Minutes 12-04-84MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, DECEMBER 4, 1984 PRESENT Carl Zimmerman, Mayor Robert Ferrell, Vice Mayor Nick Cassandra, Councilman James R. Warnke, Councilman Samuel L. Wright, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W. Vance, City Attorney Mayor Zimmerman called the meeting to order at 7:30 P. M. He corrected the date on the agenda to December 4, 1984. He announced the Invocation tonight will be by Rev. Joseph Dye, Boynton Beach Congregational United Church of Christ, and requested everyone to remain standing for the Pledge of Allegiance to the Flag led by Councilman Nick Cassandra. AGENDA APPROVAL Mr. Cheney requested the addition of two items under Legal - Other. The first item relates to the lease the City now has with the Boynton Beach Child Care Center and the second relates to the union contract with the Fire Department. Vice Mayor Ferrell moved to adopt the agenda with these addi- tions, seconded by Councilman Cassandra. No discussion. Motion carried 5-0. ANNOUNCEMENTS Mr. Cheney announced that City Hall will be closed Monday, December 24th, and Tuesday, December 25th, in observance of Christmas. Mr. Cheney announced the sanitation schedule will be changed over the Christmas and New Year's holidays and copies of those changes are available in the back of the room and will be published in the newspaper. MINUTES Regular City Council Meeting Minutes of November 20, 1984 Vice Mayor Ferrell made a motion to accept the minutes, seconded by Councilman Cassandra. Motion carried 5-0. CITY MANAGER'S REPORT Christmas Parade Mr. Cheney thanked those involved from the Chamber of Commerce and City for their help in the Christmas Parade on Sunday. He was told there was a good crowd of people along the route and about 30,000 people attended. The people enjoyed it very much. Removal of Sand at Palm Beach Inlet Mr. Cheney reported that a meeting was held this afternoon in the chambers sponsored by Rep. Messersmith's office having to do with the Corps of Engineers taking sand out of the inlet at the Palm Beach port. It has gone from a 35' to 13' depth. He was not able to attend the meeting. Seminar on Industrial Revenue Bonds Mr. Cheney announced on Thursday morning, the City Industrial Revenue Bond Committee and the Chamber of Commerce are sponsoring a seminar on industrial revenue bonds. Legislation has changed this and the new regula- tions, etc. will be discussed at this seminar to be held at the civic center. Pursuit of Excellence Program Mr. Cheney told about our Personnel Director and the Personnel Director of Palm Beach becoming aware of a Pursuit of Excellence Program tailored to some extent to the public sector. He told about a one day seminar being planned for department heads and their assistants to see how it works. He will give a report as we want to see how it works out in government. CONSENT AGENDA A. Proposed Resolution No. 84-NNNN - Re: Final Plat, Quail Lake West A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, APPROVING THE FINAL PLAT FOR QUAIL LAKE WEST IN SECTION 31, TOWNSHIP 45 SOUTH, RANGE 43 EAST Approve Change Order No. 4 - Raw Water Supply Wells 17-22 - R & A Project No. 00622-G (626~681-60) This change order was submitted by Alsay-Pippin Corporation and will increase the amount of the subject contract by $1,296, adjusting the total contract amount to $767,784.21. De Mr. Leonard O. Eskey, Project Manager for Cantania Development Corp., requests City Council permission for the placement of one (1) office construction trailer in conjunction with the building of Quail Lake West homes located at Congress Avenue & S.W. 23rd Avenue In accordance with Chapter 25, Section 25.7 of the City of Boynton Beach Codes of Ordinance, the Building Department recommends approval. The trailer will remain for the dura- tion of the project. Em Approve replacement of 600' of 8" water line on Seacrest Blvd. at North 22nd Avenue - Project is needed prior to intersection improvements by the County The Director of Utilities recommended approval with funds to be allocated from the Utility Reserve Fund. Mr. Cheney referred to the traffic signal being installed at Seacrest Blvd. and 22nd Avenue and stated some improvements will also be made and before that, utility relocations have to take place. This takes care of that, so the intersection can be improved. F. Approval of Golf Course Fees for winter season Mr. Cheney referred to reports and surveys being submitted and stated he has had some calls about the fees being too high, but explained how these fees are competitive to other courses, close to what was projected in the budget adopted, and related to making the course self-supporting. - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 for their willingness to construct a sidewalk along the entire frontage. They feel they can dedicate 15' from the front of the building northward to Boynton Beach Boulevard to accommodate three lanes of traffic and the sidewalk. Going south, it would have to go into 40'. Councilman Cassandra stated he made the motion for con- tinuance because he felt they wanted to discuss an amicable solution with:the Planning Director, but he feels there has been very little change. They still have not met the code requirements. Mr. Phil Ferrari, Staff Architect, stated they did meet with Mr. Annunziato this afternoon and wanted to come to a