christian Fellowship Organization, the City has been kind enough to issue a proclamation and he extended his thanks. Mayor Warnke pre- sented him with the proclamation. CONSENT AGENDA A. Bids Three (3) New 1000 Gallon Underground Petroleum Storage Tanks and Three (3) New Commercial Pumps - Golf Course The Tabulation Committee recommends awarding the bid to Glasgow Equipment Service, Inc., in the amount of $14,942. B. Request for Zoning Approval for Alcoholic Beverage License - Wagon Wheel, 511 N.E. 4th Street The Deputy Building Official noted zoning at this address permits the sale of beer and wine for consumption on premi- ses and package sales of beer and wine. - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Ce Approve request for the use of two trailers, one con- struction office trailer & one electrical material storage trailer in conjunction with the construction of the High-Ridge Convalescence Center Mr. Thomas Ivone, Construction Manager of McHoye Construction Corporation has requested permission for the use of these two trailers. Dt Approve request for use of one (1) temporary trailer in conjunction with the mall out-parcel located on Congress Avenue & Old Boynton Road and to be used as a temporary banking facility until construction of new facility is completed. (approximately three (3) years) Mr. Casimir L. Kuzmirek, Property Manager representing First Federal Savings & Loan Association of Lake Worth, submitted this request. E. Approval of Boynton Beach Elks Lodge No. 2676 to use Jaycee Park for Craft Bazaar - December 10, 1983 This item was deleted by the City Manager. F. List of payments - Month of October, 1983 See list attached. Gm Approve Delray Beach Garden Club request for placement of ground signs on Seacrest Blvd. - December 3, 1983 The Deputy Building Official noted this request may be per- mitted under the Sign Ordinance, Sec. 21-16(c)(2). H. Approve Change Order No. 6 - Extra Work Items - Golf Cours~ A change order in the amount of $3,834 was submitted by Daniel O'Connell, General Contractor, and approved by Mr. Howell. Approve purchase of meter registers from Neptune Meters Utilities Mr. Sullivan submitted a memo dated November 10, 1983, recommending taking advantage of this sale. J. Approval of Bills See list attached with one addition. - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 K. Approval of Cemetery Refund Ms. Lou Ann Klein submitted a request for refund on Lot 479A, Block S. Councilman deLong moved to approve the Consent Agenda as recommended by the City Manager with the additions and dele- tion of Item E. Vice Mayor Zimmerman seconded the motion. Under discussion, Councilman Cassandra referred to the new petroleum storage tanks for the~golf course and asked if there is only one maintenance building and Mr. Cheney replied that there are two. Mr. Cassandra questioned why three pumps are needed and Mr. Cheney explained that pumps were needed for both diesel and regular gas. Mr. Cassandra referred to not receiving much information on the change order requested for the golf course and Mr. Cheney explained this change relating to electricity changes in the shelter building. Mr. Cassandra referred to changing the septic tank lids and questioned why this wasn't considered in the original design and Mr. Howell explained how smaller septic tanks were originally specified and this became necessary with the carts going over them. Motion carried 5-0. BIDS NONE DEVELOPMENT PLANS Approve request to construct 240, two-story garden apart- ments plus recreation facilities on Tract H and private park site at Meadows 300 PUD. This request was submitted by Julian Bryan for C & H Properties, Inc. and the location is Meadows Way at Meadows Blvd. Mr. Cannon informed the Council this comes with a positive recommendation for approval by the Planning & Zoning Board subject to staff comments. It was approved by the Community Appearance Board subject to providing further details. He outlined the site plan. He then read the staff comments from the Building Department, Fire Department, Engineering Department, and Public Works Department. Councilman deLong moved to accept the unanimous recommen- dation of the Planning & Zoning Board and approve this with the staff comments, seconded by Councilman Cassandra. No discussion. Motion carried 5-0. Approve request for site development plan approval to construct four permanent entry signs and two temporary announcement signs. This request was submitted by Julian Bryan for C & H Properties, Inc. and is located on the west side of Congress Avenue between Hypoluxo Road & LWDD ~18 - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Mr. Cannon stated this comes to the City Council with a positive unanimous recommendation from the Planning & Zoning Board. He read the staff comments from the Utilities Director. He explained the signs planned and pointed out the location. Mr. Cassandra referred to the Community Appearance Board noting comments regarding landscaping when reviewing this plan and Mr. deLong replied that we move on the recommen- dation of the Planning & Zoning Board. The applicant came forward and advised that he concurred with the Community Appearance