AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, IMPLEMENTING
THE "FLORIDA CLEAN INDOOR AIR ACT; FLORIDA
STATUTE 386,201 ("ACT'S; ADOPTING THE
PROVISIONS THEREOF; PROVIDING FOR ENFORCEMENT
AND PENALTIES; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE,
WHEREAS, it is the intention of the City Commission of the City of Boynton
Beach to implement the "Florida Clean Indoor Air Act", F.S. 386.201 (the Act) and
recognize and strongly support the legislative intent of the Florida Clean Indoor Air
Act (F.S. 386.202)("Act'), to wit:
"386.202 Legislative Intent. The purpose of this part is to protect the
public health, comfort and environment by creating areas in public
places and at public meetings that are reasonably free from tobacco
smoke by providing a uniform statewide maximum code. This part
shall not be interpreted to require the designation of smoking areas.
However, it is the intent of the Legislature to discourage the
designation of any area within a government building as a smoking
area."
WHEREAS, the Act allows, but does not mandate designated smoking
areas; and
WHEREAS, the City Commission supports a workplace totally free of
smoke;
NOW, THEREFORE, BE I'T RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
.Section 1. The City Commission of the City of Boynton Beach, Florida
hereby implements the "Florida Clean Indoor Air Act'; F.S. 386.201 (~'Act") and
recognizes and strongly supports the legislative intent of F.S. 386.202.
Section 2. The City Commission of the City of Boynton Beach, Florida does
designate all indoor City facilities, including common areas, as Non-Smoking areas.
Section 3. The City of Boynton Beach Police Department may prosecute
violations by issuance of Notices to Appear for violation of a City Ordinance in which
case, the penalty for each violation shall be a fine of $260.00.