solu- tion. He feels they are close. It is either 50 feet or do it the way they want to do it. From Boynton Beach Boulevard to the driveway, they are willing to give 15 feet, which would include three lanes of traffic and a sidewalk and this is where most of the traffic will be. From that point on, they feel i0 feet is adequate for the pavement and sidewalk. The postal service will serve the public whether in the city or county, but they would like to be in the City of Boynton Beach because the cost of utilities is lower; but if they have to spend additional money to redesign the building and move it, they have lost the benefit of the cost of utilities. Mayor Zimmerman commented that he believes the south end of the road would be used as much as the north end and Mr. Ferrari replied that the street deadends into the back of the school. Mr. Cheney clarified that the public street deadends into the school, but there is a private, well-used road going out to Congress'Avenue. Mayor Zimmerman added that many peoPle use it now and if the post office is built, it will increase usage of that private road. Mr. Ferrari referred to reaching an amicable solution, which means give and take on both sides and Mr. Cheney responded that when the post office decided to buy the property, the city requirements were 50 feet and they should have done their planning to address this requirement. If the right- of-way requirements were changed in the middle, it would have been different. Mr. Ferrari explained the federal government's procedure for purchasing property. Mr. Cheney clarified that there is space on Chis property to put the building and parking lot to meet our standards which were on the books before the property was purchased. The land was purchased with certain development standards. Mr. Ferrari stated he was asking the City Council to negotiate with them and come to a fair solution for both sides and Mayor - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 Zimmerman replied that he didn't think the minimum code should be negotiated. Councilman Cassandra explained that actually redesign of the building was not involved, but removal of the muck to shift the location of the building. Comments were made about many developers having to remove muck in order to build. Mr. Ferrari stated the City of Boynton Beach asked them to apply for annexation. They thought because of that, the city would work with them, but apparently the city is not agreeable to do that. Mayor Zimmerman stated the standard minimum codes must be obeyed. Mr. Ferrari understood this, but his position was to negotiate and reach a solution to save the postal service money. Mayor Zimmerman asked if anyone in the audience wished to speak in favor of this particular annexation and rezoning and received no response. He asked if anyone wished to speak in opposition and received no response. Councilman Warnke asked what the county requirements for the road would be and Mr. Annunziato replied that he discussed this with Mr. Walker today and the county will grant a per- mit with three lanes of construction, but will not accept it for maintenance. It would have to be a minimum of 50 feet for county maintenance. They would grant a permit to access Boynton Beach Boulevard, but it would be treated as a pri- vate drive. It is a publicly dedicated right-of-way, but neither the county nor the city have accepted it for maintenance. Councilman Warnke referred to the contents of the letter submitted by the Postal Service and stated he feels they should be allowed to do what they want and stay in the county. Mayor Zimmerman asked if the matter of sovereign immunity was clearcut and Mr. Vance replied that he has no doubt if the federal government wishes to construct a military installation, they can do it, but the post office is an independent agency. He doesn't know if it is the same situation. He cannot give a definitive answer. Mr. Cheney stated before taking final action, the descrip- tion of the annexation includes some peripheral rights-of- way to be annexed to the city. If the post office site is not going to be annexed, he would like to rewrite the annexation ordinance to annex those rights-of-way, since it has been advertised. We would like to simply redo the - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 description on the annexation eliminating the post office, if the Council desires. Mr. Annunziato clarified that these include the 30' right-of-way behind the shopping center, Boynton Beach Boulevard westward to Knuth Road and the west half of Knuth Road. Mr. Vance requested the Council to direct the redraft of this annexation ordinance to the rights-of-way only eliminating the post office property. Mr. Vance asked who owns the right-of-way at the present time behind the shopping center and Mr. Annunziato replied that he suspects it initially was in the county, but the county has not accepted it for maintenance and it is a public right-of-way. Councilman Cassandra moved not to approve the request of annexation of the postal department and direct the City Attorney or staff to rewrite the annexation for the rights- of-way. Mr. Vance suggested eXcluding or eliminating the post office property from the description of the property to be annexed and Councilman Cassandra agreed. Vice Mayor Ferrell seconded and the motion carried 5-0. LEGAL Ordinances - 2nd Reading - Public Hearing