Board's comments. Councilman deLong moved to accept the unanimous recommen- dation of the Planning & Zoning Board subject to staff com- ments, seconded by Councilman Cassandra. No discussion. Motion carried 5-0. Approve request for site development plan approval to construct 208,490 square feet of industrial warehousing with ancillary office facilities on parcels 3D, 3E, and 3F of Boynton Commerce Center. This request was submitted by Iraj Montazedi Mr. Cannon informed the Council this site plan comes with a positive unanimous recommendation for approval by the Planning & Zoning Board subject to staff comments. It was reviewed by the Community Appearance Board and approved sub- ject to the applicant providing a more detailed plant list and replacing those trees which will be eliminated. He showed the site plan. The plat and subdivision development plans were previously approved by the City Council. He explained the size and location of the buildings. He read the staff comments from the Building Department and Engineering Department. Mayor Warnke questioned the location of the main entrance and Mr. Cannon advised it will be from Woolbright Road. Mr. Cheney added that one of the conditions mentioned was a spe- cial inspector will be required. He explained that a cer- tified inspector was now required on certain developments to comply with state law and it is anticipated it will be an inspector paid for by the developer on contract to us. Mr. Cassandra referred to this permit being issued many months ago and stated they got approval to bulldoze quite a bit. He still feels a permit which has been issued by the City and exceeds a certain amount of time should be required to have the plans resubmitted. There should be limitations considered for permits and not run forever. Mayor Warnke informed him the Community Appearance Board previously - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 approved the removal of these trees and it was covered under a previous permit. Mr. Annunziato told about the history of this master plan. He added the lot clearing permit was recently issued consistent with the tree preservation code. There is no requirement to keep trees which have to be removed for construction of streets, buildings, etc. Mr. Cassandra clarified that his concern is any permit outstanding for a period of time should be reviewed at today's standards. Mr. Cheney added that the trees on this site had to be removed for the building plans. Consideration will be given regarding how long a permit should last. Mr. deLong moved to approve the unanimous recommendation of the Planning & Zoning Board subject to staff comments, seconded by Mr. Wright. Motion carried 5-0. Approve request for site development plan to construct the Pyramis Professional Plaza submitted by Digby Bridges & Associates. The Pyramis Professional Plaza is a 30,978 sq. ft. office building located on Seacrest Boulevard between S.W. 23rd and S.W. 25th Avenues, on the west side. Mr. Cannon stated this comes to the City Council with a una- nimous positive recommendation of the Planning & Zoning Board subject to staff comments. It was also recommended that a buffer wall be constructed at the rear property line in lieu of a hedge. The Planning & Zoning Board also recom- mended the height exception be approved for the elevator penthouse and mechanical equipment. He showed the site plan and explained the location. He read the staff comments from the Building Department, Fire Department, Utility Department, Engineering Department, and Planning Department. The Community Appearance Board also reviewed this site plan and approved the landscaping. Mr. Zimmerman referred to the Council approving the height exception and Mr. Annunziato informed him the code provides for mechanical equipment or an elevator penthouse to exceed the district height regulation. What the applicant requested was a parapet wall surrounding the roof which gives the impression of a taller building, but screens the mechanical equipment. The Planning & Zoning Board and Community Appearance Board believe this should be addressed. What the applicant is asking is not for a height exception for a parapet wall as it must come down, but a height excep- tion for mechanical equipment only. Mr. Cassandra asked how close the building would be to 23rd Avenue and Mr. Annunziato informed him it would be 140 feet from the intersection. Mr. Cassandra referred to there not - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 being a right hand turn lane and Mr. Annunziato replied this dedication could be required by the City Council. Mr. Digby Bridges came before the Council then and explained how they felt a parapet wall would be better architectural design to hide the unattractive airconditioning equipment. He feels the code should be changed and the height of the building should be to the flat level of the roof. Mr. Cheney added that in most codes, a parapet is an accepted exception, but is not included in our code. That can be addressed by the Board and is not an issue before the Council. Mr. deLong moved to accept the unanimous recommendation of the Planning & Zoning Board and to grant the height excep- tion