Minutes 11-20-84MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, NOVEMBER 20, 1984 PRESENT Carl Zimmerman, Mayor Robert Ferrell, Vice Mayor Nick Cassandra, Councilman James R. Warnke, Councilman Samuel L. Wright, Councilman Peter L. Cheney, city Manager Betty S. Boroni, city Clerk William Doney, Assistant City Attorney Mayor Zimmerman called the meeting to order at 7:32 P. M. He announced the Invocation tonight will be given by Father John Block, Pastor of St. Mark's Catholic Church, followed by the Pledge of Allegiance to the Flag led by Vice Mayor Robert Ferrell. AGENDA APPROVAL Councilman Warnke stated he would like to delete Item I from the Consent Agenda and have it considered separately after the Consent Agenda. Councilman Cassandra stated he has some questions to ask the City Manager after his report, which do not require any time tonight but response at a future meeting. Vice Mayor Ferrell stated under Other, he would like to discuss the agenda format. Councilman Wright stated he had an additional announcement to make. Mr. Cheney stated he would like to delete Items D and L under the Consent Agenda. He would like to add under Old Business, Item C - Status Report on Reverse Osmosis. Cguncilman Warnke moved to adopt the agenda as revised, seconded by Vice Mayor Ferrell. Motion carried 5-0. ANNOUNCEMENTS M~. Donald Vandergrift and Mr. Bob Hutzler came forward r~presenting the Palm Beach Soil & Water Conservation District. Mr. Hutzler explained the purpose of the Soil & Water Conservation District. He added it is unusual for a municipality to be involved in activities in the district, but Boynton Beach has been. The Board of Supervisors passed a resolution recognizing the City of Boynton Beach for o~tstanding service for controlling wind erosion on the d~nes at the beach. He read the things which were recom- mended to the city and explained how they were successfully - 1 - ~REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 accomplished. He then read the resolution and presented a plaque to the city. Mayor Zimmerman announced that City Hall will be closed Thursday, November 22, and Friday, November 23, in observance of Thanksgiving. Mr. Cheney added that one of the newspa- pers erroneously reported that our garbage collection has not changed, but it has for the holiday and the regular Thursday pickup will be on Wednesday. Councilman Wright announced that he will be having a Gospel Extravaganza Benefit for Child Care and Sickle Cell on Saturday, December 1, 1984, at the Civic Center, at 7:30 P.M. He then acknowledged the presence of his fiancee, Sherrina Ford from Tampa, in the audience. Mayor Zimmerman recognized the presence in the audience of Ms. Janet Olin, aide from Representative Messersmith's office. MINUTES Regular city Council Meeting Minutes of November 7, 1984 Councilman Cassandra clarified that on Page 9, Crown Liquors was not granted a permit. Councilman Wright moved adoption with the noted correction, seconded by Councilman Cassandra. Motion carried 5-0. Special City Council Meeting Minutes of November 8, 1984 Councilman Cassandra moved to accept as presented, seconded by Vice Mayor Ferrell. Motion carried 3-0 with Councilman Warnke and Councilman Wright abstaining. CITY MANAGER'S REPORT Certificates of Occupancy at Cherry Walk Mr. Cheney told about potential residents of Cherry Walk being concerned about the issuance of certificates of occu- pancy and explained these will not be issued until the problems with the utility system are resolved. The comple- tion of the utility system is probably three weeks away and it depends entirely upon the developer and the engineer coming to terms and there is nothing the city can do about it. He further explained that the delay was caused by financial problems of the developer and the city is not involved. - 2 - ~REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 United Way Program Mr. Cheney referred to the city employees participating in the United Way program and reported how their contributions had increased each year with a total of $10,600 being collected this year which is 13% above last year. Billboards on Congress Avenue The City Manager referred to billboards along Congress Avenue and reported that property on the north end recently came into the city and the billboard has been removed. Intracoastal Bridge Mr. Cheney reported that we have received a copy of the hearing officer's report relative to the bridge issue brought by a property owner in Ocean Ridge. We are not involved in the hearing. We will respond to this report indicating the status of the bridge in context of the Boynton Beach Comprehensive Plan. He explained that this project will probably continually be challenged. Comprehensive Plan Revision Councilman Cassandra referred to the revision of the Comprehensive Plan taking place during the past ten months and stated he would like the City Manager to set up a workshop so the City Council can see what is going