Proposed Ordinance No. 84-46 - Re: CRA Moratorium Extended Mr. Vance read proposed Ordinance No. 84-46 by title: AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 83-40 BY EXTENDING A TEMPORARY MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION OR ALTERATION OF BUILDINGS AND STRUCTURES WITHIN THE DOWNTOWN BUSINESS DISTRICT OF THE CITY; PROVIDING FOR AUTOMATIC REPEAL; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mayor Zimmerman received no response when he asked if anyone wanted to speak in favor or opposition to this ordinance and then closed the public hearing. Mr. Cheney explained the tentative schedule for adoption of the community redeve%opment ordinances and suggested possibly indicating this ordinance is effective with the moratorium ending on April 2. He figured this proposed ordinance would fall about a month less than the schedule and another extension would be necessary. Mr. Vance - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 referred to the schedules fluctuating and suggested it might be simpler to adopt this ordinance and if another extension is needed, then pass another ordinance. Councilman Warnke moved that proposed Ordinance No. 84-~46 be approved on second and final reading, seconded by Councilman Wright. No discussion. Mrs. Boroni took a roll call vote on the motion as follows: Councilman Wright - Aye Mayor Zimmerman - Aye Vice Mayor Ferrell - Aye Councilman Cassandra - Aye Councilman Warnke - Aye Motion carried 5-0. Ordinances - 1st Readinq Proposed Ordinance No. 84-47 - Re: Amendment to Zoning Code - Family Definition (Tabled) Councilman Cassandra moved to remove from the table, seconded by Councilman Warnke. Motion carried 5-0. Mr. Vance read proposed Ordinance No. 84-47 by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING APPENDIX A - ZONING, SECTION !. DEFINITION OF TERMS. TO AMEND THE DEFINITION OF FAMILY TO CLARIFY THE SAME; PROVIDING THAT EACH AND EVERY OTHER DEFINITION CONTAINED IN SECTION 1 OF SAID ZONING CODE REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING AUTHORITY TO CODIFY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mayor Zimmerman stated a couple of people had requested to speak on this. Mrs. Dee Zibelli, 440 Ocean Parkway, stated she thinks the concept of the ordinance is fine, but questions how it is going to be enforced. She explained how she could not see any probable way to enforce it. Councilman Warnke replied that we are trying to bring this ordinance into compliance with a supreme court ruling. It relaxes what we have on the books. The intent is not to look for violations, but if a violation comes up, then we have a legal ordinance on the books to back up the enforcement. - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 Councilman Cassandra referred to step 2 being enforcement and stated our code book has the word family throughout and we have been told the present definition is illegal. Regardless of implementation, the correct definition should be included. He explained how family was stated throughout the zoning section of the code. Mrs. Marjorie Ochstein, 636 N. E. 8th Avenue, stated she thinks the definition of family seems to be a little narrow. She thinks our whole society's view of what a family is is changing. She doesn't think it can be said that a family is only people who are related. Councilman Cassandra replied that the definition includes more and read the proposed definition. Mrs. Ochstein asked if the ordinance limits the number of people and Councilman Cassandra replied negatively as there could be twenty children, but no more than two unrelated. Councilman Warnke moved to approve Ordinance No. 84-47 on first reading, seconded by Councilman Cassandra. Under discussion, Mr. Vance clarified that we have a U. S. Supreme Court case which upheld this particular proposition, but there can be attacks based on the state constitution. Councilman Wright questioned how this compares with other cities and Mr. Vance replied that he has not done a survey of other cities, but consulted the case books. Councilman Wright expressed his concern about limiting the number of foster children and suggested possibly revising it to stipu- late age and Mr. Vance replied that he thought that would be a problem and the only logical way to revise it would be to increase the number from two, which is the minimum. Councilman Wright stated he will check on the average size of foster homes in the county as he is concerned about disadvantaged youth. Councilman Warnke suggested possibly there could be guidelines to cover foster homes. Councilman Cassandra referred to the staff reviewing this and stated they have recommended this definition. Mrs. Boroni then took a roll call vote on the motion as follows: Mayor Zimmerman - Aye Vice Mayor Ferrell - Aye Councilman Cassandra - Aye Councilman Warnke - Aye Councilman Wright - Nay Motion carried 4-1. - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 Councilman Wright told about hearing remarks about the course not being up to par and Mr. Cheney replied that he thinks our course is more up to par than any other municipal course and he requested that specifics be obtained with such remarks. Councilman Wright advised that he told this person to contact Joe Sciortino. Mr. Cheney reviewed the fees. G. Approval of Bills See list attached. Councilman Cassandra moved to accept Consent Agenda