pursuant to Section 4F of the zoning code and subject to staff comments. Under discussion, Mayor Warnke stated it is the opinion from Mr. Vance and Mr. Cheney that when the redevelopment plan is approved, this would take effect and Mr. Cheney clarified that when the redevelopment plan is approved, expected future expenditures REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 for public activities will be fairly clear because the plan will identify street improvements, utility improvements, public park and public area improvements, or other public activities as necessary to bring about and support expected private investment. Also, if this is approved in the month of December, the T.I.F. procedure is started by the Assessor,s office, so a year from now in November when the tax proceeds are received the increment will go to the agency. ' Mr. Cheney referred to the question raised at the last meeting of how to know what the funds are used for and that is when the plan is adopted, which should be early in 1984 It is suggested to start the process now so the year is not lost. ' Mayor Warnke commented that if we do not do this, our tax base will probably stay the same. If we go ahead with this, the taxes will probably rise and the benefits will go to the Community Redevelopment Agency. Councilman deLong told about information he gained in his own research and moved that we put this on the ballot as a straw vote to get the feeling of the people. If it is una- nimous or overwhelming, we can appeal to the legislature to submit a special act. Councilman Cassandra seconded the motion. Under discussion, Mr. deLong ~added that the City Manager will take care of this. Also, even though it is a straw ballot, it would exclude any pockets in the City. Mr. Cheney replied that some language will be prepared with a map identifying the area. He will try to have this for the next Council meeting. It will be in the form of an ordi- nance. No discussion. Motion carried 5-0. Approve contract to update City's Comprehensive Plan Mr. Vance advised that he has reviewed the form of the contract and it is acceptable. Mr. Wright referred to initially recommending that an addi- tional planner be hired to take care of this responsibility and questioned the recommendation to hire a consulting firm - 19 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 and Mr. Annunziato replied that when he prepared the budget memo, he pointed out the requirement to update the compre- hensive plan. This is required to be done by August 4. By hiring someone now, it would not be appropriate to train him and meet the deadline. We have an experienced consulting firm. They have the ability and capability to do the work. He recommends contracting with them. Mr. Wright referred to options and broadening the prospec- tives to address the year 2000 or further with considering capital improvements, etc. Mr. Cheney advised that a staff presentation will be made relative to the capital improve- ments program. Also, to pay a consultant to study the issue of a high school in Boynton Beach would be very expensive and this is an issue for the Council and citizens. Mr. Cassandra referred to having an adversion to consultants' fees because he feels we have some of the best people working in this City. The City Manager has given good reasons for this contract, but he Ks not in agreement. This is a modification and update of the comprehensive plan and he feels the city staff is more knowledgeable about this than any consultants. Mr. deLong agreed that mainly con- sultants gather the information from the city employees and then submit a report. Mr. Cassandra agreed and read clauses from the contract regarding consultations with the city staff. Councilman deLong clarified that the question is can the staff handle this and if not, why not? Councilman Cassandra replied that his personal opinion is that our staff can handle this and save $32,000. Mr. Annunziato responded that as part of the budget preparation, he explained the respon- sibilities and projects on-going in the Planning Department with Mr. Cannon being responsible to move forward with the new zoning ordinance which is a fulltime job. His problem is it does not appear they will have the staff time to do the work with the comprehensive plan update and that is the basis for his recommendation for the consultant. Mr. deLong stated that he thinks this should be done by our own staff. Mr. Wright asked if comparable cities hire consultants and Mr. Annunziato replied that most cities our size did and continue to consult out the comprehensive plan. The cost in 1978 for the comprehensive plan was $35,000 plus an addi- tional $2,000 to $3,000 for Russell & Axon. Mr. Cassandra clarified that $38,000 was spent to invent the plan and now $32,000 is being requested to update it. He does not feel this expense is warranted. Mr. Wright referred to changes being made in the next session of the legislature and explained how terms for - 20 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 approval of plans would be more stringent. He thinks we should go with a consultant this last time to be sure to remain abreast of current legislation and