on. There are M-1 areas in the city being built quite rapidly with different kinds of buildings with no aesthetics. He would like to have something on the outside to hide what is on the inside. Environmental Review Councilman Cassandra stated he would like a resolution or code to tighten UP environmental review. Any PID zone should go through environmental review. Dumpster Codes Mr. Cassandra stated in going around the city, some dumpsters are screened in and there are some which have screens which are broken and not repaired. He would like the code tightened, so garbage is hidden from the people. - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA CONSENT AGENDA A. Bids 1. NOVEMBER 20, 1984 Ten (10) Smith & Wesson Model 64 Revolvers - Police The Tabulation Committee recommends awarding the bid to the low bidder, Lawman & Shooters, in the amount of $162.22 each for a total amount of $1,622.20. One (1) Complete Unit: Chassis for 20 cubic yard trash body w/20 cubic yard trade body and PI TL-3 lightning loader with slide control - Public Works The Tabulation Committee recommends awarding the bid to Petersen Industries Machines, Inc. in the amount of $38,814.75. Cleaning and Repainting of Eimco-Envirotech potable water clarification unit and painting exterior concrete at three (3) units - Utilities The Tabulation Committee recommends awarding the bid to two vendors taking the low bid of each project - exterior awarded to Don Gagnon Painting & Waterproofing in the amount of $7,600 and interior awarded to Brinkerhoff Painting & Sandblasting in the amount of $19,499. Congress Avenue Boynton Beach, FL 33435 The Deputy Building Official noted zoning for the above address permits the sale of beer, wine and liquor for con- sumption off premises. Approve Reservation Fees for Picnic Shelters - Public Beach Mr. Frederick recommends that if groups wish the privilege to reserve a shelter, an appropriate fee should be required. He recommends a $25 per day fee for reserving a shelter. If shelters are not reserved, they would be available on a first come, first serve basis. In addition, he also recom- mends a $50 damage/cleanup deposit, which would be returned to the user group upon inspection of the area after use. Councilman Cassandra questioned how this could be enforced if someone gets there before the group making the reservation and Mr. Cheney replied that signs will be put up indicating the reservation. Councilman Cassandra questioned when the inspection for cleanliness would be made and Mr. Cheney explained this could be done when they leave as employees are at the beach all the time. Councilman Wright commented that he knows it is customary about paying a fee for reserving something, but he doesn't know if he is in favor and would like this done on a trial basis. Mr. Cheney replied it offers a special opportunity and there is cost for the city to go through the reservation process. He added that the county has this procedure and he does not think the fee is large. Concur with Recommendation of Community Relations Board for Funding of Day Care Title XX Program The Community Relations Board recommends that the City Council concur and a grant of $4,396.04 be forwarded for this purpose as noted in the City Manager's memo dated November 20, 1984. - 5 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 Go Approve Transmittal of Road Improvement Fees for Palm Beach County The Finance Director has reviewed the collections as noted in his memo dated November 14, 1984, and finds them in order and recommends they be transmitted to Palm Beach County. Approve Request by Scott Atkinson, Project Engineer for Haynes-Siefried Construction Company, to place nine construction trailers and a security fence in conjunc- tion with the building of Burdines at the Boynton Beach Mall In accordance with Chapter 25, Section 25.7 of the City of Boynton Beach Codes of Ordinance, the Building Official recommends approval. The trailers and security fence will remain for the duration of the Burdines project. J. Payment of Bills - Month of October, 1984 See list attached. K. Acceptance of Deed for Knuth Road The Planning Director submitted this right-of-way deed for the Council's acceptance. M. Approval of Bills See list attached. Councilman Cassandra moved to accept the Consent Agenda, Items A, B, C, E, F, G, H, J, K, and M. Councilman Warnke seconded. Motion carried 5-0. Approve Request by Lanny Gelfand, President of Pioneer Roofing to place an office trailer on West Industrial Avenue. Property is being temporarily leased with an option to purchase, and said trailer would be used for sales purposes. Due to the uncertainty of the purchase of this property, the Building Department does not recommend approval. Mr. Cheney clarified that the recommendation is to deny this request. Councilman Warnke moved to deny the request for the trailer applied for by Pioneer Roofing. Vice Mayor Ferrell seconded and the motion carried 