Items A, B, C, D, E, F, and G. Councilman Warnke seconded. No discussion. Motion carried 5-0. BIDS NONE In view of the time, Councilman Warnke moved to bypass the Public Hearing and return to it at 8:00. Vice Mayor Ferrell seconded and the motion carried 5-0. DEVELOPMENT PLANS Modification to the approved master plan of the Meadows 300 PUD Tracts C and D requested by James E. Retzke, Director of Planning and agent for the Babcock Company Mr. Annunziato informed the Council the applicant is requesting to be permitted to use more of the building area of the lot in a matter similar to that granted to the deve- loper of Tract B and Dos Lagos. Approval is recommended subject to Items A thru E in his memo of November 28, 1984. Councilman Cassandra referred to the change in setbacks being a substantial change and Mr. Annunziato replied that 7~' side setbacks is standard in the R-lA zone and they are asking this to be specified on the plan, so there cannot be further encroachment. Councilman Warnke questioned how many additional units would be allowed with the change and Mr. Annunziato replied there would be none. Councilman Cassandra asked if they wanted to move the buildings back for more front footage and Mr. Annunziato explained that one model is 54' deep and they would like to have the potential for a screen room and pool in the rear. Councilman Cassandra referred to this applying to all the lots and Mr. Annunziato agreed. Councilman Cassandra suggested that it only apply for the 54' deep house and Mr. Annunziato replied - 4 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 that could be a problem with the size of the house depending on the purchasers. Mr. Cheney added that builders build houses speculatively also. Mr. Jim Retzke came forward and stated after talking with the staff, they felt the best way would be the blanket method. He explained how they addressed all the setback problems. He further explained how they wanted to make the streetscape interesting and enable buyers to have room for screen enclosures or pools in the rear. They are trying to avoid having the owner obtain a variance for one or two feet later. Councilman Cassandra further explained his concern about setbacks in PUD's. Further discussion followed concerning the size of the houses, size of the lots, setbacks, etc. Councilman Wright moved to accept the staff recommendation finding no substantial change with reference to the memo of November 28, 1984, from Carmen Annunziato to Peter Cheney. Vice Mayor FerreI1 seconded. No discussion. Motion carried 3-2 with Councilman Cassandra and Councilman Warnke dissenting. PUBLIC HEARING Approve request to annex, rezone, and amend the future land use element for a 4.22 acre tract of land, currently vacant and undeveloped, to permit the develop- ment of the new main Boynton Beach Post Office south of West Boynton Beach Boulevard, west of and adjacent to the Boynton Plaza. These requests were submitted by Jack F. Willis for the United States Postal Service. (Continued from the November 20, 1984, City Council Meetinq - See Letter dated November 22, 1984) Mr. Cheney stated this was continued because there was some concern about the post office's willingness to comply with the city's code, which we felt was important. A letter was received from the Postal Service indicating they will comply with those things they want to. They maintain they are a federal agency. Our recommendation was they should comply with our requirements. One was the width of the right-of- way in that area, which he believes will become very busy with the use of the post office. Mr. Annunziato did meet with the post office representatives this afternoon. Mr. Annunziato reported that basically the applicant's posi- tion has not changed from that reported in the letter, except - 5 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 Proposed Ordinance No. 84-48 - Re: Amend Land Use Element - Riteco Development Corporation Mr. Cheney distributed an amended ordinance. Mr. Annunziato explained that the change involves the correction in the ordinance in that all the land use shown on the comprehen- sive plan where the Park of Commerce is going to be located west of High Ridge Road is in the low density residential category. Under discussion, Councilman Cassandra stated he was con- cerned about this PID not falling under a committee of environmental control and Mr. Bud Post replied that he can understand the city's position, but would hope it would not duplicate the review by the state level. Mr. Cheney advised that this particular ordinance covers land use and the deve- lopment order will cover standards. Councilman Cassandra further expressed his concern about hazardous waste situations. Proposed Ordinance No. 84-51 - Re: Riteco Development Corporation Development Order Mr. Cheney explained how this ordinance adopts the develop- ment order. Mr. Vance added that paragraphs 16 and 17 on page 8 relate specifically to the questions raised by Councilman Cassandra. Councilman Cassandra stated this goes to the county and state and we are bypassed and Mr. Cheney disagreed and read paragraph 17. Councilman Cassandra clarified that his concern is before the fact and not after- wards. Vice Mayor Ferrell made a motion to adopt Ordinance No. 84-51 on first reading, seconded by Councilman Wright. Under discussion, Mrs. Boroni advised the blanks in Section 1 