avoid problems down the road. Mr. deLong replied that if it is done in- house, he doesn't think there is any question about approval. Mr. Zimmerman questioned the money available for this and Mr. Cheney explained the possibility of using general reve- nue sharing money. Mr. Cheney clarified that there is no question the staff is capable of doing this, but explained the work load of the Planning Department and how day-to-day activities could not be put off, plus training time was required for new person- nel. The advantages of WRT is they know us and the plan. We will provide information, but time will be needed to com- pile the report. If the Council chooses not to go the con- sultant route, it can be done in-house; but we cannot update the comprehensive plan and continue rewriting the zoning ordinance in the next ten months. We do have the ability, but we will have to give up something. The staff is limited in the whole city. Mr. Cassandra stated that obviously the Planning Department has been noting areas which they feel should be changed and Mr. Annunziato agreed this is an on-going process. He doesn't think changes in districts or zoning classifications in the comprehensive plan are anticipated. He explained how the zoning codes would coincide with the comprehensive plan. Mr. Wright moved to accept the recommendation of the City Manager and the additional comments that he and the Director of Planning have given tonight regarding problems of staff time and the consultants would be of better assistance to them. Mayor Warnke clarified that his motion is to accept the contract of WRT. He ascertained there was no second to this motion. Mr. Cassandra moved to have our city staff put their effort into the comprehensive plan and reset their priority requirements to get the comprehensive plan completed. Mr. deLong seconded the motion. Under discussion, Mr. Wright referred to there being a lot of work involved in this and stated if the staff is going to do it, he feels another planner should be employed. Mr. deLong replied that he didn't think that was needed and they only needed some assistance. Mr. Cheney added that there are times when trying to get a project done, a person is in the way. Possibly they may request some temporary money for edi- torial assistance. Mr. Cassandra referred to tabling this - 21 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 and Mr. Cheney disagreed as it has been made clear not to have the consultants. The priorities can be changed and a schedule will be worked out. Mayor Warnke clarified that the motion is to refer the comprehensive plan to our City Planners even though it may mean changing priorities in future work and have this done in-house. Councilman Cassandra - Aye Councilman deLong - Aye Councilman Wright - Nay Mayor Warnke - Aye Vice Mayor Zimmerman - Aye OLD BUSINESS Discuss Election Law revisions and review redrafted ordi- nances Mayor Warnke referred to the City Attorney submitting a review and recommendations and stated in 1985, the present laws on the elections in 1984 would not continue for two years and Mr. Vance agreed stating the 1984 election will be held under the existing ordinances and charter provisions. He added those candidates elected in 1984 will serve a full two year term. Mayor Warnke referred to the Vice Mayor elected in 1984 becoming Mayor in 1985 and Mr. Cassandra stated the Vice Mayor would have a one year term and stay as a Councilman the next year of his term. Vice Mayor Zimmerman suggested setting up district divisions to see how this fits in and Mr. Vance agreed before drafting the final version, new districts must be designated. Mr. Cassandra referred to the possibility of the mayor-elect leaving before his term is over and questioned how his replacement would be chosen and Mayor Warnke replied that the Vice Mayor would take over and the Council would make an appointment. Mr. Vance agreed and added some clarification is needed before finalization. There was discussion regarding the limit of terms and Mr. Vance clarified that this would become effective after each term expires after the 1984 election. Mr. Cassandra clarified that the Council agreed the term should be two years, agreed with the residential require- ments, agreed to go with House Bill 742, and agreed to four districts. - 22 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Mayor Warnke stated he believes those elected in 1984 should be allowed to serve under the laws existing in 1984 and that means the Mayor could not be elected in 1985. Mr. Vance stated that a decision must be made on the present method of electing the Vice Mayor. After further discussion, Councilman Cassandra moved to accept the language for the residential requirement, four districts, mayor at large, two year terms, and the question of Mayor and Vice Mayor be spelled out, so the man running in 1984 will be running only for that year as Vice Mayor with the new concept of Mayor to occur in 1985. Mr. Vance suggested a new concept of choosing the Vice Mayor as it is exceedingly awkward with the Mayor being elected at large. Mr. Cassandra requested that he submit a suggestion for the Council's consideration. Mr. Wright