5-0. - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 BIDS Award of Bid for Boat Ramp Park Reconstruction Mr. Cheney referred to a sheet analyzing the bids and then distributed another sheet with slight modifications. He explained how miscellaneous was deducted on a prorated basis, but this was not fair after the contractor gave clarification. After the miscellaneous amount was justified, it was left in and deductions were made from con- tingencies. Included in the proposal is an outline for funding. Mr. Cheney then referred to his memo indicating where we stand with the Boat Ramp Park and clarified that all would be done except the finger walkway, floating dock area and bulkhead around the cove. He would like to come back at some point and do the fishing dock and sees in the capital improvements program how that might be funded. These things can be a separate project at a later time which will not cause any disruption to the park. This park will function with boat launching facilities, restrooms, landscaping, parking, road, additional shelter, drainage and the utili- ties solved. Councilman Cassandra referred to approving $25,000 at the last Council meeting for Congress Middle School and stated if he knew that was going to take away from Boat Ramp Park, he would not have voted for it. He explained how he felt BOat Ramp Park serves more citizens. Mr. Cheney replied that we still wouldn't have had enough money and Mr. Cassandra understood that, but he would have liked to have known about this and had the opportunity to evaluate priori- ties first. Mayor Zimmerman asked where this contractor is located and Mr. Cheney replied in Boynton Beach and he did the clubhouse and shelters in the golf course. Vice Mayor Ferrell made a motion to accept this bid, seConded by Councilman Warnke. Motion carried 5-0. Mr. Cheney added that he will have a report at the next Council meeting regarding the land acquisition in front of this park. Mayor Zimmerman announced that the Vice Mayor just reminded him that Public Audience was omitted and suggested it might - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 be best to proceed with the second bid first. Councilman Wright moved to have the Public Audience period at the close of Public Hearings, seconded by Vice Mayor Ferrell. Motion carried 5-0. Approve Agreement with Barnett Banking for City Banking Service Mr. Cheney referred to putting the city banking services out to bid about three years ago and advised at that time, the best proposal was received from Florida National Bank. This is the way we can be sure our costs of banking are limited and we have an above minimum amount of funds invested every day. We still have the opportunity at any time to invest funds as we want to. Now, we have gone out for proposals again. The Finance Director has reviewed the bids received in detail. He recommends that we award our banking services to Barnett Bank. He explained the chart submitted On which this recommendation was based. Councilman Wright questioned what happens to the checking a~counts of city employees currently at Florida National Bank and Mr. Cheney replied they can transfer to Barnett Bank if they want to. Councilman Wright asked if there w~uld be a service charge put on their current accounts and Mr. Swann advised after the city terminates with Florida National Bank, the city employees would have to pay for their checking accounts. Councilman Warnke questioned the effective date and Mr. Cheney replied it would be February 1 to have checks reprinted, relations adjusted, etc. Councilman Wright moved to adopt this recommendation for banking, seconded by Councilman Cassandra. Motion carried 5-0. PUBLIC HEARING Approve request to annex, rezone and amend the land use element of a 17.7 acre tract of land currently vacant and undeveloped to permit the development of a planned unit development to be known as Lakes of Hypoluxo on the south side of Hypoluxo Road, 1500 feet west of Congress Avenue. These requests were submitted by Richard Whalen, agent for Walter H. Janke. Mr. Annunziato informed the Council this is a request to annex, rezone and amend the land use element to show annexed land as low density residential and he explained the loca- - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 tion. He further explained that this property meets the Comprehensive Plan conditions for annexation. He told about the development planned. Comments from the city staff have been submitted. Included in his comments are the comments from the County Traffic Engineer. As proposed, the number of units exceeded the low density category; however, with the criteria placed, the applicant will drop under and fall into the land use category. Mayor Zimmerman referred to the other two pockets in this area annexing and Mr. Annunziato replied that he did notify the property owners to the east and west. He did have a followup conversation with the property owner to the east, who has a nursery, and he was not interested