should have published in The Post Extra on September 6, 1984. Mr. Bud Post requested that the first paragraph on page 2 change "will" to "may" result and insert in recognition of such "possible" impact. They are hiring an expert and will report the results to both parties. The study is on civic and non-recreational impact. The study is to determine how great those impacts would be. Mr. Cheney clarified that the study is not to determine how great those impacts will be, but to determine when certain things happen and what the - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 contribution will be. It will study the issue of the appropriateness of the civic dedication ordinance similar to our recreation ordinance. Mr. Post stated the study is to determine whether the impacts are substantial or insignifi- cant. If insignificant, then no impact fee would be necessary. Mr. cheney disagreed. Councilman Cassandra stated he thought the concern was that we were charging too much and we agreed to get an impartial person to see if our formula was too high. Mr. Vance stated he concurred with the City Manager and Councilman Cassandra. He would resist any changes to this paragraph. He asked if the developer was agreeable or should this be studied and delayed and Mr. Post replied that it is not important enough to delay, but he thought the purpose of the study was to determine whether there was substantial impacts. Mr. Post referred to paragraph (f) on page 14 and questioned if this had been changed and Mr. Vance replied affirmatively that it has been changed stating at the time of issuance of building permits. Mr. Post stated he would like to discuss that and Councilman Cassandra suggested that Mr. Post meet with Mr. Cheney and get these clarified. Mayor Zimmerman referred to discussing this at the workshop meeting last night and Mr. Cheney stated as the Council requested, he reviewed the discussion from the meeting with the City Manager of Delray Beach. Councilman Wright inter- jected that he talked with Delray Beach Councilman Malcolm Bird and told him we are in agreement to have the city purchase property, but they do not want to. Councilman Warnke suggested it would be appropriate to present a propo- sal to the Delray Beach City Council. For the audience's edification, Mr. Cheney explained the situation existing' at the Wastewater Plant and land acquisi- tion proposals discussed. Mayor Zimmerman stated he thinks we should give direction to Mr. Sloan in regard to expansion plans for the plant. After discussion, Vice Mayor Ferrell made a motion to reject the option of a land swap and re-affirm our commitment on an appraisal for the front piece of property with offering to pay half the appraisal fee. Councilman Warnke seconded the motion. Under discussion, Mayor Zimmerman referred to the engineering firm proceeding and Mr. Cheney advised he will send a letter to the Mayor of Delray Beach. Motion carried 5-0. - 18 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 Approval of terms for purchase of property of Boat Ramp Park Mr. Cheney referred to having discussions with Mr. Stroshein and Mr. Moore and advised an agreement has been reached and a written document will be forthcoming. We have set aside approximately $326,000 for this purchase in the budget and the proposed purchase price is $385,000. That price is con- sistent with appraisals. There is an assumable existing mortgage of $40,000 on the property. He recommends accepting the mortgage at 7% interest and paying off gra- dually. The difference between $326,000 and $345,000 can be made up with continuing the leases for at least one year. Currently over $2,000 per month is being received on the existing leases. If the Council agrees, he will tell the tenants they can stay at least one year. He would like to know if this is acceptable to the Council. Councilman Cassandra made a motion to have the City Manager and City Attorney proceed with negotiations and get rid of those cubicles when the boat ramp is completed. Councilman Wright seconded the motion. Under discussion, Councilman Warnke asked if the existing leases expire one year from now and Mr. Cheney replied negatively as they are month to month leases. Councilman Warnke requested that it be included in the motion to continue these leases for a period of only one year. Mr. Vance advised there are no written leases. Councilman Warnke asked who would be the landlord and Mr. Cheney explained that the bait and tackle shop is a direct lease and a lady in the single family house handles the others. Motion carried 5-0. Lease with Boynton Beach Child Care Center Mr. Cheney stated we have in existence a lease on city owned property for the Child Care Center which technically owns the building. The programs are operated by the Community Action Council. The leases run out in 1990. For some time, the Child Care Center has been raising money for expansion and now, they have apparently raised enough money to begin building. They wanted to pour footings this week, but we would not give them a permit considering six years remaining on the lease. Also, there has been discussion about relo- cating the Child Care Center, but they want to expand where they are. Councilman Warnke referred to the Public Works Complex expanding on this property and Mr. Cheney agreed there is no question that additional land for the Public Works Complex would