clarified that it would be two year terms with an indefinite number of terms and Mr. Cassandra agreed there would be no limitation on the number of terms. Mr. Wright then seconded the motion. Under discussion, Mayor Warnke clarified this was just being approved in concept. Mr. Vance added that he is going to revise the method of choosing the Vice Mayor and will draw four districts on the map. Mr. Cheney advised the Planning Department prepared the original 'district map and asked if they wanted the Planning Department to do the same thing and Mr. deLong replied affirmatively. Motion carried 5-0. NEW BUSINESS Communication from Motorola re: Unitary Tax Councilman Wright referred to there being controversy about this legislation and stated the League of Cities will be addressing this in a few months. He moved to have the City Manager in conjunction with the City Attorney bring back additional information on this legislation for us to take a position on this. Councilman deLong seconded the motion. Under discussion, Mayor Warnke advised the Executive Board of the Municipal League asked him to contact Motorola and he presented the letter at the last Municipal League meeting, but they did not take any action. Also, the Governor is appointing a special committee to look into this situation. Large corporations seem to oppose it, but do not want to take away from education. Mr. Cheney commented that he has some general ideas about this unitary tax, but does not think he should spend the time studying it and what impact it will have. This is a political issue. Mayor Warnke agreed that he did not think it is a City Council issue, but should be taken out on a unified front by the League of cities. - 23 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1983 Mr. deLong withdrew his second and Mr. Wright withdrew his motion. It was agreed the League of Cities should find out more about this issue first. Replacement for Representative on the Community Action Board Councilman Wright referred to the City having an official seat on the Community Action Board and advised that Mr. Carnell Johnson was appointed to serve, but he has expressed interest in not continuing. Mr. Johnson has not attended meetings for about a year which affects the quorum. Mr. deLong suggested putting this on the agenda for the next meeting so names can be submitted. Mr. Cheney stated this Board is an advisory body to the Community Action Council. Mr. Wright added that an alternate member is needed also. Other Mr. Zimmerman requested that the one ordinance be put on the agenda for the next meeting which was Submitted pertaining to election law changes not needing a referendum vote for first reading. Mayor Warnke referred to there being a resignation on the Golf Course Committee and Mr. Cheney advised this was a county member and he did request Commissioner Wilken to make a re-appointment. ADMINISTRATIVE Consider appointing one member to Boynton Beach Housing Authority (Tabled) Mayor Warnke advised that he talked to Mr. Delaney and they do not have a recommendation. Futura Printing Letter Councilman deLong commented that he is inclined to believe weshould giVe FUtu~a Prin~ing's letter s~omeconsidera~ion. Mayor Warnke agreed that he would like to give our printing to local people. Councilman Wright agreed he would like to give priority to local people and thinks we should have exceptions for community based projects, such as the GALA, Black Awareness Program, etc. Mr. deLong moved to rescind the motion of January 4, 1983, to leave this to the discretion of the City Manager and Purchasing Agent. As requested, Mrs. Boroni took a roll call vote on the motion as follows: Councilman deLong - Aye Councilman Wright - Aye Mayor Warnke - Aye Vice Mayor Zimmerman - Aye Councilman Cassandra - Aye Motion carried 5-0. Mr. deLong moved for Mr. Cheney and Mr. Steinmetz to get together to work out some sort of arrangement, seconded by Mr. Wright and he added that it should be suitable to both sides. Under discussion, Mr. deLong clarified that he was talking about local printers. Mayor Warnke asked if he meant restricting it to local people and Mr. deLong replied he would give them the edge if possible. He suggests that we try it for a year and make a comparison of cost. He is asking that Mr. Cheney set up a procedure where local men would be given preference. Mr. Wright stated that the City Manager should meet with others and not only Bob Steinmetz and Mr. deLong agreed with all local printers. Mr. Cassandra referred to there possibly being a large percen- tage of savings throughout the year and clarified that we want to give to locals where only a few dollars are involved. Mayor Warnke advised that five local printers could bid and Mr. deLong agreed they should be given a try. Mr. Cassandra asked if he meant to award to local bidders regardless of the amount and Mr. deLong replied if a local business cannot handle it, then the City Manager can come back to the City Council for further direction. As requested, Mrs. Boroni took a roll call vote: Councilman Wright - Aye Mayor Warnke - Aye Vice Mayor Zimmerman - Aye Councilman Cassandra - Aye Councilman deLong - Aye Motion carried 5-0.