in annexation, but does recognize his future is with the City of Boynton Beach. The property owner to the west had very little com- ment. Mr. Annunziato continued that Hypoluxo Road does form the north limits of the reserve annexation area and the city wraps around on the south and goes to Lawrence Road. Councilman Warnke referred to this presently being agri- cultural and Mr. Annunziato agreed that is the present zoning, but it is not being used for agriculture purposes. Councilman Cassandra questioned if the increase in frontage to 55 ft. would still allow 87 units and Mr. Annunziato informed him it would decrease to 75 units and approval is recommended subject to staff comments. Mr. Chris Hurst, Paramount Engineering Group, showed a print with the 55 ft. lot frontages requested and pointed out the number of lots would be 78 with a gross density of 4.4. Councilman Cassandra asked if he was in agreement with all the staff comments and Mr. Hurst replied affirmatively as he doesn't believe anything will present a problem. Mayor Zimmerman ascertained there was nobody present in the audience wishing to speak either in favor or opposition to this request. Councilman Cassandra moved to approve this based on the Planning & Zoning Board's unanimous recommendation subject to staff comments. Vice Mayor Ferrell seconded the motion. Under discusSion, Councilman Cassandra read Item 6 on Mr. Annunziato's memo and suggested possibly including a certain number of years to give a general time that we will recoup our service. He suggested possibly adding an additional item noting our water supply is still adequate at the pre- sent moment. - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 Councilman Warnke stated this is another example of 17 acres of reserved agriculture land being changed to development. He personally cannot see this and is going on record not in favor of annexing or converting any more land from agri- culture to development. Councilman Cassandra responded that there is nothing wrong with Mr. Warnke's statement, but it would be in conflict with rounding off our boundaries. Councilman Warnke stated he did not see any aesthetic value of rounding off the boundaries and the voters also said not to annex. Vice Mayor Ferrell clarified that the voters approved rounding off the boundaries and also, this is not being used as agriculture. Motion carried 4-1 with Councilman Warnke dissenting. Approve request to annex, rezone, and amend the future land use element for a 4.22 acre tract of land, currently vacant and undeveloped, to permit the develop- ment of the new main Boynton Beach Post Office south of West Boynton Beach Boulevard, west of and adjacent to the Boynton Plaza. These requests were submitted by Jack F. Willis for the United States Postal Service. Mr. Annunziato explained the location. This request was reviewed by the staff and approval recommended subject to comments. It does meet the present conditions imposed in the comprehensive plan with the consideration of no taxes being paid to the city. However, the postal service is subject to municipal service fees and construction fees. There is one issue which remained unresolved at the Planning & Zoning Board meeting concerning access to the site, par- ticularly the 30 ft. road separating this tract from Boynton Plaza. He pointed this out on the plan. The postal service is willing to dedicate an additional 10 ft. of right-of-way to meet the suggestions submitted by Mr. Walker. However, with a 40 ft. right-of-way, it does not address the need of a sidewalk or drainage. They have suggested they would be willing to place a sidewalk on their property in an easement to the city. With respect to the staff's position and the Planning & Zoning Board's, it was very clear the motion included to endeavor to secure the proper right-of-way. His recommendation is to continue to ask for 20 ft. However, the postal service has found some limiting conditions on the site which may prevent them from moving the building to the west. He has modified his recommendation that an additional driveway be provided to the north. - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 Councilman Warnke asked who would be paying for this road and Mr. Annunziato replied that the postal service would. Councilman Cassandra asked if this is the road of contention about traffic in that shopping center and Mayor Zimmerman replied negatively. Mr. Annunziato pointed out this road. Discussion ensued about the importance of this road and the right-of-way width necessary. The plans were then consulted and there was discussion about the possibility of moving the building. Mr. Jack Willis, Architect, representing the United States Postal Service, stated they are willing to give 45 feet up to the first driveway, which is sufficient width. They are requesting that 45 feet be considered because they are 100% through the design on the building and it would require a redesign if going to 50 