be useful; but if it is not available, we will use what we have. Ideally, he thinks the Rainbow Grocery building would be better for the Child Care Center with a - 19 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 lot of land and not in an industrial area. On the other hand, they are functioning in the present location and it is working. Councilman Cassandra suggested tabling this particular question until meeting with the director of the Child Care Center and hearing her preference. He believes they don't want to move. Also, the traffic on Seacrest Boulevard should be considered. Councilman Wright stated they do want to stay there. He would like to see a much better facility. Since they have started, he believes we should extend the lease and allow them to remain there awhile. Councilman Cassandra pointed out that the capital improvement program includes a Public Works Complex and that would have to stop or be redesigned to allow this center to remain. Mr. Cheney agreed if the center stays there, changes at the Public Works Complex would be done on the present land. After further discussion, Mr. Cheney suggested formalizing our relationship with the Child Care Center's Board of Directors and reaching an agreement. Councilman Cassandra moved to table, seconded by Councilman Warnke. No discussion. Motion carried 5-0. Union Contract with Fire Department Mr. Cheney referred to negotiating with the Fire Union for some time and advised last night, the union agreed to accept the wage proposal on page 16 giving a 4% adjustment beginning November 1 with an additional 2% beginning June 6 and also including the dental plan. This is what was origi- nally offered and now being given a month later than origi- nally offered. He recommends approval with execution authorized contingent upon them being sure all the wording is in. He recommends acceptance of this negotiated agreement with the Fire Union as presented. Councilman Warnke asked when the original contract expired and Mr. Cheney replied as of the end of September, but they have been working under an extended contract. Vice Mayor Ferrell made a motion to approve this contract contingent upon the Fire Department approving and giving the City Manager authorization to make any minor changes required. Councilman Warnke seconded and the motion carried 5-0. - 20 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 4, 1984 OLD BUSINESS Response to previous City Council requests for information: Status of Comprehensive Plan update requested by Councilman Nick Cassandra Mr. Cheney referred to submitting a self-explanatory report and explained how we are at the evaluation and appraisal stage. Councilman Cassandra asked if it is possible to get a super- ficial overlay on the original plan to see what is being changed and Mr. Annunziato explained the plan is to list each policy statement or actual statement or objective and provide an analysis by department of what the change was, whether the objective was accomplished, etc. When the final package is submitted, it will show what is in the plan and what the response is. Report on City regulations concerning screening of dumpsters Councilman Cassandra asked if there was anything which could be done about the appearance of dumpsters and Mr. Cheney told about these being a continuous problem. NEW BUSINESS NONE ADMINISTRATIVE Request for conference expenses by Councilman Warnke Councilman Warnke told about a conference sponsored by the Environmental Service Center in Tallahassee entitled Florida Paradise Regained with the whole theme being we can have development along with preserving what we have. He feels it would be an asset to the city to have him or anyone par- ticipate and bring back all the material we possibly can. He would pay his own transportation and meals. The registration is $135 plus hotel charges for four nights. Vice Mayor Ferrell made a motion to authorize Councilman Warnke to attend this conference and pay his expenses of $395. Councilman Wright seconded the motion. Consider U.S. Conference of Mayors Program - City Photo Program Mayor Zimmerman referred to this program outlined in a letter dated November 19 and asked if anyone had any ideas. He suggested that a chairman be appointed and follow it through. Councilman Cassandra suggested obtaining more information. Mayor Zimmerman stated he would send in the card and keep the Council informed of the response. PUBLIC AUDIENCE Beach Project Mr. Ben Uleck, 1507 S.W. 17th Avenue, referred to the beach project still not being completed and questioned the penalty clause being enforced and Mayor Zimmerman replied that a large part of the beach has been used and it is practically 100% completed. Councilman Warnke referred to the contract requiring substantial completion and Mr. Cheney advised that it was substantially completed as of November 10 or 12, but there is a list of punch items to be completed together with change orders. Mayor Zimmerman suggested that everything be checked before payment is made and Mr. Cheney agreed this would be done and explained how contracts are administered by the city. Mr. Uleck further insisted that the contractor should pay the penalty clause and told about what he had observed at the beach. Mr. Cheney clarified that it was our judgment on the date of November 10 or 12, it was substantially completed and the penalty date ran until then.