feet. They would also include a sidewalk, curb and gutter and three lanes of traffic. They would be willing to give 10 feet from that point to the end of their property. Also, in the design of the street, it would take all the drainage to the northeast corner of the property. Councilman Cassandra stated if he is pushed to vote now, he could not vote favorably. He asked if it would be con- venient to table this, so he could spend more time analyzing this. He asked if it would hurt the time schedule. Mr. Phil Ferrari replied that they would appreciate if more time was given to look at their position. Construction is not anticipated being started until February or March. Councilman Warnke stated his own personal position is he can see no reason why the city should annex this property. It has been brought out the Boynton Beach Post Office should be in Boynton Beach, but we have one and this one could serve out to Loxahatchee on the edge of the Everglades. The people who will go there could care less whether it is in the city limits or not. We would be furnishing fire and pQlice services and get no taxes. He would just as soon let it be a county problem. M~. Cheney pointed out that consideration must be given of a possible problem by not requiring the post office to meet the requirements of a 50 ft. right-of-way standard when small private developers must meet the requirement. It is unfortunate they have designed it, but it can be changed. In response to the comment about annexation, he requests that consideration be given to having logical service boun- daries for municipal services. We have to consider where - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 our responsibilities lie in the most economical position with police and fire. We must think about the county coming in to serve that area which is pretty much surrounded by the city. Vice Mayor Ferrell asked if this was left in the county, what right-of-way would be required and Mr. Annunziato informed him the county's position is they would only accept 50 feet, which is the minimum for a subdivision. Mr. Ferrari stated they would certainly like to be in the City of Boynton Beach. The request to annex was not their request, but was a request from the City of Boynton Beach. The post office will operate whether in the city or county. Mayor Zimmerman added that a lot of cities have the post office outside the city limits. Mr. Ferrari requested this to be tabled, so they can con- tinue discussion with the Planning Department. Councilman Cassandra moved to continue this request to December 4, seconded by Councilman Wright. Motion carried 5-0. Approve request to amend the future land use element from Moderate Density Residential to Office and Professional Commercial and to rezone from R-1AA (PUD) Single Family Residential to C-1 Office and Professional District for a parcel of land located in the northwest corner of Woolbright Road and LWDD E-4 Canal. These requests were submitted by Charles F. Hill for Roger Saberson. Mr. Annunziato explained the location of the site and zonings bordering the property. He stated that he submitted a report and recommendation. One issue raised in developing this property was the impact on surrounding properties and since it is separated by an 80 ft. canal, it is felt it could be developed without causing a sufficient adverse impact on the residences to the north. This land is approximately 4 feet higher than the property to the north and it is recommended a 2 ft. hedge might be required in the middle of the wall to separate the property to the north in noting the land elevation and lights. He referred to the proposed use being a medical office facility and explained there didn't appear to be any conflicts. He explained that the property probably could be developed for single family purposes. He referred to consistency with the comprehensive - 12 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 plan and explained that traffic access was sufficient and it was determined there would be minimal impact on nearby resi- dences. Approval is recommended. Councilman Cassandra asked if we could stipulate what should be built and Mr. Doney replied negatively because if rezoned to C-l, whatever is allowed in that zone can be built. Councilman Cassandra referred to stipulating the permit should be pulled out within 90 days or revert to the origi- nal zoning and Mr. Doney advised that he did not think that would be appropriate. Mayor Zimmerman asked if there could be an agreement outside the zoning to allow a one story building instead of two and Mr. Doney replied negatively as whatever the zoning category permits must be allowed. Councilman Wright asked what was planned and Mr. Annunziato t~ld about the plans to build an eye clinic, but this cannot be stipulated. ME. Charles Hill, agent, informed the Council there is a purchase contract on this property subject to it being r~zoned to C-1 and he read a clause included noting it will b~ for medical and professional offices. Mayor Zimmerman referred to a time limit and Mr. Hill replied they will start as soon as possible and six months is given for a m~rtgage commitment. Councilman Warnke stated that Dr. Chua has been in the pro- f~ssion in Delray Beach for many years and is very r~spected. He doesn't think he would have any other use for thi~ land· He feels he would be an asset to the city. Mayor Zimmerman asked if anyone else was in favor of granting this rezoning and land use amendment and received n6 response. He asked if anyone was in opposition. Mr. Paolella, 1600 S.W. 14th Avenue, stated he lives directly behind this property. In speaking on behalf of the n~ighbo~s along the canal from the w~st side to the east side, they are not opposigg this, however, they would like to go on record they are ~n favor of this with the provision that the site plan show a 6 ft. masonry wall being erected from the northwest existing property line to the northeast corner to the southeast corner. Mr. Hill replied that the developer will stipulate they will conform to the recommen- dations of the Planning & Zoning Board in that regard. Mayor Zimmerman clarified that the recommendation was for a north wall only and Mr. Hill replied that he didn't know - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 what purpose it would serve to have a wall on the east~' because on the other side of the E-4 canal is a retention pond and then commercial zoning. He thinks a block wall would prevent any lights from bothering people to the north of the canal and does not think it would have to go around to the southeast corner. They will abide by the stipulation of the Planning & Zoning Board on the site plan. Mayor Zimmerman asked if the Council had control over the site plan requiring a wall along the canal and Mr. Annunziato replied that the City Council has that au%hority. The code says a hedge may be substituted for a wall. The Planning & Zoning Board, staff and City Council have the ability to make these determinations. With the difference in elevation, the staff did recommend a wall. There was further discussion about the necessity and location of a wall and Councilman Warnke clarified that the site plan will come before the Planning & Zoning Board and City Council and the wall is not the issue right now. Councilman Cassandra moved to accept the Planning & Zoning Board's unanimous recommendation for the rezoning of R-1AA (PUD) to C-1 office and professional district. Councilman Warnke seconded the motion. No discussion. Motion carried 5-0. Approve request to construct a 10,684 squ~re foot truss plant on a 1.24 acre site at 1401 Neptune Drive to be known as the Novatek Truss Plant. This request was sub- mitted by Raymond M. They have found they can make the recommendation this would be consistent under conditional uses allowed. This request was presented to the Community Appearance Board and subsequently approved. Mr. Raymond Baribeau stated they agreed with the comments 98% and have resolved the other 2%. PUBLIC AUDIENCE Lane Designations on Woolbright Road Mr. Philip Fisher, 35 Crossings Circle, stated he would like to bring attention to the lane designations on Woolbright Road from 1-95 to Seacrest Boulevard and advised these are non-existent and extremely dangerous at night. Mr. Cheney stated this is a county road and we will bring it to their attention. He added that he would hope that citizens who have concerns with the county would feel free to contact the County Commission directly also. Cable Television Pornoqraphy Mrs. Florence Torregrossa, 2045 S.W. 24th Circle, stated she would like the Council to consider a proposed cable televi- sion resolution. Other cities have this in force and it is very important. This should be considered because it is affecting all of our lives. Attorney Frank Kriedler, 521 Lake Avenue, Lake Worth, stated he represents this group and their specific concern is por- nography which is being broadcast through cable television, which is rapidly expanding. He explained the resolution states concern about the particular problems set forth and asks the Florida State Legislature to legislate in that area. They request the resolution be adopted and forwarded to the appropriate people as stated in the resolution. Councilman Warnke referred to the residents' rights and explained how he felt we should not tell people what they should do within their own homes. Councilman Cassandra suggested having Mr. Doney give a legal opinion whether we can act on such a resolution or not. Vice Mayor Ferrell commented that he is not interested in getting involved and does not think it is the City Council's concern. - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 Councilman Wright commented that he understands the rationale behind this. He feels it should be done in the proper prospective. He thinks this is asking too much. When people pay for cable television service, they should be able to watch what they want. Mayor Zimmerman suggested that the City Attorney revise this proposed resolution into our form and Mr. Cheney pointed out that three members were not in favor. Mr. Doney advised that he could look at it, but believes it would be a dif- ficult area to legislate. After further comments, Mr. Kriedler stated he understands with three votes, nothing will be done, but he would like to be notified if there is a change. OLD BUSINESS Response to previous City Council requests for information Golfview Harbour street sign replacement and bridge cleaning Mr. Cheney reported the signs were checked in this area and have been taken care of. Painting of the fence has also started. Councilman Wright requested that a copy of the report be sent to Mr. Kanonik. Report on permit fee for American Legion new construc- tion Mr. Cheney informed the Council he could not give a figure because the plans have not been submitted for a fee to be calculated. Councilman Cassandra referred to plans being submitted and Mr. Carl Washington, Commander of Post 288, came forward. He explained that they are ready to submit the plans now and proceed with the permit. Mr. Cheney requested these plans to be brought in as we cannot act until receiving them. Mr. Annunziat© added that their property is in a R-3 zone and lodges are a conditional use, which is subject to a public hearing. He explained how there were several steps to go before securing a permit. Mr. Cheney stated if their - 22- Consider accepting Forest Hills Park recreational property from Palm Beach County Mr. Cheney referred to a meeting being scheduled with the Board on Monday and Mayor Zimmerman announced this would be left on the table. REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 application is submitted, we can have documents to see what is required to proceed. Councilman Wright requested the requirements to be submitted in writing to them and Mr. Cheney replied that he will work with Mr. Leroy Harris. Response to questions concerning occupational license fee structure for merchants Mr. Cheney stated some time ago, there were questions about the occupational license fees and the process we are going through to update our enforcement consistent with our code. The Chamber of Commerce was asked to look at our procedure and in response, they submitted a report dated November 6, 1984. They concluded that what we are doing appears to be reasonable and legitimate. Also, Mr. Keehr has advised that collection has been 80% to 90% on this phase with little concern. We are doing the same thing with contractors. We just received from the state a directory of real estate a~ents and will be sure they also pay their appropriate fees. He stressed that we are trying to be sure this is equitable. Councilman Warnke complimented the Chamber of Commerce for their report and Councilman Wright agreed and acknowledged their great work. Review of funding proposal and schedule for Capital Improvement Program Mr. Cheney referred to submitting a report and explained what was said at the last meeting has been reflected with i~entifying three possible ways of funding capital improve- m~nts He outlined the funding methods and advised the first two sheets attempt to look at projects, suggestions on funding, how that expenditure might be by fiscal year and schedule. The next page is a summary of items that might be by general obligation bond issue and he will be meeting next week with the bond attorney to talk about alternatives of packaging those items in different referendum matters. SUggested is a city government complex, public works complex and multi-purpose building. Page 5 shows some projects which might be funded over a period of time out of the operating budget. The last page does a similar kind of thing for the utility service tax. This addresses some pro- jects which we have not put into the cycle. Mr. Cheney continued that he also prepared dates pertaining to when these will be needed to be put on the ballot. - 23 - REGULAR CITY COUNCIL MEETING ~BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 Proposed first reading of a referendum ordinance would either be December 18 or January 2. Second reading could be January 15 or February 5 at the very latest. This has to be to the Supervisor of Elections by February 8 for the elec- tion on March 12. Also, by the next meeting, it is hoped we will have the current assessed values in the city. After discussion of some of the costs and priorities, Councilman Cassandra suggested having a workshop for clari- fication. It was then agreed that a special .workshop meeting would be held on Monday, December 3, at 7:30 P. M. Status Report on Reverse Osmosis Mr. Cessna reported to the Council that Post, Buckley, Schuh & Jernigan have been working on this with several phases. The first phase was to find out about water out of the canal as a source rather than wells. Mr. W. J. Conlon told about their studying the feasibility of using canal water and consulting with various agencies. He reported-that the agencies agreed ground water supply should be considered over surface water supply when available. He explained that a dual treatment system would be required in that there are seasonal changes in the water. He outlined the objections and requested they be given approval to continue to the second phase. Mr. Conlon then referred to disposal of the reject water and explained the various methods would be considered in the second phase. At this time, they are asking permission to go ahead with the second phase of the study. They feel the city should move ahead installing test wells and production wells to get a cost comparison analysis. Councilman Warnke questioned what percentage of reject would be drinkable water and Mr. Conlon replied that 75 to 85% is shown as recoverable and he explained how they felt there could be a higher recovery rate. Councilman Warnke referred to additional wells and Mr. Cheney clarified that we went into this to see if there is an alternative method of using surface water. It is not known how much water is going out the Boynton Canal and the quality of that water has not been tested. The control agencies report the quality of that water goes up and down depending on seasons, agriculture conditions, etc. They recommend having a backup treatment system because of not - 24 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 knowing the quantity or quality of that water. Now, they are requesting to compare the two treatment costs of reverse osmosis and lime treatment. Councilman Cassandra moved to approve the second phase of this study. Councilman Wright questioned the cost and Mr. Cheney replied it would be included within the $35,000. Councilman Wright referred to reverse osmosis being an expensive and costly project and Mr. Conlon disagreed and explained. Councilman Cassandra moved to authorize Phase II and look at the cost factor of reverse osmosis within the budgeted amount. Vice Mayor Ferrell seconded the motion. No discussion. Motion carried 5-0. Board Appointments - Consider changing annual appointments to staggered terms - Requested by Councilman Cassandra Councilman Cassandra referred to some of the boards having one year terms and stated with the growth of the city and down- town development, he feels we should have continuity on the boards with staggered terms. He would like to charge the City Manager to come back with some alternatives, so we can decide on this so the new Council can appoint people for particular terms. ADMINISTRATIVE Concur with appointment of Vice Mayor Robert Ferrell to Florida League of Cities Ethics and Personnel Committee and Councilman Samuel Wright to Florida League of Cities Intergovernmental Relations Committee and concur with appropriate expenses to attend required meetings Councilman Cassandra referred to their attendance being required on certain dates and stated he is concerned they - 25 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 20, 1984 possibly might be needed here to vote on an important Council matter. Mr. Cheney explained that most of the meetings are on Fridays and that he has been on committees and has been able to attend. Councilman Cassandra stated he would like to have reports of their activities. Councilman Warnke added that it would also be helpful to know what is on the agenda before they go in case there are any concerns. Councilman Cassandra suggested leaving the information for the meetings in the Mayor's office for review. Establish date for first City Council meeting in January 1985 Mr. Cheney referred to the code not providing for a change in meeting dates in the case of a holiday. Councilman Warnke moved that the first regular City Council meeting in January be Wednesday, January 2, 1985. Vice Mayor Ferrell seconded and the motion carried 5-0. OTHER Agenda Format Vice Mayor Ferrell made a motion to move the Public Audience from where it is on the agenda to follow Other as the last item on the agenda. He referred to items under Public Audience usually just affecting a small group and stated this would enable us to move along a lot quicker. He thinks it would help the public aspect of the meeting. Councilman Warnke suggested it might be helpful to have a public rela- tions person in the city which would save time. Councilman Cassandra suggested putting a time limit on Public Audience. MaYor Zimmerman commented that it is a good service to the cQmmunity to have the public audience period and a lot of people like where it is on the agenda. Councilman Warnke stated he would hate to see people having a valid thing to bring before the Council having to wait until 11:00 P.M. or m~dnight. Councilman Wright suggested experimenting at the next meeting. Mr. Cheney referred to the development plans being routine and suggested possibly a full package could be submitted to the Council members for review and they could be placed under the Consent Agenda.
